WILLSON A VENUE FROM GARFIELD STREET TO GRANT STREET, SAID PA VE- ME NT PROJECT TO INCLUDE THE CONSTRUCTION AND INSTALLATION OF. A I STORM S EWER LINE, CONCRETE CURBS AND GUTTERS, GRA VEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, AND BITUMINOUS SURFACE COURSE. WHE1REAS: There has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a peti tion in due form of certain owners of properties si tua ted on South Willson Avenue from Garfield Street to Grant Street in said City asking that a i 1 i t district be created for the purpose of constructing and installing spec a mprovemen '. a pavement project to include the construction and installation of a storm sewer line from Garfield Street to Grant Street, concrete curbs and gutters, gravel base course, crushed gravel cushion course, and bituminous surface course, and other work incidental thereto; and WHEREAS: That at a regular meeting of the City Commission of The City of Bozeman held on the 20th day of June 1956, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a I special improvement district to be known and designated as Special Improvement District No. 386 of the City of Bozeman for the purpose of constructing and installing a pavement project on South Willson Avenue from Garfield Street to Grant Street, said pavement pro- ject to include the construction and installation of a storm sewer line, concrete curbs and gutters, gravel base course, crushed gravel cushion course, and bituminous surface course, and other work incidental thereto. Section 2 Boundaries The boundaries of said Special Improvement District No. 386 are described as follows: Beginning at the Northeast corner of Block Fifteen ( 15) , of the Butte Addition to the City of Bozeman, thence westerly along the South line of West Garfield Street to the Northwest corner of Lot One (1), of said Block Fifteen (15); thence Southerly along the East line of the alley in Blocks Fifteen (15) and Eighteen (18), of said Butte Addition, to a point on the North line of West Grant Street; thence Easterly along the North line of West Grant Street to the Southeast corner of Block Nineteen (19), of said Butte Addition; thence Northerly along the East line of Blocks Nineteen (19 ) and Fourteen (14), of said Butte Addition, to a point on the South line of West Garfield Street; thence Westerly along the South line of West Garfield Street to the point of beginning. I Section 3 Character of Improvements Construction of a pavement pro,ject on South Willson Avenue from Garfield to Grant Streets, said pavement project to include the construction and installation of a storm sewer line with appurtenances from Garfield to Hayes Streets, combined concrete curbs and gutters, gravel base course, crushed gravel cushion course, and bituminous surface course. --.-..-- -... - .... ___..____ ".._..__._.__u__.___ .__.. 52 Section 4 Estimate of Cost The preliminary estimate of cost is Twenty-two Thousand Nine Hundred Dollars ($22,900.00) including all street excavation, trench excavation and backfill, all materials, installation costs, engineering and inciden ta Is. Section 5 I Method of Assessment The preliminary estimate of cost set forth above is to be assessed against the property within said District on a front foot basis. The cost per front foot is es- timated at $19.083333. Section 6 Actual Frontage of District The total actual frontage of all property included within said proposed Special Improvement District No. 386, is 1200 feet, which is the frontage on which all pro- tests will be received, considered and determined. Section 7 Payments Tha t pa ymen ts for said improvements shall be made in twenty (20) annual install- ments extending over a period of nineteen (19 ) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desir- es to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds I of said Special Improvement District No. 386, as authorized by law. Such bonds will be in denominations of $100.00 each and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Im- provement District No. 386 Fund of the Ci ty of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registra- tion, whenever funds are available for that purpose in said Special Irrprovement Dis- trict No. 386. Said bonds shall draw a simple interest from the date of their regis- tration until called for payment, at a rate not exceeding six (6) per cent per annum, which interest shall be chargeable as a part of the cost of the construction and in- stallation of said improvement. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special irrprovement districts in cities and towns, and any amendments there - of or thereto. Section 8 Protests and Notice I That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana on the 18th da y of ,Tuly, 1956, at the hour of one o'clock P.M. of said day, are the time and place, when and where the City Commission will hear and pass upon all protests duly and re- gularly made and filed against the creation of said proposed Special Improvement Resolution No. 812 .-- - --..------- r7'J ' ), District No. 386, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, a!1d he is hereby, directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. That Wednesday, the 18th day of July, A.D. 1956, at one o'clock P.M. at the Commis- sion Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 812 as the time and place for hearing objections to the action proposed to be taken by said re solu tion, and when and where any and all persons whose property is within said pro- posed Special Improvement District No. 386 on South Willson Avenue from Garfield Street to Grant Street in said City may appear and show cause, if any they have, against said proposed improvement. Objections must be made in writing and filed with the Clerk of the City Commission not later than fifteen (15) days after date of the first publication of this Notice. I An approximate preli~inary estimate of the cost of doing such work and making such improvement within said District, including all street excavation, trench excavation and backfill, all materials, installation costs, engineering and incidentals, which is to be specially assessed against the property within said District, is $22,900.00. The total actual number of front feet of property within the said District, exclusive of s tre e ts , avenues and alleys is 1200 front feet. Payment for the improvements is to be made in twenty (20) annual installments over a period of nineteen (19 ) years with inter- est on the deferred payments not to exceed six (6) per cent per annum, payable annually, Resolution No. 812 ;).1 But this shall not be construed to prevent payment in full at any regular payment date by any property owner. For a description of the boundaries of said Special Improvement District No. 386 reference is hereby made to Resolution No. 812 of the Commission of the City of Bozeman declaring the intention to create said District which is on file in the office of the undersigned Clark of said Commission in the City Hall of said City of Bozeman, 8ta te I of Mon tana, and open for inspection to all in terested parties and the public generally.
