WHEREAS, there has been filed with the Clerk of the Commission of the City of
Bozeman, Montana, a petition in due form of certain property owners on Cypress Ave-
nue from the north property line of Block D of Marwyn, a rearrangement of Blocks
13, 14, 15, 18, 19, 20 and adjacent vacated streets of the Northern Pacific Addition
to Bozeman, Montana to its point of intersection with East Curtiss Street, East Curtiss
Street from Cypress Avenue to the east line of said Block D, and all that portion of
East Olive Street and MCAdow Avenue as contained within said Block D asking that a
special improvemen t lighting dis trict be crea ted for the purpose of opera ting and
maintaining a lighting system to light Cypress Avenue from the north property line
of Block D of Marwyn, a rearrangement of Blocks 13, 14, 15,

of intersection with East Curtiss Street, East Curtiss Street from Cypress Avenue
to the east line of said Block D, and all that portion of East Olive Street and

NOW, THE:'EFORE, BE IT RESOLVED BY THE CITY COWnSSION OF TIlE CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create
a special improvement district to be known and designated as Special Improvement
Lighting District Number 420 of the City of Bozeman for the purpose of operating and
maintaining a liphtlng system to light Cypress Avenue from the north property line
of Block D of Marwyn, a rearrangement of Blocks 13, 14, 15,
18, 19, 20 and adjacent
vacated streets of the Northern Pacific Addition to Bozeman, Montana, to its point
of intersection with East Curtiss Street, East Curtiss Street from Uypress Avenue
to the east line of said Block D, and all that portion of East Olive Street and
McAdow Avenue as contained within said Block D.
Section 2
Boundaries
The boundaries of said Special Improvement Lighting District are described as
follows:
Beginning at a point on the West line of Cypress Avenue, said point being
125 feet North of the North line of East Olive Street, thence in a westerly
direction parallel to the North line of East Olive Street extended a dis-
tance of 125 feet; thence in a southerly direction 125 feet West of and
parallel to the West line of Cypress Avenue to a point 125 feet South of
I the South line of East Curtiss Street; thence in an Easterly direction
125 feet South of and parallel to the South line of East Curtiss Street to
a point on the West line of Gol~ Way; thence in a Northerly direction along
the West line of Golf Way to a point on the North line of East Curtiss
Stree t; thence in an Easterly direction along the North line of East Curtiss
Street to the East line of Block D, Marwyn, said point being 125 feet East
of the East line of McAdow Avenue; thence in a Northerly direction 125
feet East of and parallel to the East line of McAdow Avenue and continuing
in a Westerly direction 125 feet North of the North line of Olive Street
to the point of beginning.

Section 3
Character of Improvements
The character of the improvement to be installed and paid for by The Montana
Power Company is the erection and installation of 10 luminaires with 6,000 lumen
lamps mounted approximately 30 feet high on wood poles. Power is to be fed by
a single overhead wire, and the installation shall be equipped with all necessary
appliances for the safe and proper operation of the system.
Section 4

Estimate of Cost of Maintenance and
Electrical Current and Method of Assessment.
An estimate of the cost of maintaining such lighting system and supply-
~_ng current therefor is the sum of Two Hundred Nine ty-Four Dollars (~~294 .00)
per year, of which total seventy-five percent (75%) is to be assessed against
the property within the district on an area basis, and twenty-five (25%) percent
is to be paid by the City of Bozeman. The estimated rate of assessment per year
per square foot of the property within the district 1s $0.0007963 per square
foo t.
Section 5
Actual Area of District
The total actual area of the property within said proposed Special Improve-
ment Lighting District No. 420 is 300,635.35 square feet, which is the area on
which all protests will be received, considered and determined.
Section 6

The proposed Special Improvement Lighting District will be established for
the purpose of paying the operating and maintenace cost of such lights only which
said operation and maintenance will jnclude the furnishing of electric current,
all lamps as needed and the maintenance of poles, cables, and other incidental
item s . The entire cost of such lights will be borne by the Montana Power Company.
Section 7
I
Protests and Notice
That the regular session of the City Commission of the City of Bozeman, to
be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on
Wednesday, the 19th day of April ,A.D. 1~61, at the hour of one o'clock p.m.
of said day, are-tl1:e time and place when and where the City Commission will hear
and pass upon all protests duly and regularly made and filed against the creation
of said proposed Special Improvement Lighting District No. 420, the improvement
proposed to be made pursuant thereto and the extent and character thereof, or
either thereof; and the Clerk of the City Commission be, and he is hereby directed
to give notice in the manner and for the time as by law required, of the adoption
of this Resolution of Intention.
Adopted by the Commission of the City of Bozeman, Montana, at a reglJ1ar and
stated session of said Commission held on the 29th day of March, A.D. 1961.

That Wednesday, the 19th day of April, A. D. 1961, at one o'clock p.m. at the
Commission Room of the City Hall, Bozeman, Montana, is designated by said Resolution
No. 1012 as the time and place for hearing objections to the action proposed to be taken
by said resolu tion, and when and where any and all pe rsons whose propert~r is wi thin said
proposed SpeciaJ Improvement Lighting District No. 420 on Cypress Avenue fl'om the North
property line of Block D. of Ma rwyn , a rearrangement of Blocks 13, 14, 15, 18, 19, 20
and adjacent vacated streets of the Northern Pacific Addition to Bozeman, Montana, to
its point of intersection with East Curtiss Street, East Curtiss Street from Cypress Ave-
nue to the East Line of Block D, and all that portion of East Olive Street and McAdow
I Avenue as contained within said Block D, in said City may appear and show cause, if any
they have, against said proposed improvement. Objections must be made in writing and
filed with the Clerk of the City Commission not later than fifteen (15) days after the
date of the first publication of this Notice.
- That the general character of the improvement to be made in said Special Improve-
ment Lighting District No. 420 is the erection and installation of 10 luminaires with
6,000 blmen lamps mounted approximately 30 feet high on wood poles. Power is to be fed
by 3 single overhead wire, and the installation shall be equipped with all necessary
appliances for the safe and proper operation of the system.
An approximate and preliminary estimate of the cost of mainteining such lighting
system and supplying current therefor is the sum of Two Hundred Ninety-Four Dollars
(tl;294.00) per year, of which total seventy-five percent (75%) is to be ass,essed again-
st the property within the district on an area basis, and twenty-five (25;0) percent is
to be paid by the City of Bozeman. The estimated rate of assessment per year per
square foot of the property within the district is $0.u007963 per square foot.
The proposed Special Improvement Lighting District will be established for the
purpose of paying the operating and maintenance cost of such lights only which said
opera tion and ma in tenance will include the furnishing of electl'ic current, all lamps
as needed and the maintenance of poles, cables, and other incidental items. The entire
cost of such lights will be borne by the Montana Power Company.
For a description of the boundaries of said Special Improvement Lie:hting District
No. 420 reference is hereby made to Resolution No. 1012 of the Commission of the City
of Bozeman declaring the intention to create said District, which is on file in the
office of the undersigned Clerk of said Commission in the City Hall of said City or
Bozeman, State of Montana, and open for inspection to all interested parties and the
public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes
I of Montana, 1947.
