WHEREAS, the City Commission of the City of Bozeman, Montana on the 29th day of March, 1961, passed and adopted Commission Resolution No. lU12 declaring it to be the intention of said Commission to create 8. Special Improvement Lighting Dis tric t No. 420 of said City for the purpose of insta~ling and maintaining a light- ing: systeM to light Cypress Avenue from the north property line ofi31ock D of Marwyn, a rearrangement of Blocks 13, 14, 15, Hi, 10, 20 and adjacent vacated streets of the Northern Pacific Addition to Bozeman, 11ontana, to its point of intersection with East Curtiss Street, East Curtiss Street from Cypress Avenue to the east line of said Block D, and a~l that portion of East Olive Street and McAdow Avenue as contain- ed within s8id Block D, said lighting S;Tstem to be installed and paid for by the Montana Power COMpany, all under the authority of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the Revised Codes of Montana, 1947, which said Resolu tion, of record and on file in the office of the Clerk of said Co~~1ss1on and open to the inspection of the public, is hereby referred to for further particulars; I and l,NHEREAS, due proof has been made that service of notice of the adoption of said Resolution No. 1012 was duly made and gIven as by law provided; and WHEREAS, a t the time and place fixed in said Resolution No. lU12 for the making and filing of protests against the creation of said proposed Special Improve- ment Lighting District No. 420, to-wit, at the hour of 1:00 o'clock P.~. on 'Neccnesday, the 19th day of April , 1961, being a re~ular meeting time of said City Commission, a t the Commission Chamber in the City Hall building of the Ci ty of Bozeman, there were not sufficient protests made or filed against the creation of said Special Improvement Lighting District No. 420; NOVi, THEREFORE, BE IT nF:SOL'\rED BY THE C0?5~'ISSION OF' THE CITY OF BOZEMAN: - Section 1 Creation and Purpose Tha t there be, and there is hereby created a special improvement district of the Ci t:l of Bozeman to be knovm and designa ted as Special Improvement Lighting D1s tric t No. 42U, for the purpose of installing and maintaininr; a lif~hting system to light Cypress Avenue from the north propert:r line of Block D of Marwyn, a roarrangement of Blocks 13, 14, 15, 1H, 19, 20 and adjacent vacated streets of the Northern Pacific Addition to Bozeman, Montana, to its point of intersection with East Curtiss Street, East Curtiss Street from Cypress Avenue to the east line of sa id Blocl{ D, and all that portion of East Olive street and McAdow Avenue as con- tained wIthin s.,aid Blocl{ D, said lighting system to be installed and paid for by the Montana Power C;ompany, all under the an,thority of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the Revised Codes of Jllontana, 1947, pursuant to fmd in conformi ty wi th GommisRion Resolution No. 1012 of the Commission of the Ci ty of Bozeman, passed and adopted on the 29th da y 0 f March , 1961, wrlich sa id I Commission Resolution No. lU12 declares it to be the intention of said City Commis- sion to create said Special Improvement Lighting District No. 420 for the purposes; aforesaid, and which said Commission Resolution No. 1012 is of record and on file in the office of the Clerk of said Ci ty Commis~)ion in the Ci ty Hall Building, Bozeman, is open to the inspection of the public, and is hereby referred to for further particulars. Section 2 Bounela ri e s 'Ihe boundaries of said Special Improvement Lighting lJlstrict No. 420, hereby created, are defined as described as follows: . .---- -..-.-- 19 Beginning at a point on the 1.:Vest line of Cypress Avenue, said point being 125 feet North of the North line of East Olive street, thence in a westerly direction parallel to the North line of East Olive Street extended a distance of 125 feet; thence in a southerly direction 125 feet West of and parallel to the West line of Cypress Avenue to a point 125 feet South of the South line of East Curtiss Street; thence in an Easterly direction 125 feet South of and parallel to the South line of East ~urtiss Street to a point on the West line of Golf Way; thence in a Northerly direction along the West line of Golf Way to I a pain t on the North line of Eas t Curtiss Street; thence in an Easterly direction along the North line of East Curtiss Street to the East line of Block D, Marwyn, said point being 125 feet East of the East line of McAdow Avenue; thence in a Northerly direction 125 feet East of and parallel to the East line of McAdow Avenue and continuing in a Westerly direction 125 feet North of the North line of Olive Street to the point of beginning. Section 3 Character of Improvements The character of the improvement to be made in said Special Improvement Light- ing Dis tric t No. 420 to be installed and paid for by the Montana Power Company is the erection and installation of 10 luminaires with 6,000 lumen lamps mounted approximately 30 feet high on wood poles. Fower is to be fed by a single overhead wire, and the instHllation shall be equipped with all necessary appliances for the safe and proper operation of the system. Section 4 Estimate of Cost of Maintenance and Electrical Current and Method of Assessment. An estimate of the cost of maintaining such lighting system and supplying current therefor is the sum of Two Hundred Ninety-Four Dollars (qp294.00) per year, of which seventy-five per cent (75%) is to be assessed against the property within the district on an area basis, and twenty-five (25%) percent is to be paid by the City of Bozeman. The estimated rate of assessment per year per square foot of the property within the district is $0.000'7963 per square foot. I Section 5 Actual Area of District The total actual area_ of the property wi thin said proposed Special Improve- ment Lighting District No. 420 is 300,635.35 square feet. Section 6 Fa ymen t Special Improvement Lighting District No. 420 is established for the pur- pose of paying the operating and maintenance cost of such lights only which said operation and maintenance will include the furnishing of electric current, al l lamps as needed, and the maintenance of poles, cables, and other incidental items. The entire installation cost of such lights will be borne by tbe Montana Power Company. The portion of the cost of maintenance and electrical current payable by the City of BozemRn will be paid directly by the City of BozemRn and the portion to be assessed against the property within the district will be assessed and paid annuRlly as pro,T1ded by law.
