HomeMy WebLinkAboutD6 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Chris Kukulski, City Manager SUBJECT: Homesite Zone Map Amendment MEETING DATE: April 24, 2006 BACKGROUND: On August 1, 2005, the City Commission held a public hearing on a request for an initial zoning designation of a 3 acre parcel located east of North 19th Avenue, west of North 17th Avenue, and south of Stevens Street. The Commission preliminarily approved the proposed zoning designations of “R-O” (Residential Office District), directing staff to bring back an Ordinance establishing the initial zoning designations upon annexation of the property. RECOMMENDATION: Adopt Ordinance No 1664. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property. ORDINANCE NO. 1664 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY ESTABLISHING AN INITIAL MUNICIPAL ZONING DESIGNATION OF R-O (RESIDENTIAL OFFICE DISTRICT) ON 3.1 ACRES DESCRIBED AS TRACTS 17 AND 19 OF THE HOMESITE SUBDIVISION, LOCATED IN THE SOUTHWEST QUARTER OF SECTION 1, TOWNSHIP 2 SOUTH, RANGE 5 EAST, GALLATIN COUNTY, MONTANA. WHEREAS, the proposed zone map amendment to establish an initial zoning designation of R-O (Residential Office District) has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on July 19, 2005 to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the Bozeman Zoning Commission voted 4 to 0 in favor of the proposed zoning designation, and therefore forwarded a recommendation of approval to the Bozeman City Commission; and WHEREAS, after proper notice, the City Commission held its public hearing on August 1, 2005, and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment to establish an initial municipal zoning designation of R-O (Residential Office District), with contingencies, to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on August 1, 2005, the City Commission found that the proposed zone map amendment would be in compliance with the Growth Policy and would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby designated as R-O (Residential Office District): That Part of the Southwest Quarter of Section 1, Township 2 South, Range 5 East, PMM, Gallatin County, Montana, described as follows: Tracts 17 and 19 of the Homesite Subdivision; and further described as, Commencing at the Northwest Corner of said Tract 19, said point being on the east right-of-way of North 19th Avenue; Thence North 89/10’52” East, Azimuth 570.68 Feet; Thence South 00/39’23” East, Azimuth 240.00 Feet; Thence South 89/10’52” West, Azimuth 570.83 Feet; Thence North 00/37’21” West, Azimuth 240.00 Feet to the True Point of Beginning - 2 - Said tract of land being 3.1 acres along with and subject to any existing easements. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading.
