HomeMy WebLinkAboutE1 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Dustin Johnson, Project Engineer Chris Kukulski, City Manager SUBJECT: Mandeville Master Plan, Professional Services Agreement MEETING DATE: May 15, 2006, Consent Agenda BACKGROUND: Attached are three (3) original signature copies (Devin Harbour cc only) of the partially executed Professional Services Agreement for the above referenced project. The agreement is for Allied Engineering Services Inc. to oversee the design, bidding, construction, and inspection of the Wheat Drive Extension. This section of road will extend north from the Mandeville Lane to approximately the current location of the cell tower located on the city owned Mandeville Farm. The majority of the design for the stretch of road was designed during the design process for the transfer station. The contract extension is based off time and materials and not to exceed the amount of $33,568.00. RECOMMENDATION: Authorize the City Manager to sign the Professional Services Agreement for the master planning Mandeville Farm property. FISCAL EFFECTS: The project will be funded through the solid waste disposal fund. ALTERNATIVES: As may be suggested by the City Commission. Kukulski, City Manager Attachments: Professional Service Agreements (3 copies) Report compiled on 5/3/06 cc: Devin Harbour w/orig. enclosures Project File / Dustin Johnson −1− Amendment No. 4 to Professional Services Agreement For City of Bozeman Solid Waste Transfer Station THIS AGREEMENT is made as of this ________ day of _______________________, 2006, between THE CITY OF BOZEMAN, a Municipal Corporation, Bozeman, Montana, herein referred to as OWNER and ALLIED ENGINEERING SERVICES INC., an Engineering Consulting Firm of Bozeman, Montana, herein referred to as ENGINEER. WHEREAS, the parties have entered into a Professional Services Agreement dated November 13, 2001, herein referred to as Original Agreement for professional engineering services; and WHEREAS, the parties desire to further amend the provisions of this Agreement. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: ARTICLE 1 – ENGINEERING SERVICES Added to Section 1.1 of the Original Agreement is the following: 1.1.1 With the completion of engineering services for the transfer station, ENGINEER shall provide engineering services for the construction of the Wheat Drive extension. Services shall include any necessary redesigns of previously proposed infrastructure included in the design, permitting, surveying, construction drawings and specifications, cost estimates, bidding documents, and construction inspection. ENGINEER and OWNER shall attend any pre-bid conferences, bid openings, pre-construction conferences, construction progress and other job related meetings, substantial completion inspections and final payment inspections. ARTICLE 6 – COMPENSATION FOR ENGINEERING SERVICES Section 6.1.1, 6.1.2, 6.1.3, and 6.2.4 of the original agreement is replaced with the following: 6.1.1 Payment. The OWNER shall for design phase services performed as Basic Engineering Services under sections 1.1.1 through 4.5 of this agreement pay for time and materials of the ENGINEER not to exceed the amount of $33,568.00 for such services without the approval of the OWNER. 6.1.2 Payment Schedule. This section will be removed. 6.1.3 General. ENGINEER may submit monthly statements for services rendered. The statements shall be based upon hourly rates as specified in section 7.3 and the cost of any materials. 6.2.4 The OWNER shall pay an amount for Additional Services rendered by the ENGINEER and approved in writing by the OWNER on the basis of ENGINEER’S Direct Labor Costs times a factor of 3.10, or an amount otherwise negotiated at the time such services are requested and approved by the OWNER. −2− Section 7.3 DIRECT LABOR COSTS are updated as follows: Principals $50/hour Project Managers $40/hour Senior Engineers $35/hour Staff Engineers $27/hour Senior Technicians $23/hour CADD Drafter $23/hour Technicians $20/hour Construction Inspector $22/hour Two Person Survey Crew $58/hour Clerical $19/hour Except as specifically amended herein, the original agreement shall remain in full force and effect and the Parties shall be bound by all terms and conditions therein.
