HomeMy WebLinkAboutResolution 2086 Exceed Current Mill Levy -- ,. ...- .... ~_. roo _ _ _...,.....--.,-,. ___. ~~_~.________........_______~--.-.--_ ________'-_ _~,.......-. ___~~ ~ ___~_ ...............r..---.-------~' _~___ ~ _ _.....--..--.................---..........-~- 24'5 COMMISSION RESOLUTION NO. 2086 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, INDICATING THE CITY'S INTENT TO EXCEED THE CURRENT MILL LEVY FOR GENERAL FUND PURPOSES ON THE APPROVAL OF THE ELECTORATE: ESTABLISH- ING A CERTAIN LEVIED DOLLAR AMOUNT, SAID ADDITIONAL DOLLAR AMOUNT I OF MONIES RAISED TO BE USED BY THE CITY OF BOZEMAN FOR OPERATING THE CITY'S ALL-PURPOSE GENERAL FUND: INDICATING THE APPORXIMATE NUMBER OF MILLS NECESSARY TO OPERATE THE CITY'S ALL-PURPOSE GENERAL FUND: SETTING THE DATE AT WHICH THE QUESTION OF THE ADDITIONAL MILL LEVY WILL BE SUBMITTED TO THE QUALIFIED ELECTORS OF THE MUNICIPALITY; AND SETTING FORTH PROCEDURES FOR CONDUCT OF THE ELECTION. WHEREAS, the City of Bozeman, Montana, has thoroughly reveiwed the capital, salary and operations expenditures for the City's All-Purpose General Fund in preparation of an operating budget for Fiscal Year 1979-1980; and, WHEREAS, expenditure monitoring and expenditure reductions over the past fiscal year have reduced City operating costs to minimum levels; ald, WHEREAS, the City has conducted a complete analysis of revenue over the past two fiscal and, .. years; WHEREAS, the City staff has projected the total possible collectible revenue for Fiscal Year 1979-1980; and, WHEREAS, it appears that expenditure levels necessary to provide services to the citizens of the City of Bozeman at existing levels, cannot be maintained by existing revenue; and, WHEREAS, the City Commission and the City staff have explored all possible options to increase the City's collectible revenue; and, WHEREAS, tax collections are not received during the months of July, August, September, October and November, necessitating the registration of warrants during this period, causing undue expenses to the General Fund; and, WHEREAS, by statute the City Commission may establish a cash reserve for an amount not I to exceed one-third (1/3) of the All-Purpose General Fund to meet expenditures from said fund during the months of July through November, inclusive; and, WHEREAS, the Legislature of the State of Montana has passed, during the 46th Legislative Session, Senate Bill No. 235, which permits municipalities in the State of Montana to exceed the previously established 65 mill levy ceiling for the All-Purpose General Fund; and, WHEREAS, the City staff has received a legal interpretation from the City Attorney ver- ifying that Senate Bill No. 235 has become effective as law in the State of Montana as of July 1, 1979; and, WHEREAS, Senate Bill No. 235 provides for the mechanisms necessary to exceed the prev- iously established 65 mill levy limitation for the All-Purpose General Fund, in order to maintain City services by providing revenue sources which are adequate to meet City expend- itures; NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, to-wit: Section 1 That the revenue derived from the special mill levy election as provided herein will be used to establish a reserve in the City's All-Purpose General Fund in order to operate said fund without the extensive registering of warrants to maintain City business during the months of July through November, inclusive. I Section 2 That the specific amount requested to establish said reserve, andfue amount necessary to be placed at issue before the qualified electorate of the City of Bozeman is $93,675.00. - ~ Section 3 That the above-stated amount, necessary to establish a reserve in the City's General Fund, represents 5.00 mills. -~ COMMIS 5.IQN _RE5.0LlJTIOlL1ID...__ 2086~~_~~~~__ _L ~.~ _~_ u~~~~ ~~~______~_~_~._.- -. .~~~.- ,.~ ~~~_.- . .-- -~ ~_. ~.~'-............--_..~........----.--. - . 246 Section 4 That said additional mill levy as stated herein shall be placed at issue before the qualified electorate of the City of Bozeman at the primary election to be held on September 11, 1979; and the wording of the proposal to be placed on the ballot shall indicate that the mill levy established herein (5 mills) shall be assessed and utilized to establish a reserve fund. I Section 5 That the City Commission of the City of Bozeman, Montana, hereby instructs the County Clerk and Recorder to proceed with a special election as set forth on the date herein speci- fied in accordance with the provisions of Senate Bill No. 235 and the election laws of the State of Montana.
