A RESULUTION OF THE COMMISSION OF THE CITY OF BOZEMAN
LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON
ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE
CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA,
TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING
STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE
CITY OF BOZEMAN FOR THE YEAR 1961. I
WHEREAS, the City Council and the Commdssion of the City of Bozeman have
heretofore duly and regularly passed Council and Conunission Resolutions creating
Street sprinkling Districts within the City of Bozeman and defining the bound-
aries thereof and providing for the assessment of the cost of sprinkiing the same
as set forth in Resolutions hereinafter referred to; and
WHEREAS, the streets within the boundaries of said Street Sprinkiing Dist-
ricts have been sprinkled during the year 196i, as contemplated in said Resolutions,
in accordance with the terms and conditions thereof; and
WHEREAS, the Street Sprinkling Districts and the Resolutions creating the
same, the total frontage of the property within said district to be assessed, the
total cost of said sprinkling within said districts and the proportion thereof
ch~eable to the property therein is hereinafter set forth.
NOW THEREFOR, pursuant to the provisions of Sections 11-2263 to 11-2267 inclu-
sive, R.C.M., 1947, the Bozeman Municipal Code and said Council and Commission
resolutions creating said Street Sprink1ingDistricts;
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMIS-
SION OF THE CITY OF BOZEMAN, STA TE OF MONTANA:
Section 1. That for the ~ear 1961, the City of Bozeman has waived the
sprinkling assessments or all treet ~prinkiing Districts except Street Sprinkling
Districts No.1, 2, 3 and 4; that for the year 1961, The City of Bozeman has de-
frayed the cost $9,245,48 of sprinkling streets in the several street sprinkling
districts pursuant to Resolutions creating the same, and seventy-five percent of
the entire cost thereof ($6,934.11) exciuslve of the cost of sprinkling parks and
public places, the total number of linear feet of property to be assessed, and I
the rate per linear foot, is as follows:

Tracy, Black and Rouse Avenues one-half (t) block each side of Main
Street, a total frontage of 9,355.9 feet, the sum of $2,873.61, being
75% of the entire amount4 or at an approximate rate per front foot or
side street frontage of U.307144155.
Sp rinkling District No.2, created by Council Resolution No. 995,
Babcock Street from east property line of south Rouse Ave. to the west
property iine of south Fourth Ave., including one-half t block on
Rouse, Bozeman, Black, Tracy, Willson & Grand Avenues north from Bab-
cock Street, Willson Ave. from Babcock Street to south property line
of Olive Street and Third Ave., between Babcock and Main Street, a
total frontage of 7,221.2 feet, the sum of ($1,8U5.3l), being 75% of
the entire amount, or at an approximate rate per front foot of main
or side street frontage of $U.25.
Sprinkilng District NO.3, created by Council Resolution No. ~96, Menden-
hall Street from the east property line of North Rouse Avenue to the
west property line of North Third Avenue including one-half (t) block
on Rouse, Bozeman, Black, Tracy, WWillson and Grand Avenues south from
Mendenhall Street and North Third Avenue between Mendenhall Street and
Main Street, a total frontage of 6,359.58, the sum of ($1,589.94),
being 75% of the entire amount, or at an approximate rate per front
foot of main or side street frontage of iV.25.
Sprinkiing District No.4, created by Council Resolution No. 99'1,
West Main Street from the west property line of vacated"Bourt.t;l. Ave-
nue to '"the 'wee t property line of South Eighth Avenue, a total frontage
of 2,661.U feet, the sum of ($665.25), being 75% of the entire amount, I
or at an approximate rate per front foot of main or side street
frontage of $U2.5.
Section 2. That to defray seventy-five percent of the cost of
sprinkling streets within said street sprinkling districts for the year
1961, there be, and there is hereby ievied and assessed a tax, upon all
property in front of and bordering on said street sprinkling districts
as set forth in Schedule one hereto attached and made a part hereof;
that a particular description of each lot and parcel of land with the
name of the owner and the sum assessed against him or it, is eet forth
in the assessment lists hereto attached, marked Scheduie No. 1 and made

a part hereof; that the several sums set opposite the names of the owners, and the
described lots and parcels of land be, and the same are hereby levied and assessed
upon and against said lots and parcels of land; that the several sums be collected
from the respective owners of said lots and parcels of ~and described in the said
assessment lists, Schedule One, as required by ~aw; that said sums sha~l be paid
and the co~lection thereof sha~l be made in the manner and in accordance with the
law governing the co~lection of special improvement taxes; too t failure to pa y such
assessments when the same shall become due and payable shall make such persons and
such lots and parce1s of 1and liable to the penal ties provided by law rela ti ve to
I delinquent taxes.
Sec tion 3. That the regular session of the Commission of the City of Bozeman
to be held on the ~ day of September, 1961, at the Commission Chamber, City Hall
Bui1ding, be, and the same is hereby designated aa the time and place at which
objections to the final adoption of this Resolution will be heard by the Commission.
Section 4. That the Clerk of the Commission be, and he is hereby ordered and
directed to pub1ish in the Bozeman Daily Chronicle, a daily newspaper printed and
published in the said City of Bozeman, a notice signed by the Clerk of the Commis-
sion, and stating that a Resolution levying a special assessment of taxes to de-
fray seventy-five per cent of the cost of sprinkling streets in the said Street
Sprinkling Districts for the year 1961, is on file in the office of the Clerk of
the Commission, sUb,jact to inspection for a period of five days; that said Notice
shall state the time and p1ace at which objections will be heard by the Commis-
sion to the f1nal adoption of this Resolution; that it shall be published at least
five days before the date set by the Commission for hearing objections, and the
fina1 adoption of this Resolution.
Provisiona~ly passed and adopted by the Commission of the City of Bozeman at
a regular session thereof held on the 13th day of September, 1961.

HEARING FINAL ADOPTION COMMISSION RESOLUTION NO. 1025
LEVYING ASSESSMENT OF SEVENTY-FIVE PERCENT OF COST OF
S~RINKLING STREETS, STREET S~RINKLING DISTRICTS FOR THE
YEAR 1961.
NOTICE IS HEREBY GIYEN, that at a regu1ar session of the Commission of the
City of Bozeman held on the 13th day of Sept., 1901, Commission Resolution No. 1025
was duly passed and adopted; that said Commission Resolution No. 1025 levies and
assesses a special assessment of taxes upon all the property in Street Sprinkling
Districts of said City to defray seventy-five percent of the cost of sprinkling
streets within said Street ~prink1ing Districts for the year 1961.
That said Street Sprinkling Districts, and the Resolution creating the same
I and the amount of the assessments are as follows:
Street Sprink~ing District NO.1, created by Resolution No. 424t, in
the amount of $2,873.61.
Street SprinkLing District No.2, created by Resolution No. 995, in
the amount of $1,H05.31.
Street Sprinkling District NO.3, created by Resolution No. 996, in
the amount of $1,589.~4.
Street Sprink~ing District No.4, created by Resolution No. 997, in
the amount of '665.25.
That said Resolution No. 1U25 is now on file in the office of the Clerk of the
Commission of said City of Bozeman subject to inspection of a11 persons interested

for a period of five days; that Wednesday, the 2uth day of Sept., 1961, at 1:00
o'clock P.M. of saId day at a regular session of the Commission of the City of
Bozeman, Commission Room, City Hall Building, has been designated as the time and
place when and where said Commission will hear and pass upon any and all objections
that may be made to the final adoption of said Commission Resolution No. 1025,
and the levying of said assessments; and that said Resolution will be finally
passed and adopted at said regular session of said Commission, subject to such
corrections and amendments as may be made upon objections made and filed within
five days limit as provided by law.
