A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY
OF BOZEMAN TO CREATE A SPECIAL H'PROVEMENT DISTRICT

AND OTHER WORK INCIDENTAL THERETO.
WHEREAS, there has been filed with the Clerk of the City Commission of the
City of Bozeman, Montana, a petition in due form of certain owners of properties
situated on West Short Street from North Sixth Avenue to North Seventh Avenue and
on North Sixth Avenue from West Villard Street to Durston Road in said City ask-
ing that a special improvement district be created for the purpoBe of construct-
ing and installing a pavement project to include combination concrete curbs and
gu tters, gravel base course, crushed gravel cushion course, and
bituminous sur-
face course and other work incidental thereto; and
WHEREAS, that a regular meeting of the City Commission of the City of
Bozeman held on the 12th day of April, 1961, the aforesaid petition was
respectively considered and ~ranted; NOW THEREFORE,

Section 1
I
Declaration of Intention
Tha tit is hereby declared to be the inten tion of the Oi ty of Bozeman to
create a special improvement district to be !mown and designated as Special
Improvement District No. 421 of the City of Bozeman for the purpose of construct-
ing and installing a pavement project on West Short Street from North Sixty Ave-
nue to Forth Seventh Avenue and on North Sixth Avenue from West Villard Street
to Durston Road, said pavement project to include combination concrete curbs and
gu tters, gravel base course, cr1::.shed gravel cushion course,
and bi~lminous sur-
face course and other work incidental there to.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 421 are described
as follows:
Beginning at a point on the North line of West Villard
Street, s~id point being 110 feet West of the West line
of North Sixth Avenue, thence from said point of beginning
and in a northerly direction 110 feet West of and parallel
to the iNest side of North Sixth Avenue to a point 152
feet South of the South line of West Short Street; thence
in a Westerly direction 152 feet South of and parallel to
the Sou th line of We s t Short S tre e t to the Ea s t line of
North Seventh Avenue; thence in a northerly direction
along the East line of North Seventh Avenue to a point
152 feet North of the North line of 'vVest Short Street;
thence in an easterly direction 152 feet North of and
parallel to the North line of West Short Street to a
I point 110 feet West of the West line of North Sixth Avenue;
tl:ence in a northerly direction 110 feet West of and
parallel to the West line of North Sixth Avenue
to a
point on the South line of Durston Road; thence
in an
easterly direction along the South line of Durston Road
to a point 110 feet East of the East line of North Sixth
Avenue; thence in a southerly direction 110 feet east
of and parallel to the East line of North Sixth Avenue
to a point on the North line of West Villard Street;
thence in a westerly direction along the North line of
West Villard Street to the point of beginning.

Section 3
Character of Improvements
Constnlction of a pavement project on West Short Street from North Sixth
Avenue to North Seventh Avenue and on North Sixth Avenue from West Villard Street
to Durston Road, said pavement project to incDlde combination concrete curbs and
gu tters, gravel base course, c~lshed gravel cushion course and bituminous surface
course, and other work incidental thereto.
Section 4
I
Estimate of Cost
The preli~inary estimate of cost is $29,800.UO, including all street exca-
va tion, all ma terials, installation costs, engineering and incidentals.
Section 5
Method of Assessment
The preliminary estimate of cost set forth above is to be assessed on an
area basis, with the first 25 feet of each lot next and adjacent to the improve-
ment being recorded at double its actual area in computing the assessable area of
each lot. On this basis the assessable area of the district is 299,163.20 square
feet.
Sec tion 6
Actual Area of District
The actual area of the district as described is 211,414.70 square feet, and
protests will be considered on an actual area basis.
Section 7
Pa ymen ts
That payments for said improvements shall be made in twenty (20) annual
installments extending over a period of nineteen ( 19)
years, but this shall not
be construed to prevent payment in full at any reg"ular payment date by any pro-
perty owner who desires to do so. It is proposed to pay the entire cost and

expense of the construction and installation of said improvements with cash to be
obtained from the sale of bonds of said Special Improvement District No. 421, as
au thorized by law. Such bonds will be in denomina tions of ~iauO .00 each and fractions
or multiples of $lUO.UO where necessary, to be issued and charBeable against a fund
to be known and designated as Special Improvement District No. 421 Fund of the City
of Bozeman. The bonds will be redeemable at the option of the Ci ty,
singlely or
in multiples, and in the order of their registration,
whenever funds are available
for that purpose in said Special Improvement District No. 421.
Said bonds will
draw a simple interest from the date of their registration until called for pay-
men t, at a rate not exceeding six (6) per cent per annum, which interest shall be
chargeable as a part of the cost of the construction and installation of said
improvement. The bonds will be issued and sold in accordance with the provisions
of Section 11-2232 and Section 11-2271, Revised Codes of Montana,
1947, and all
other applicable provisions of Title 11 of the Revised Codes of Montana,
1947,
relating to Special Improvement Districts in cities and towns,
and any amondments
thereof or thereto.
Section 8
Protests and Notice

at the Commission Room of the City Hall, J:jozeman, Montana, is designated by said

property is within said proposed Special Improvement District No. 421 on West Short
Street from North Sixth Avenue to North Seventh Avenue and on North Sixth Avenue
from West Villard Street to Durston Road in said City may appear and show cause, if
any they have, against said proposed improvement. Objections must be made in writing
and filed with the Clerk of the City Commission not later than fiftenn (15) days
after date of the first publication of this Notice.
An approximate preliminary estimate of the cost of doing such work and making

made in twenty (2U) annual installments over a period of nineteen (19) years with
interest on the deferred payments not to exceed six (6) per cent per annum, pay-
ab-Le annually, but this shall not be construed to prevent payment in full at any

For 3 description of the boundaries of said Special Improvement District
No. 421 reference is hereby made to Resolution No. 1013 of the Commission of the
City of Bozeman declaring the intention to create said District, which is on file
in the office of the undersigned Glerk of said Commission in the City Hall of said
City of BozemBn, state of Montana, and open for inspection to all interested parties
and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised
Codes of Montana, 1947.
