WHEREAS, the City Council and the Commission of the City of Bozeman have heretofore duly and regularly passed Council and Co~~ission Resolutions creating special improvement districts within the City of Bozeman, defining the coundaries thereof and providing; for the maintenance of parkings therein, and for the assessment I of the cost of maintaining the parkings as set forth in Resolutions hereinafter referred to;; and WBEHBAS, the parkings wi thin the boundaries of said Special Improvement Districts have been cared for and maintained during the year 1955, as contemplated in said Resolutions, in accordance with terms and con- ditions thereof; and '!'iHEREAS. said Special Improvement Districts for the maintenance of parkings and the Resolutions creating the same, the total frontage or the area, of the property within said districts to be assessed. the total cost of said maintenance wi thin said districts and the amount chargeable to the :f ro!-,erty therein. is here- inafter set forth, NOW, THEREFORE, rursuant to the provisions of Section 11-2224. Political Code, HC'II!, 1947. and said Council and Commission R~solutions creating said Special Improvement Districts. and providing for the main- tenance thereof; Bg IT RESOLVED AND IT IS HEREBY ORDERED BY TEg COMlvHSSIor OF THE CITY OF BOZEIVIM, S'l'ATE OF' MONTANA; for Section 1. That/the year 1955, The City of Bozeman has defrayed the cost (;5,710.33) of maintenance of parkings in the severel Special Improvement Districts, pursuant to Resolutions creating the same, and that the entire cost thereof, the total number of lineal feet, or area. of the property to be assessed. and the rate per linear foot or square foot, is as follows, to-wit; I Dist. 'l'hat to defray the cost of maintenance of parkings within said Special Improvement Districts for the year 1955, there be and there is hereby levied and assessed a tax upon all the property in front of and bordering on said Special Improvement Districts as set forth in Schedules One to Nineteen inclusive. hereto ettached and made a rart hereof; that a particular description of each lot and parcel of land with I the name of the owner and the sum assessed against him or it, is set forth in the essessment lists hereto attached. marked "S~hedUles One (1) to Nineteen (19)" and made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby levied and assessed upon and against the said lots and pa reel s of land; that the several sums be collected from the respective owners of said lots and parcels of land described in the said assessment lits. Schedules One to Nineteen inclusive, as required by law; that said sums abdl be paid and the collection thereof shall be made in the manner and in accordance with the law governing. the collection of Special Improvement taxes; -----.-.- 9 that failure to pay such assessments when same shall become due and payable shall make such person and such lots and parcels of la nd liable to the penal ties provided by law relative to delinquent taxes. Section 3. That the regular session of the Commission of the City of Bozeman to be held on the 14th day of September, 1955 at the Commission Chamber, City Hall Building, be, and the same is hereby designated as the time and pIa ce at which objections to the fine 1 adoption of' this Resolution will be heard by the Cornrnissi on. I Section 4. That the Clerk of the Commission be, and he is hereby ordered and directed iD publish in the Bozeman Daily Chroncile, a daily newspaper, Frinted and published in the City of Bozeman, a notice signed by the Clerk of the Commission, and stating that a resolution levying a special assessment of' taxes to defray the cost or maintenance of parkings in the said Special Improvement Districts for the year 1955, is on file in the office of the Clerk of the Commission, subject to inspection for a period of' five days; that said notice shall state the time and pL ce at which objections will be heard by the Commission to the final adop- tion of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing objections, and the final adoption of this R~solution. Provisionally passed and adopted by the Commission of the City of Bozeman at a regular m:'eting of said Commission, on the 7th day of September, 1955. NorrCE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 7th day of September, 1955, Commission Resolution No. 793 wes duly passed and adopted; that said Commission Resolution No. 793 levies and assesses a special assessment of taxes uFon all the property in Sepcial ImFrove- ment Districts of said City to defray the cost of maintenance of perkinEs within said Sp"cail Improvement Districts for the year 1955. All persons interested are referred to the several Council and Conunission Rr.-solutions creating the afore- said Special Improvement Districts, defining the boundaries thereof, And providing for the assessment of the cost of said maintenance of pa rkings. ror further particulars, all of the said Resolutions being on file in I the office of the Clerk of the Conunission of the City of Bozeman, at the City Hall of said City, and sub- ject to inspection of all interested parties.
