This City is authorized by Section 90-5-104, Montana Code Annotated (hereinafter, the Act), to acquire, whether by construction, purchase, devise, gift or lease, or anyone or more of such methods, any land, any building or other improvement, and all real and personal properties deemed necessary in connection therewith, whether or not now in existence, which shall be suitable for use for commercial, manufacturing or industrial enterprises, recreation or tourist facilities, and hospitals or long-term care facilities. To defray the cost of acquiring and improving any such project, the City is authorized by the Act to issue its revenue bonds and sell such bonds at public or private sale in such manner and at such time as may be determined by this bOdy to be most advan- tangeous. Such bonds are to be secured by a pledge of the revenues to be derived by the City from the project, and may be secured by a mortgage and by a pledge of the lease and by such other security devices as may be deemed advantageous. A petition has been present- ed to this City Commission by the Montana Bank of Bozeman, N.A., requesting that the City, acting pursuant to and in accordance with the act, issue revenue bonds of the City in an amount presently estimated to be approximately $4,000,000.00. Under the provisions of the obligations of the City; and the bonds and interest coupons shall not constitute nor give rise to a pecuniary liability of the City or a charge against its general credit or taxing powers. 2. Public Hearing. Chapter No. 304 of the Montana Session Laws of 1974, effective on July 1, 1974, requires that prior to the issuance of any bonds under the authority of the I Act, this Commission shall give notice and hold a public hearing on the project. Pursuant to such authority, a public hearing onfue proposed project is called and shall be held on the 29th day of August, 1979, at 1:15 o'clock, p. m., in the Commission Chambers, City Hall, Bozeman, Montana. The project and bonds as described in Paragraph One above are hereby given preliminary approval, subject to the conduct of the public hearing. 3. Publication of Notices. The Clerk of the City Commission of and for the City of Bozeman, shall cause notice to be published in a newspaper of general circulation in the City at least once a week for three consecutive weeks prior to the date set for the hearing, the last such publication being at least seven days before the date of the hearing, exclud- ~ ing the day of publication. - - ~ CITY COMMISSION OF AND FOR THE-CITY OF BOZEMAN ATTEST: -- Erna I State of Montana ) County_of Gallatin) City of Bozeman ) I, Erna V.
