COMMTSSION RESOLUTION NO. 1042

I A RESOLUTION OF THE COMMISSION OF THE CITY OF
BOZEMAN EXTENDING THE BOUNDARIES OF THE SAID CITY
OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A CERTAIN
TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF
BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED
WITHIN THE CORPORATE LIMITS THEREOF.
WHEREAS, there has been presented to the City Commiss10n of the
City of Bozeman a written and verbal request petitioning the said City
Commission to extend the boundaries of the City of Bozeman so as to include
within the boundaries in the City of Bozeman, lands which have been platted
into lots, blocks, streets and alleys and certain unplatted land that has
been surveyed, which considered to gether form a tract contiguous to said
City of Bozeman; and
WHEREAS, there has been presented to the City Commission of the
City of Bozeman a Certificate of Survey of said unplatted land which has been
filed in the Office of the County Clerk and Recorder of Gallatin County,
Montana, on the 22nd day of May, 1962, and that, further, there has been a
Plat presented to said City Commission entitLed "WESTRIDGE, a Subdivision of
a portion of the Northerly one-half of the Northwest Quarter of Section Nine-
teen, Township Two South, Range SiX East of the Montana Principal Meridian in
the County of Gallatin, State of Montana", which said Plat was duly filed in
the Office of the County Clerk and Recorder of Gallatin County, Montana, on
the 16th day of June, 1960; and
WHEREAS, the proper legal descriptions of said contiguous tracts,
both of which said tracts are to be considered together as one unit for the
purpose of this Resolution, are as follows:
Tract No. 1
The following unplatted land for wnich a Certificate of Survey
I has been filed in the Office of the County Clerk and Recorder,
Gallatin County, Montana:
Beginning at the Southwest corner of Section Eighteen,
Township Two South, Range Six East of the Montana
Principal Meridian; thence along the Westerly line of
said Section Eighteen N. 000 -01' W. a distance of
1,465.07 feet to a point on the Southeasterly line
of the 50 foot right-of-way of tbe Chicago, Milwaukee,
St. Paul and Pacific Railroad Company; thence along
said Southeasterly right-of-way line N. 300 - 16' E.
a distance of 1,353.60 feet to the point of inter-
section with the southerly line of Butte Addition to
Bozeman, Montana; thence along said southerly line
EAST 8 distance of 245.95 feet to the Southeasterly
corner of said Butte Addition; thence along the east-
erly line of aforesaid Butte Addition N. 000 -01' E.
a distance of 421.75 feet to a point on the South-
easterly line of aforesaid Railroad right-of-way;
thence along aforesaid Southeasterly right-of-way
line N. 300 -16' E. a distance of 1,503.57 feet to
a poin t; thence S. 590 -44' E. a distanoe of 25.00
feet to a point; thenoe N. 300 -16' E. a distanoe
of 97.81 feet to the point of beginning of a cir-
cular curve to the right with the radius of 233.19
feet; thence along the arc of said curve, through
a central angle of 590-05', a distance of 240.47 feet
to a point; thence N. 89021' E. a distance of 5u9.75
feet to the Northeast corner of the Thompson ranch,
which said point is located on the North and South
center line ot aforesaid Section Eighteen; thence

E. a distanoe of 4,214.23 feet to a point on the
northerly boundary of Spring Creek Road, and also
the point of beginning of a circular curve to the
right with a radius of 758.U6 feet; thence along
the arc of said curve, through a central angel of
55029'40", a distance of 734.22 feet; thence North
17038' West a distance of 166.60 feet to a point of
be~inning of a circular curve to the left with a
ra ius of 566.67 feet; thence along the arc of said
curve, through a central angle of 33015 '20", a dis-
tanoe of 328.90 feet; thence S. 780 -30' W. a distance
of 123.80 feet to a point on the southerly line of
said public road right-of-way; thence S. 16o-lU' W.

a distance of 986.31 feet to a point; thence S. 110
45' - 30" W. a distance of 77.48 feet to a point;
thence S. 070 -21' W. a distance of 222.17 feet to
a point on the southerly line of aforesaid Section
Eighteen; thence along said souther!y line N. 890
24' W. a distance of 1,320.12 feet to the point of
beginning.
Traot No. 2 I
The fO!lowing platted land for which an official plat
thereof has been filed in the office of the Gallatin
County Clerk and Recorder, referred to and known a8
the "Westridge Subdivision," as follows:
All of that oertain portion of the northerly half
of the Northwest Quarter of Section 19, Township 2
South, Range 6 East of the Montana Principal Meridian,
in the County of Gallatin, State of Montana, bounded
and described more partioularly as follows, to-wit:
Beginning at the Northwest corner of said Section
19; thence alon~ the northerly line of said Section
S 890 12' E. a Istance of 1320.13 feet to a point;
thence South a distance of 228.00 feet to a point;
thence N. 890 12' W. a distance of 109.58 feet to
a point; thence S. 260 59' 40" W. a distance of
259.29' to a point; thence S. 840 02' 30" E. a
distance of 133.52' to a point; thence South a
distance of 380.58' to a point on the southerly
line of aforesaid northerly half of the North-
west Quarter of said Section 19; thence N. 890 06'
W. along said southerly line to a point on the west-
erly line of said Section 19, a distance of 1225.46
feet; thence North along said westerly line a distance
of 1325.75 feet to the point of beginning;
The tract of land thus described containing an area
of 37.3 acres, excepting, however, therefrom that
oertain parcel of land described in that certain
deed to R. J. Rickabaugh and Alfreda M. Rickabaugh, I
husband and wife, which said deed is recorded on
page 438 of Book 129, deed records of the County
of Gallatin, State of Montana, said parcel of land
containing an area of 1.136 acres.
WHEREAS, it will be for the best interest of the City of Bozeman
and the inhabitants thereof and the inhabitants of said contiguous tracts
hereinbefore desoribed, to extend the boundaries of the City of Bozeman so
as to inolude said tracts hereinbefore described wi thin the corpora'te 11mi ts
of the said City of Bozeman; and
WHEREAS, the Clerk of the City Commission has, pursuant to the pro- -
visions of Section 11-403, Revised Codes of Montana, 1947, given the required
public notice of such proposed extension of the boundaries of the said CltJof
Bozeman; and
WHEREAS, TWENTY (20) DAYS have expired since the date of the first
publication of said notice and no written expressions of approval or disapproval
of the proposed extension of the boundaries of the said City of Bozeman have
been received from resident freeholders of the territory proposed to be embra-
ced in the City of Bozeman, Montana; and
WHEREAS, no land in the territory to be annexed is used for indus-
trial or manufacturing purposes,
NOW, THEREFORE, BE IT RESOLVED that pursuant to the authority vested
in the City Commission of the City of Bozeman, Montana, by Seotion 11-403,
Revised Codes of Montana, 194", IT IS HEREBY DECLARED that the boundaries of
the said City of Bozeman, Montana, shall be and the same hereby are extended
so as to embrace and include within the boundaries and corporate limits of
the said City of Bozeman, Montana, the contiguous tracts of land hereinbefore
described, and for whioh the Certificate of Survey and plat, respectively, I
have been filed, said Certificate of Survey being filed in the Office of the
County Clerk and Recorder of Gallatin County, Montana, on the 22nd day of May,
1962, and said Plat being filed in the Office of the County Clerk and Recorder
of Gailatin County, Montana, on the 16th day of June, 1962.
PASSED AND ADOPTED BY THE Commission of the Oi ty of Bozeman at a
regular session thereof held on the 27th day of June, 1962.
