HomeMy WebLinkAboutE9City of Bozeman City Clerk PO Box 1230 Bozeman, MT 59771 ORDINANCE NO. 1662 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE BOZEMAN’S OFFICIAL CITY ZONING MAP’S ZONING DISTRICT DESIGNATIONS BY ESTABLISHING A NEW ZONING DESIGNATION OF "R-3" (RESIDENTIAL MEDIUM DENSITY DISTRICT), “R-4” (RESIDENTIAL HIGH DENSITY DISTRICT) AND “PLI” (PUBLIC LANDS AND INSTITUTIONS) ON ~ 226 ACRES SITUATED IN A PORTION OF SECTION 23, T2S, R5E, PMM, CITY OF BOZEMAN, GALLATIN COUNTY, MONTANA, AND LOCATED WEST OF SOUTH 19TH AVENUE BETWEEN STUCKY ROAD AND BLACKWOOD ROAD WHEREAS, the proposed zone map amendment to establish a new zoning designation of R-3" (Residential Medium Density District), “R-4” (Residential High Density District) and “PLI” (Public Lands and Institutions) on ~ 226 acres has been properly submitted, reviewed and advertised; and WHEREAS, the City of Bozeman Zoning Commission held a public hearing on May 17, 2005, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved; and WHEREAS, after proper notice, the City Commission held its public hearing on June 20, 2005, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, as recommended by the Zoning Commission, to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on June 20, 2005, the City Commission found that the proposed zone map amendment would be in compliance with the Bozeman 2020 Community Plan and would be in the public interest. WHEREAS, the City Commission has reviewed and considered the proposed zone map amendment forwarded by the Zoning Commission NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby established as "R-3" (Residential Medium Density District): Beginning at the South One-Quarter Corner of Section 23 thence North 88°49'22" West, along the south line of said Section 23 a distance of 1328.27 feet; thence North 01°19'12" East, a distance of 1331.29 feet; thence South 88°50'58" East, a distance of 1331.58 feet to a point on the north south mid- section line of said Section 23; thence North 01°27'44" East, along said north south mid-section line a distance of 1333.08 feet to the Center One-Quarter Corner of said Section 23; thence South 88°53'38" East, a distance of 914.45 feet; thence North 80°06'37" East, a distance of 174.39 feet; thence along a 300.00 foot radius curve to the right through a central angle of 11°00'03" for an arc length of 57.60 feet; thence South 88°53'20" East, a distance of 160.19 feet; thence North 00°45'24" East, a distance of 35.87 feet; thence South 88°54'36" East, a distance of 1302.97 feet to a point on the east line of said Section 23; thence South 00°34'15" West, along said east line a distance of 2736.62 feet to the Southeast Corner of said Section 23; thence North 88°58'06" West, along the south line of said Section 23 a distance of 2647.94 feet to the Point of Beginning. Said tract of land being 203.78 acres, along with and subject to any existing easements. That the zoning district designation of the following-described property is hereby established as "R-4" (Residential High Density District): Beginning at the Center One-Quarter Corner of Section 23 thence North 01°27'44" East, along the north south mid-section line of said Section 23 a distance of 45.00 feet; thence South 88°53'38" East, a distance of 562.85 feet; thence North 04°25'12" East, a distance of 23.20 feet; thence North 26°11'10" East, a distance of 78.28 feet; thence North 00°33'44" West, a distance of 1203.91 feet; thence South 88°34'05" East, a distance of 738.75 feet; thence South 01°02'41" West, a distance of 337.74 feet; thence South 01°02'09" West, a distance of 925.89 feet; thence South 00°45'24" West, a distance of 35.87 feet; thence North 88°53'20" West, a distance of 160.19 feet; thence along a 300.00 foot radius curve to the left through a central angle of 11°00'03" for an arc length of 57.60 feet; thence South 80°06'37" West, a distance of 174.39 feet; thence North 88°53'38" West, a distance of 914.45 feet to the Point of Beginning. Said tract of land being 22.56 acres, along with and subject to any existing easements. That the “PLI” (Public Lands and Institutions) zoning district designation is to be established subsequent to the subdivision of the lot and acceptance of the deed by the City of Bozeman. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading. PROVISIONALLY PASSED by the City Commission of the City of Bozeman, Montana, on the first reading at a regular session thereof held on the 17th day of April, 2006. PASSED, ADOPTED AND FINALLY APPROVED by the City Commission of the City of Bozeman, Montana, on second reading, at a regular session thereof held on the 15TH day of May, 2006. ___________________________________________ Jeffrey K.
