LEVYING AND ASSESSING A SPECIAL 'ASSESSMENT OF TAXES UPON ALL THE

and thereafter, after due and legal proceedings had, the Commission of The City
of Bozeman did on the 22nd day of March , 1961, duly pass Commission
Resolution No. ~, entitled:

which Commission Resolutions Nos. ~ and 10~1, passed as aforesaid, are nereby
referred to and made a part of this resolution for further particulars in respect
to the bmmdaries of said dis tric t, the character of the improvements to be con-
s truc ted the re in, the estimated cost of said improvements and the methof of assess-
ing the cost against the property within said district; and
WHEREAS, said improvements as contemplated in said Commission Resolutions
Nos. ~ and lUll have been constructed and completed in accordance with the terms
and conditions of Commission Resolutions Nos. lulU and lu~l, and the total cost of
said improvements so const~lcted is the sum of - - Thirty-seven thousand
one hundred sixty-six and ~2/1Uuths dollars ($37,~66.82)
NOW, THE"qEFORE, pursuant to the provis10!ls of Sections l1-22V1 to 11-228'1
I and 11-33vl, R. C. M., 1947 and amendments thereto,
BE IT RESOLVED AND IT IS lfEREB'Y ORDERED BY THE COMMISSION OF' Tm~ CITY OF
BOZEMAN, STATE OF MONTANA:
Section .1. That to defray the cost and expense or const~lctlng and making
the improverrents in said Special Improvement District No. ~, there be, and
there is hereby levied and assessed a tax amounting to the sum of Thirty-seven
thousand one hundred sixty-six & 82/l00ths dollars upon all the 'property in said

and parcel of land with the name of the owner and the sttm assessed against him
or it for such improvements and the amount of each partial payment to be ma.de
and the day when the same shall be delinquen t is set fortil in detail in the
assessment list nereto attached, marked Schedule II A"', and made a part hereof;
that the several sums set opposite the names of the owners and the described

lots and parcels of land be, and the same are hereby respectively levied and
assessed upon and against said described lots and parce~s of land to defray the
cos t and expens e of cons true ting and making ttle improvements within said Dist-
rict; that the several sums so assessed be collected from the respective owners
of said lots and parcels of land d~~cribed in said assessment list, SChedule "AI"
as required by law; the t the payment of said sums shall be made in 20 ins tall...
ments and the payment of said lnstall:'nents shall extend over a period of nine-
~ years; that the payment of the respective annual installments shall be made
on or before the 3Uth day of November of each year until payment of all install-
men ts together with the interest thereon, shall be made;
that said sums shall be
paid and the collection thereof Shal~ be made in the manner and in accordance
with the law governing the collection of special improvement taxes; tha t failure
to pay such assessments when the same become due and payable shall make such per-
sons and said lots and parcels of land liable to the penalties provided by law
relative to delinquent taxes.
Sec tion 2. That the regular session of the Commission of The City of

25th day of October, 1921, at 1:00 at clock P.~., be,
and the same ts hereby
designated as the time and place at which objections to the final adoption
of
this Resolution WilL be heard by said Commission.
Section 3. That the Clerk of the Commission of The City of Bozeman, be

he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a
daily newspaper printod and published in the said City of Bozeman, a notice signed
by the Clerk of the Commission and stating that a Resolution levying and assessing
a special assessment of taxes to defray the cost and expense of constructing and
making the improvements in the said Special Improvement District No. 419 is on
file in the office of the Clerk of the Commission subject to inspection for a
period of five (5) days; that said Notice shall state the
time and place at which
objections will be heard by the Commission to the final adoption of this Reso-
lu tion; that it shall be published at least five (5 )
days before the day set by
the Commission for the hearing of objections and the final adoption of this Resolu- I
tion.
Provisionally passed and adopted by the ~ommission of the City of Bozeman
at a regular session thereof held on the l~th day of October,
1961.

NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of The
City of Bozeman held on the leth day of October, 1961,
Commission Resolution
No. lu33 was provlsionaily passed and adopted; that said Commission Resolution
levies and 9ssesses a special assessment of taxes upon ali the property in Speciai
Improvement District No. 419 in said City, to defray the cost and expense of
constructing 'and making the improvements within said District, to-wit:
Beginning at a point on the west line of North Seventh Avenue, said
I point being twenty feet south of the south line of Royal Vista Addi-
tion as platted within the City of Bozeman, Montana, thence from
said point of beglnr.ing and in a westerly direction twenty feet
south of and paraiiel to the south line of Royal Vista Addition to
a point 16U feet west of the west line of Eighth Avenue; thence in
a northeriy direction to and along the rear lot lines of Lots 1, 2,
3, 4, 5 and- 6 of Block 3, Royal Vista Addition to the south-westerly
cornor of Lot 6 of said addition; thence in a northeasteriY direction
aiong the westeriY lot ~ine of Lot 6, Block 3 and Lot 16,
Block 1 to
tho northwesteriy corner of said Lot 16, Block 1,
of said Royal Vista
Addition; thence in an easterly direction along the northerly line

therein.
