A RESOLUTION OF THE COMMISSI:JN OF THE CITY OF BOZEMAN, MONTJlNA, LEVYING ftND
ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROP8PTY IN SPECIAL IM-

I 195L , duly and regularly pass Commission Rpsolution No. 767, entitled:

INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 380 OF THE CITY OF BOZEMANFOR 'rHE PUR-
POSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON NORTH TRACY AVENUE FROM
SHORT S'rFEET TO PEACH STREET, SAID PAVEMENT PRO.TECT TO INCI. UDE THE INSTALLATION
OF CRUSHED GRAVEL BASE COURSE, CRUSHED GRAVEL CUSION COURSE AND BITUMINOUS
SURFACE COURSE:
and thereafter, after due and legal proceedings had, the Commission ,)f The City of Bozeman
did on the 1st day of September, 1954 duly pass Commission Resolution No. 767 A , entitled:

IMPROVEMENT DISTRICT NUMBER 380 OF TIm CITY OF BOZEMAN FOR THE PURPOSE OF CON-
S'rRTJCTING AND INSTALLING A PAVEMENT PROJECT ON NORTH TRACY AVENUE FROM SHORT STREE'r
TO PEACH STREE'r, SAID PAVEMENT PRO,JECT TO INCLUDE THE INSTALLA'rION OF CRUSHED
GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE AND BITmUNOUS SURP'ACE COURSE,
IN SAID CITY,
which Commission Resolutions Nos. 767 and 767A, passed as aforesaid, are hereby referred
to and made a part of this resoluticm for further particulars ln respect to the boundaries
of said district, the character of the improvements to be constructed therein, the esti-
mated cost of said improvements and the method of assessing the cost against the property
within said district; and
WHEREAS, said inprovements as contemplated in said Commission Resolutions No~. 767 and
I 767A have been constructed and completed in accordance with the terms and conditions of
Commission Resolutions Nos. 707 and 767A, and the total cost of said improvements so
constructed is the sum of Three Thousand Two Hundred Fifty-eight and 98/100 Dollars
(st'3, 258.98) .
NOW THEREFORE, pursuant to the provisions of Sections 52?5 to 5277.5 and 54.85, R.C.M.,
1935 and amendements thereto,
BE IT RESOLVED AND IT IS HEREBY OPDlI;RED BY 'rHE COMMISSION OF frEE CI'rY OF' BOZEMAN,
STATE OF MONTANA:
Section 1. 'rhat to defray the cost and expense of constructing and making the im-
provements in said Special Improvement District No. 3eO, there be, and there is hereby
levied and assessed a tax amounting to the sum of Three Thousand Two Hundred Fifty-eight
Dollars and Ninety-eight Cents, ($3,258.98) upon all the property in said Special Improve-
ment District No. 380, that a particular description of each lot and parcel of land with
the name of the owner and the swn assessed against hin or it for such improvements and
the amount of eaC~l partial payment to be made and the day when the same shall be delin-
quent is set forth in detail in the assessment list hereto attached, marked Schedule "A"
I and made a part hereof; that the several StUS set opposite the names of the owners and
the described lots and parcels of land be, and the same are hereby respectively levied
and assessed upon and against said described lots and parcels of land to defray the cost
and expense of constructing and making the improvements within said District; that the
sl,;:veral sums so assessed be collected from the respective owners of sald lots and parcels
of land described in said assessment list, Schedule "Att, as required by law; that the
payment of said sums shall be made in twenty installments and the payment of said install-

ments shall extend over a period of nineteen years; that the payment of the respective
annual installments shall be made on or before the 30th day of November of each year until
payment of all installments together with the interest thereon, shall be made; that saId
sums shall be paid and the collection thereof shall be made in the manner and in accordance
with the law governing the collection of special improvement taxes; that failure to pay
such assessments when the same become due and payable shall make such persons and said I
lots and parcels of land liable to the penalties provided by law relative to delinquent
taxes.
Section 2. 'fhat the regular session of the Commission of 'fhe City of Bozeman to be
held in the Commission Chamber in the City Hall of said City on the 13th day of October,
1955, at 1: o'clock P.M., be and the same is hereby designated as the time and place at
which objections to the final adoption of this Resolution will be heard by said Commission.
Section 3. That the Clerk of the Commission of The City of Boze~an be, and he is
hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper
printed and published in the said City of Bozeman, a notice signed by theClerk of the
Commission and stating that a ResolutL)n levying and assessing a special assessment of
taxes to defray the cost and expense of constructing and making the improvements in the
said Special Improvement District No. 380 is on file in the office of the Clerk of the
Commissi}n subject to inspection for a period of five (5) days; that said notice shall
state the time and place at which objections will be heard by the Commission to the final
adoption of this Resolution; thr:t it shall be published at least five (5) days befor~ the
day set by the Commission for the hearing of objections and the final adoption of this I
Resol ution. .

HEARING, FINAL ADOPTION OF COMMISSION RESOLurLm 799, LEVYING ASSESSMENT SPECIAL
IMPROVEM1~T DISTRICT NO. 380, CITY OF BOZEMAN, PAVING ON NORTH TRACY AVENUE FROM
SHORT STREET T J PEACH STREET.
NOTICE IS HEREBY GIVEN, That at a regular session or the C )rmnlsslon or The City or I
Bozeman held on the 5th day of October, 1955, Commission Resolution N). 799 was provision-
ally passed and adopted; that said Commission Hesolution levies and assesses a special assess-
ment of taxes upon all the property in Special Improvement District No. 380 in said City,
to defray the cost and expense of cmstructing and making the improvements within said
District, to-wit:
BEGINNING at the Southwest Corner of Block F of Beall's Second Addition to
The City of Bozeman, thence Easterly along the North Line of Short Street
to a point on the West Line of the North and South alley in said Block F;

thence Northerly along the West Line of said alley to a point on the South J".t
Line of Peach Street; thence Westerly along the South Line of Peach street
to a point on the East Line of the North and South alley in Block One (1), of
Beall's Third Addition to the City of Bozeman; thence Southerly along the
East Line of the alley in said Block One(l) to a point on the North Line
of Short Street; thence Easterly along the North Line of Short Street to the
point of beginning.
Tha t , said Commission Resolution No. 799 is now on file in the office Jf the Clerk of
the Commission, subject t,) the inspection for a peri)d of five (5) days by
