COMMISSION RESOLUTION NO. 811
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN
DECLARING IT TO BE THE INTENTION TO CREATE A SPECIAL IMPROVE-
MENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO.
385 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING
AND INSTALLING A PAVEMENT PROJECT ON S01:JTH BLACK A VENUE FROM
STORY STREET TO COLLEGE STREET, SAID PAVEMENT PROJECT TO IN-
CLUDE THE CONSTRUCTION OF A BITUMINOUS SURFACE COURSE ON THE
I EXISTING BASE, AND OTHER WORK INCIDENTAL THERETO.
WHEREAS, there has been filed with the Clerk of the City Commission of the City
of Bozeman, Montana, a petition in due form of certain owners of properties situated on
South Black Avenue from Story Street to College Street in said City asking that a spec-
ial improvement district be created for the purpose of constructing and installing a
pavement project to include the construction of a bituminous surface course on the exi s t-
ing base, and other work incidental thereto; and
WHEREAS: That at a regular meeting of the City Commission of The City of Bozeman
held on the 20th day of June, 1956, the aforesaid petition was respectively considered
and gran ted; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create a
special improvement district to be known and designated as Special Improvement District
No. 385 of the City of Bozeman for the purpose of constructing and installing a pavement
I a pavement project on South Black Avenue from Story Street to College Street said pave-
ment project to include the construction of a bituminous surface course on the existing
base, and other work incidental thereto.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 385 are described as follows:
Beginning at the Northeast corner of Block E of Hoffman's Addition
to the City of Bozeman, thence Westerly along the South line of East
Story Street a distance of 109 feet; thence Southerly 109 feet West
of and parallel to the West line of South Black Avenue to a point
on the South line of Lot Sixteen (16), of Block G, of the said Hoffman's
Addi tion; thence Easterly along the South line of said Lot Sixteen (16)
to the Southeast corner of said Lot Sixteen (16); thence Southerly
along the West line of South Black Avenue to the Southeast corner of
said Block G; thence Easterly along the South line of Block D, of said
Hoffman's Addition, and the prolongation of the South line of said Block
D, to a point 109 feet East of the East line of South Black Avenue;
thence Northerly 109 feet East of and parallel to the East line of South
Black Avenue to a point on the South line of East Story Street; thence
Westerly along the South line of East Story Street to the poin t of
beginning.
Section 3
Character of Improvemente
I Construction of a pavement project on South Black Avenue from Story Street to
College Street, said pavement pro.1ect to include the construction of a bituminous sur-
face course on the existing base, and other work incidental thereto.
Section 4
Es tima te of Cos t
The preli~inary estimate of cost of Six Thousand Five Hundred Eight and no/1OO
Dollars ($6,508.00) inc Iud ing all ma teria Is, installation costs, engineering and
incidentals.

Sectlon 5
Method of Assessment
The prelimlnary estimate of cost set forth above is to be assessed against the property
within said District on an area basis as follows:
Costs of the project will be assessed on an area basis, with the first twenty-five
feet of each lot next ad~acent to the improvement being recorded at double its actual I
area in computing the assessable area of each lot. On this basis the assessable area
of the district is 218,018 sauare feet and the cost per square foot is $0.02985075.
Section 6
Actual Area of District
The total actual area of all property within Special Improvement District No. 385,
exclusive of streets, avenues and alleys, is 177,343 square feet, which is the area on
which all protests will be received, considered and determined.
Section 7
Payments
That payments for said improvements shall be made in ten (10) annual installments
extending over a period of nine (9 ) years, but this shall not be construed to prevent
payment in full at any regular payment date by any property owner who desires to do so.
It is proposed to pay the entire cost and expense of the construction and installation
of said improvements with cash to be obtained from the sale of bonds of said Special
Improvement District No. 385, as authorized by law. Such bonds will be in denomina-
tions of $lUO.OO each and fractions or multiples of $lOO.UO where necessary, to be

issued and chargeable against a fund to be known and designated as Special Improvement
District No. 385 Fund of the City of Bozeman. The bonds will be redeemable at the
option of the City, singly or in multiples, and in the order of their registration,
whenever funds are available for that purpose in said Special Improvement District No.
385. Said bonds shall draw a simple interest from the date of their registration
until
called for payment, at a rate not exceeding six (6) per cent per annum, which interest
shall be chargeable as a part of the cost of the construction and installation of said
improvemen t . The bonds will be issued Rnd sold in accordance with the provisions of
Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all
other
applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to
special improvement districts in cities and towns, and any amendments thereof or there-
to.
Section 8
Prates ts and Notice
That the regular session of the City Commission of the City of Bozeman, to be held
at the Commission Chamber, City Hall Building, Bozeman, Montana,
on the 18th day of July, I
1956, at the hour of one o'clock P.M. of said day, are the time
and place, when and
where the City Commission will hear and pass upon all protests duly and regularly made
and filed against the creation of said proposed Special Improvement District No. 385,
the improvement proposed to be made pursuant thereto and the extent and character the r e -

Notice is hereby given that on the 27th day of June A.D. 1956, at a regular meeting
of the Commission of The City of Bozeman, Commission Resolution Number 811 entitled:

was passed and adopted.
That Wednesday, the 18th day of July, A.D. 1956, at one o'clock P..M. at the Commiss-
ion Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 811 as
the time and place for hearing objections to the action proposed to be taken by said
resolution, and when and where any and all persons whose property is within said propos-
ed Special Improvement District No. 385 on South Black Avenue from Story Street to Coll-
ege Street in said City may appear and show cause, if any they have, against said proposed
improvement. Objections must be made in writing and filed with the Clerk of the City
Commission not later than fifteen (15) days after date of the first publication of this
Notice.
An approximate preliminary estimate of the cost of doing such work and making such
improvement within said District, including all tTB teria Is, installation costs, engineer-
I ing and incidentals, which is to be specially assessed against the property within said
Dis trict, is $6,508..00. The total assessable area of all property within the said
District, exclusive of streets, avenues and alleys with the 25 feet adjacent to the
improvement taken at double its actual area, is 218,018 square feet. Property immediate-
ly adjacent to and within 25 feet of the proposed improvement is to be assessed at double
the assessment against the other property in the District.. Payment for the improvements
is to be made in ten (10) annual installments over a period of nine (9) years with

interest on the deferred payments not to exceed six (6) per cent per annum, pa

For a description of the boundaries of said Special Improvement District No. 385
reference is hereby made to Resolution No. 811 of the Commission of the Ci ty of
Bozeman declaring the inten tion to crea te said District, which is on file in the

office of the undersigned Clark of said Commission in the City Hall of said City of
Bozeman, State of Montana, and open for inspection to all interested parties and the
public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes
of Montana, 1947.
