Home My WebLink AboutResolution 800 Taxes for Sidewalks and Curbs, 1955 211 COMMISSION RESOLUTION NO. 800 , , A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND A~3SESSING A SPECIAL ASSESSM::<:NT OF 'rAXES UPON CERTAIN PROPERTIES IN 'rHE CITY OF' BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUC'ING AND AND INSTALLING AND/OR REPAIRING JVIISCELLSNE,)US SIDEWALKS AND CURBS DURING THE YEAR 1955 V'JHSREAS, the Commission of the City of Bozeman, pursuant to the provisions of Ordinance No. 561, entitled: I "AN ORDINANCE COVERING 'rHE CONSTRUCTION AND INSTALLA'rrON OF CONCRETE CURBS AND SIDEWALKS IN 'T'HE CITY OF BOZEMAN, PROVIDING PENALTIES FOR THE VIOLATIONJF T'9"IS ORDINANCE AND REPEALING ORDINANCES NOS. 36.5 , 37L!, Lj25, [iLL7, L~1J9, AND L151, ANd ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF THE CITY OF BOZEMAN IN CONFLICT HEREWITH", and the provisions of Section 11-2226, Political Code, R.C.M., 19L\7, provided for the con- struction of sidewalks and curbs in the City of Bozeman during the year 19.5;;, without the formation of a Special I~provement District; WHgREAS, proceedings were had for the construction and installation and/or repair of Miscellaneous Sidewalks and Curbs in the City of Bozeman for the year 195" and WHEREAS, Miscellaneous Sidewalks and Curbs were constructed and installed and/or re- paired bordering on varbus properties in the City of Bozeman, pursua.nt to Ordinance No. 561, Section 11-2226, Political Code, R. C. M.f 1947, which are hereby referred to and made a part of this Resolution, and WHEREA S , the said Miscellaneous Sidewalks and curbs have been constructed and completed and ~r repaired in accordance with the terms and conditions of said proceedings, and the City Enrdneer has duly certified to the Commission a Schedule showing the Sidewalsk and Curbs which mve been constructed and installed and/or repaired, and the properties which are aub- I ject to assessment thereunder and the total cost of said construetion and installation and/or repairing is the sum of Five Hundred Thhty-seven and 86/100 Dollal'S ( $; 5 3 7 . 86 ) which Schedule, marked Schedule "A", is hereto attached and made a part hereof. NOW, TT-fI~REFORE, pursuant to the provisions of Ordinance No. 561 as aforesaid, and Sect~on 11-2226f Political Code, R.C.M. 19L17, as aforesald, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CrfY Of' BOZEMAN,MONTANA: Section 1. That to defray the cost of constructing and installing ana/or repairing Miscellaneous Sidewalks and Curbs as set forth in Schrluly "A", hereto attached and made a part hereof, there is hereby levied and assessed a tax amounting to the sum. of Five Hundred Thirty-seven and 86/100 Dollars ($537.06). Section 2. 'I'hat a pertuculFjr description of eac;} lot and parcel of land wi th the name of the owner and the sum assessed against him or it for such construction and installation and/or repair and the amount of each payment to be made and the day when the same shall be- come delinquent is set forth in the assessment list hereto attached marked Schedule "A" and made a part hereof; that the several sums set opposite the name of the owner and the descrip- tion of the lots and parcels of land be, and the same are hereby respectively levied and I assessed upon said lots and parcels of land to defray the cost andexpense of constructing and installing and/or repairing s4d Sidewalks and Curbs; that the several S1L~SSO assessed be callected from the respective owners of said lots and parcels of land described in said assessment list as required by law; that the payment of said sums shall be made in six installments; that the payment of said installments shall be made on or before the 30th day of November of each year until payment of all installmentstogether with the interest thereon, shall be mElde; that said sums shall be paid and the collection thereof shall be ')hJ' f...... made in the manner andin accordance with the law governing the collection of Special Im- provement taxes; that failure to pay such assessments when the same shall become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes; Section 3. That the regular session of the Commi~sion of the City of Bozeman to be I held in the Commission Chamber in the City Hall of said City on the 19th day of October, 1955, at 1:00 o'clock P.M. be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Commission. Section 4. That the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and installing and/or repairing Side- walks and Curbs in the City of Bozeman for the year 1955 is on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will 'be heard by the Commission to the final adoption of this Resolution; that it shall be pUblished at least five (,) days before the date set by the Commission for the hearing of objections and the final adoption of this Resolution. NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of the City of Bozeman held on Thursday the 13th day of October, 19,5, Commission R solution No. 000 was '" provisiona1y passed and adopted; that said Commission Resolution :B vies and assesses a special assessment of taxes upon certain lots and parcels of land in front, or on the side of which, sidewalks and curbs have been c0nstructed and/or repaired pursuant to the~ovi- I sions of Ordinance No. 561 and Section 11-2226, Political Code,' R.C.M., 19L!7, to defray the cost and expense of constructing and installing and/or repairing said Sidewalks and Curbs. That said Commission R~solution is now on file in the o~fice of the Clerk of the Com- mission, subject to inspection for a period of five (5) days by any persons interested; that Wednesday, the 19th day of October , 1955, at 1:00 o'clock P.M. of said day, at the regu1arsesslon of the said Commission of the City of Bozeman at the Commission Chamber, City Hall Building of said City, has been designated as the time and place when and where Resolution No. 800 ___.._____________ ____ __ _ ________ n . _ ..__..______._ --.------. 26 the said Commission will hear and pass upon any and all objections that may bemade to the final passage and adoption of. said Resolution No. JOO and the levying of sald assessment, and that said Resolution will be finally passed and adopted at said regulHr session.
