SUBJECT: Parking Garage Contract for Grant Application and
Development of City DBE and Title VI Civil Rights Programs
With Morrison Maierle Inc.
MEETING DATE: June 12, 2006
BACKGROUND: The design and document preparation tasks associated with the Bozeman
Downtown Parking Garage have been under review by staff since the project is back under City
responsibility. The federal money awarded the project was made directly to the City of
Bozeman. Because the money came directly to the City, there are a number of administrative
requirements the City must meet in order for the feds to release the funds.
Attached is a contract for consultant services from Morrison Maierle Inc. The contract is for
services related to the federal grant application process and document preparation for Civil
Rights compliance and Disadvantaged Business Enterprise Goals and monitoring activities.
Proposals were received from three different vendors, (one of which submitted a response that
said they were too busy to take on more work). The proposal from Morrison Maierle was the
lowest responsible and responsive price.
The City is required to develop a Title VI Civil Rights Document. This document exceeds the
Equal Opportunity Employment program the City currently has on record. This program
requires documentation that there is no discrimination in the location, design, development or
operation of the garage.
The City will also need to develop a Disadvantaged Business Enterprise Program (DBE). This
program will develop a set of goals that the City will meet in contracting any project to make
sure there are no discriminatory practices in place. This annual goal will be a guideline in
contracting and awarding bids to contractors.
Once a project that receives federal money is under construction, the community must monitor
and report on the progress made in addressing our DBE goal. These reports are submitted to the
federal agency throughout the construction phase, in this case, to the Federal Transit Authority.
RECOMMENDATION: Contracts are already in place with Morrison Maierle for this project.
One of the reasons the proposal came in lower is because information gathered for one portion of
the project will be useful in completing another facet of the project. Staff recommends approval
of the contract.
FISCAL EFFECTS: The four parts of this contract are priced with a not to exceed dollar
amount. These four tasks total $51,270. This work will be paid for with Tax Increment funds.
ALTERNATIVES: As suggested by the City Commission.
