HomeMy WebLinkAboutResolution 1030 Lighting District Maintenance and Electrical Costs 55 COMMISSION RESOLUTION NO. 1030 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAIN- I TENANCE AND ELECTRICAL C~RRENT COSTS FOR SPECIAL IMPROVE~ MENT LIGHTING DISTRICTS OF THE CITY OF BOZEMAN, P1JRSUANT TO THE PROVISIONS OF SECTIONS 11~2252, R.C. M., 1947. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Sec tion 1. Tnat pursuant to the direction and by authority of the provisions of Section 11-2252, R.C.M., 1947, and upon estimates of such cost made by said City Commission as authorized and directed by said Section 11-2252, R.C.M., 1947, to defray the cost of maintaining lighting systems and for electrical current in the several Special Improvement Lighting Districts of the City of Bozeman hereinafter specified, there is hereby levied and assessed against the property and the several lots, pieces and parcels thereof within the boundaries of Special Improvement Lighting Districts Nots. 284, 288, 289, 290, 2gb, 3UO, 361, 362, 3t38, 400 and 420 of the City of Boze- man respec tl vel~T, as heretofore created and established, the total amounts as to each entire district and the several amounts as to each lot, piece, or parcel of land within the boundaries of such district, as set forth, in the several schedules atta- ched hereto and made a part hereof and marked separately for identification as Schedule One thru Schedule Eleven. The Hmount so levied and assessed is 75% of such estimated cost of each and all of said Districts except for SILDts No's. 361 and 362, and as to SILD No. 361 and 362 the levy and assessment is bU% of such estimated cost. Section 2. That a particular Description of each lot, piece or parcel of land with the name of the owner thereof, and the sum assessed and levied against such pro- perty and owner, or ei ther, is set forth in the schedule of each district as speci- fied and identified in Section 1 of this Resolution, and made a part of this Reso- lution as aforesaid. Section 3. That the regular meeting of the Commission of the City of Bozeman to be held on the 4th day of October, 1~61, at l:uO o'Clock P.M. at the Commission I Chamber, City Hall Building, in the City of Bozeman, be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard and considered by said City Commission. Section 4. That the Clerk of the Commission be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and publisned in said City of Bozeman, a notice signed by said Clerk as such which notice shall state that this resolution levying and assessing the several amounts set forth in the Schedules' attached hereto and made a part hereof as aforesaid, and for the purposes herein stated, has been provisionally passed and adopted by the Commission of the City of Bozeman and 1s on file in the office of said Clerk and subject to inspection during regular office hours, for a period of five days from and after the pubLication of such notice and at any time during such office hours and at or 'prior to the reguLar meeting of the City Commission to be held on the 4th day of October, 1~61, ~s stated in Section 3 hereof; that said Notice shall be so publisned once, and sucn publication shall be made not less than five days before the time set for hearing and considering objections to the fine 1 adoption of this Resolution as ~foresaid. I NOTICE IS HEREBY GIVE, that at a re~l~ar meeting of the Commission of the Ci ty of Bozeman, Montana, held on the 2'1th day of September, ~901, Commission Resolution No. lu30, was provisiona~~y-p;ssed and adopted. Said Resolution ~evies and assessed a special assessment upon all the property in ~ecial Improvement Lighting Districts of said City and to defray the estimated coat of maintenance and electrical current for each of said Districts, pursuant to the provisions of Section 11-2252, R.C.M., 1947. The portion of such cost assessed is 7b% as to all of said Districts except Districts No. 361 and 362 (Main St.) and as to such districts the portion of the cost assessed 1s bO%. Reference 1s made to the Commission Resolutions creating the Special Improvament Lighting Districts above enumerated, which resolutions are on file in the office of said Clerk, subject to pub~ic inspection during regular office hours.
