C01VTIVrISSION RESOLUTION NO. 2307 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLAR- ING IT TO BE THE INTENTION OF SAID COMMISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMrROVE~mNT DISTRICT NO. 17 AND TO ABANDON THE MAINTENANCE OF STREET PARKING THEREUNDER, AND DIRECTING TIm CLERK OF THE CITY COMMISSION TO GIllE NOTICE OF SUCH RESOI~TION, ALL PFRSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED. WHF. REA S , a Petition was filed with the City of Bozeman on April 13th, 1956, I by owners of property in Special Improvement District No. 17 of the City of Bozeman, praying for the abandonment of said District, and WHEREAS, it appears for the best interests of the City of Bozeman and the proper- ty owners within said Special Improvement District No. 17 that said District be aban- doned. NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: SECTION 1. DECLARATION OF INTENTION. It is hereby declared to be the intention of the City Commission of the City of Bozeman, Mon tana, to abandon Special Improve- ment District No. 17 of said City and to abandon the maintenance of any street parking improvements therein. SECTION 2. BOlmDARIES OF DISTRICT. The boundaries of said Special Improvement District No. 17 are as follows: Beginning at a point in the center line of West Babcock Street where the same is intersected by the extension of the center line of the Alley in Block "B" of Alderson's Addition to the City of Bozeman; Thence South along the center line of said Alley and the extension of the same to the center line of West College Street; Thence West along the center line of said West College Street to the extension of the Alley in Block "c" of Alderson's Amend- ment to Fairview Addition to the City of Bozeman; Thence North along the center I line of said Alley and the extension of the same to the center line of said West Babcock Street; Thence East along the center line of said West Babcock Street to the place of beginning. SECTION 3. BENEFITS DECLARED. It is hereby declared by the Commission of the City of Bozeman that all of the land within the boundaries of said Special Improve- ment District No. 17 will be specially benefited by such abandonment and that it is to the best interests of the City of Bozeman and the owners of property within the said District that the District be abandoned. SECTION 4. EFFECTS OF ABANDONMENT. Should said Special Improvement District No. 17 be abandoned in conformance to this Resolution and the Notice to be published pursuant thereto, it shall be the duty of the owners of the property abutting on the property involved to maintain the same after such abandonment, and such abandonment shall not relieve said property owners from the assessment and payment of a sufficient amount to liquidate all charges existing against said District prior to the date of a bandonmen t. SECTION 5. TIME FOR PROTESTS. That the regular session of the City Commission of the City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesda y, the 2nd day of May, A.D. 1956, at the hour of 1:00 I o'clock P.M. of said day, are the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the abandonment of said proposed Special Improvement District No. 17. SECTION 6. CLERK TO GIVE NOTICE. That the Clerk of the City Commission be, and he is hereby directed to give notice in the manner and for the time as by law Resolution No. 807 - ,..-.,.. :{9 required, of the adoption of this Resolution of Intention. Notice is hereby given that on the 18th day of April, A.D. 1956, at a regular meeting of the Commission of the City of Bozeman, Commission Resolution ~)mber 807 en ti t1ed : A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA" DECLARI~G IT TO BE THE INTENTION OF' SAID COMMISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 17 AND TO ABANDON THE MAINTENANCE OF STREET PARKINGS THEREUNDER, AND DIRECTING THE CLERK OF THE CITY COMMISSION TO GIVE NOTICE OF Sl~H RESOLUTION, ALL PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED, I was passed and adopted. That the boundar1es of said Special Improvement District No. 17 are as follows: Beginning at a point in the canter line of West Babcock Street where the same is intersected by the extension of the center line of the Alley in Block "B" of Alderson's Addition to the City of Bozeman; Thence South along the center line of said Alley and the extension of the same to the center line of West College Street; Thence West along the center line of said West College Street to the extension of the Alley in Block "C" of Alderson's Amendment to Fairview Addition to the City of Bozeman; Thence North along the center line of said Alley and the extension of the same to the cen ter line of said West Babcock Street; Thence East along the center line of said West Babcock Street to the place of beginning. That Wednesday, the 2nd day of May, A.D. 1956, at one o'clock P.M. at the Commis- sion Room of the City Hall, Bozeman, Montana, is th e d ate, time and place set for the hearing of protest against the abandonment of said Special Improvement District No. 17 and for the passage of the Resolution of abandonment. That unless forty (40) percent of the property owners of said Special Improvement District No. 17 file written protest with the Clerk of the City Commission before the above specified date and time, a Resolution of abandonment of said Special Improvement Dlstrict No. 17 will be, by the City Commission, passed. That should said Special Improvement District No. 17 be abandoned in conformance I to this Resolntlon and the Notice to be published pursuant thereto, it shall be the duty of the owners of the property abutting on the property involved to maintain the same after such abandonment, and snch abandonment shall not relieve said property owners from the asseSSment and payment of a sufficient amount to liquidate all charges existing against said District prior to the date of abandonment.
