Home My WebLink AboutBozeman Deaconess Health Services Annexation Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Chris Kukulski, City Manager SUBJECT: Bozeman Deaconess Health Services Annexation MEETING DATE: April 24, 2006 BACKGROUND: On June 15, 1998, the City Commission held a public hearing on a request for annexation of a 38 acre parcel owned by Bozeman Deaconess Health Services, located west of Highland Boulevard and south of Hillcrest Retirement Center. The Commission preliminarily approved the proposed annexation, directing staff to bring back an Annexation Agreement and Resolution of Annexation for Commission consideration. The proposed annexation was subject to standard terms, including completion of the annexation within one year. An initial agreement was negotiated but not finally executed by the parties. The attached annexation agreement was executed by Bozeman Deaconess Health Services on February 9, 2000, but certain factors delayed completion of the process. Bozeman Deaconess Health Services remains willing and committed to the remaining terms of the annexation, as evidenced by the attached Affirmation signed by John Nordwick, President of Bozeman Deaconess Health Services. By affirming the agreement, Bozeman Deaconess Health Services also affirms that it deems this annexation to be in its best interest. The City Commission can also affirm that it is in the best interest of the City of Bozeman to complete this annexation, notwithstanding the original requirement that it be completed within one year, by authorizing the City Manager to sign the Agreement. RECOMMENDATION: Authorize the City Manager to sign the Annexation Agreement. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property.
