HomeMy WebLinkAboutG3 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Anna Rosenberry, Finance Director Chris Kukulski, City Manager SUBJECT: Public Hearing & Adoption of Resolution No. 3920 Amending FY2006 Appropriation Resolution No. 3844 MEETING DATE: June 5, 2006 BACKGROUND: Budget Amendments are proposed for the following items that require public hearing: Library Purchase: During the May 8, 2006 Commission Workshop, and at both the May 15th and May 22nd public meetings, the Commission discussed and took public comment on the proposed financing of the purchase of the Library building at 220 E. Lamme Street. Staff was directed to prepare a budget amendment to transfer $1,000,000 from the General Fund (decreasing cash reserves) and $1,500,000 from the Solid Waste Fund (decreasing unrestricted net assets) to the Library Construction Fund for such purchase. Amending the General Fund appropriation amounts for FY2006 requires a public hearing, being held tonight. Montana Public Power, Inc.: At its November 28, 2005 meeting, the Commission approved Amendment No. 1 to the Montana Municipal Power Agreement. This amendment provided for “additional assessments of up to $100,000 from Bozeman and each of the other four MPPA members, for due diligence and the regulatory approval process”. Due diligence was performed and we expect to receive invoices for those costs in the near future. Amending the General Fund appropriation amounts for FY2006 requires a public hearing, being held tonight. RECOMMENDATION: Hold a public hearing on these budget amendments and adopt Resolution No. 3920, Amending the FY2006 Appropriation Resolution. FISCAL EFFECTS: General Fund: The fiscal effect of both items will be to decrease the Unreserved General Fund Balance from an estimated $3.1 Million to an estimated $2.0 Million at June 30, 2006. Solid Waste Fund: The fiscal effect of the Library transfer will be to decrease unrestricted net assets in the Solid Waste Fund from an estimated $4.5 Million to an estimated $3.0 Million at June 30, 2006. Library Construction Fund: $2.5 Million will be deposited into the Library Construction Fund, increasing cash available for construction expenses. ALTERNATIVES: As suggested by the City Commission. Kukulski, City Manager Report compiled on May 30, 2006 Attachments: Resolution No. 3920 - 1 - COMMISSION RESOLUTION NO. 3920 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING FISCAL YEAR ENDING JUNE 30, 2006 APPROPRIATION RESOLUTION NO 3844. WHEREAS, the City Commission did, on the 20th day of June 2005, receive the City Manager’s Budget Recommendations for Fiscal Year 2005-2006; and WHEREAS, the City Commission did, on the 22nd day of August 2005, after due and proper legal notice, conduct a public hearing on the proposed municipal budget. WHEREAS, the City Commission did, on the 6th day of September 2005, adopt Resolution No. 3844, to appropriated funds for various budget units for the fiscal year ending June 30, 2006, including the General Fund. WHEREAS, a public hearing is required for an increase in appropriation authority for the General Fund, beyond that which was previously approved, pursuant to 7-6-4031 (3) M.C.A. WHEREAS, the City Commission did, on the 5th day of June 2006, after due and proper legal notice, conduct a public hearing on the proposed increases in appropriation authority. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, to wit: Section 1 The City Commission of the City of Bozeman, Montana, does hereby authorize and appropriate expenditures in addition to those approved in Commission Resolution No. 3844 in the following fund for the following reasons. General Fund: additional $1,000,000 for transfer to the Library Construction Fund for purchase of the Library property at 220 East Lamme Street. General Fund: additional $100,000 for expenditures relating to Montana Public Power Inc. (MPPI). These appropriations shall have the effect of decreasing the estimated unreserved fund balance of the General Fund. Section 2 In Commission Resolution No 3844, and pursuant to Sections 7-6-4006 and 7-6-4012, M.C.A., the City - 2 - Commission has delegated appropriation and budget amendment authority to the City Manager for the expenditures from fee-based budgets. The City Manager is directed to exercise this authority to authorize expenditures in addition to those approved in Commission Resolution No. 3844 in the following fund for the following reasons. Solid Waste Fund: $1,500,000 for transfer to the Library Construction Fund for purchase of the Library property at 220 East Lamme Street. This appropriation shall have the effect of decreasing the estimated unrestricted net asset balance of the Solid Waste Fund. This appropriation will not affect amounts reserved for closure and post-closure monitoring of the Landfill site. Section 3 Pursuant to Section 7-6-4031, M.C.A., this resolution, upon its passage, shall be in full force and effect on June 5, 2006. Section 4 That upon this resolution becoming effective, as provided in Section 5 above, all resolutions and parts thereof in conflict herewith are hereby repealed. Section 5 That should it be found by any court of competent jurisdiction that any section, clause, portion, sentence, word, or phrase of this resolution is deemed to be contrary to any existing law or regulations, that in this instance, it is the intent of the City Commission of the City of Bozeman, Montana, that all other portions, sections, words, clauses, phrases, or paragraphs of this document shall remain in full force and effect.
