Home My WebLink AboutResolution 1026 Taxes for Noxious Weeds, 1961 43 COMMISSION RESOLUTION NO. 1026 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVY- ING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CER- I TAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS WEEDS FOR THE YEAR 1961 PURSUANT TO THE PROVISIONS OF CHAPTER 6.5U OF THE BOZEMAN MUNICIPAL CODE. WHEREAS, the City Council of the City of Bozeman heretofore duly and regularly passed Ordinance No. 428, entitled: "AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNI- ISHMENT AND ABATEMENT OF CERTAIN NUISANCES", AND WHEREAS, Section ~1-985 R.C.M., 1947, provides the City or Town Council has power to declare and determine what vegetation within the City or Town shall be noxious weeds, and to provide the manner in which they shall be exterminated, and to require the owner or owners of any property within said City or Town, to exter- minate or remove noxious weeds from their premises, and one-half of any road or street lying next to the lands or boulevard abutting thereon, and to provide, in the event the owners or owner of any of said premises neg~ect to exterminate or remove noxious weeds therefrom, for levying the cos t of such extermina tion or removal as special assessment against the property; and WHEREAS, owners of premises in said City have neglected to exterminate and remove noxious weeds therefrom during the year 1961 and the City of ~ozeman, pur- suant to Section 11-95 RCM, 1947, and Section 6.5U.U20 of the Bozeman Municipal Code, have exterminated and removed noxious weeds from the premises ofsald owners and the total cost of the extermination and removal thereof is chargeable to the property as hereinafter set forth, pursuant to the provisions of said SectJ.oll ll-Wdb, Pol1&iCal Code, R.U.M., 1947, and said Section 6.bu.u2U of the Bozeman Municipal Code. BE IT RESOLVED AND IT HEREBY ORDERED BY THE COMMIS- I SIaN OF THE CITY OF BOZEMAN, STATE OF MONTANA; Sec tion 1. 'lna t during the year 1961, the City of Bozeman has exterminated and removed noxious weeds from the properties 1n the City of Bozeman and defrayed the cost thereof as set forth in the Schedule hereto attached and made a part hereof. See tion 2. That to defray the cost ($2le.5U) of exterminating and removing said noxious weeds from said premises as set forth in said schedule, hereto attached and made a part hereof, for the year 1961, there be, and there is hereby levied and assessed a special tax against said property as set forth in said schedule, hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it is set forth in assessment list hereto attached marked "Schedule Una", and made a part hereof; tha t the several sums se t opposi te the names of the owners and the description of the lots and parcels of land be, and the same are hereby ~evied and assessed upon and against said lots and parcels of land; that the several sums be collected from the respective owners of said lots and parcels of land described in said assessment list, "Schedule One", as required by law; tha t said sums shall be paid and the collection thereof shall be made in the manner in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when same shall become due and payable sha~l make such persons and such lots and parcels of land liable to the penalties provided b~ law relative to delinquent taxes. Section 3. That the regular session of the Commission of the City of Bozeman to be held on the 20th day of September, 1961 at the Commission Room, City Hall Building, be and the same is nereby designated as the time and place at which objections to the final adoption of this resolution will be heard by the Commission. Sec tion 4. That the Clerk of the Commission be, and he 1s hereby ordered I and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice s1gned by the Clerk of the Commission, stating that a resolution levying a special assessment of taxes to defray the cost of exterminating and removing noxious-weeds from certain proper- ties in the City of Bozeman for the year 1961, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be publi- shed at least five dars before the date set by the Commission for hearing of objections, and the f nal adoption of this reaolution. HEARING, FINAL ADUPTION COMM:ISSION RESOLUTION NO. 1U26 I LEVYING SPECIAL ASSESSMENT OF TAXS TO DEFRAY THE m5'ST OF EXTERMINATING AND REMOVING NOXIOUS WEEDS ON CERTAIN PROPBRTIES IN THE CITY OF BOZEMAN FOR THE YEAR 1961.. NOTICE IS HEREBY GIVEN, that at a re~11ar session of the Commission of the City of Bozeman held on the 13th day of September, 1961, Commission Resolution No. 1026 was duly passed and adopted; that said Commission Resolution No. 1026 levies and assesses a special assessment of taxes upon certain properties in the City of Bozeman for the year 1961 to defray the cost of exterminating and remov- inv noxious weeds for the year 1961. That, said Commission Resolution No. 1026 is now on file in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of all persons interested for a period of five days; that Wednesday the 20th day of Septembe r, 1961, at 1:00 o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commis. sion Resolution No. 1026 and the levying of said assessment; that, said Resolution Wiil be finally passed and adopted at said regu1.ar session of said Commission sub- ject to such corrections and amendments as may be made upon objections made and fiied within the five days limit as provided by iaw.
