A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZE-
WAN, DECLARING IT TO BE TO THE BEST INTEREST OF THE
CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF
I THE INHABITANTS OF A TRACT OF LA}ID CONTIGUOUS TO
TIffi SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY
DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY
OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT
WITHIN THE CORPORATE LIMITS THEREOF.
WHEREAS, there has been presented to the City Commission of the City of
Bozeman a written and verbal request petitioning the said City Commission to
extend the boundaries of the City of Bozeman so as to include within the
boundaries in the City of Bozeman lands which have been platted into lots,
blocks, streets and alleys and certain unplatted land that has been surveyed,
which considered togt)iber f()rm a tract contiguous to said City of Bozeman;
and
WHEREAS, there has been~resented to the City Commission of the City of
Bozeman a Certificate of Sur . of said unplatted land which has been filed
in the Office of the County Clerk and Recorder of Gal+atin County Montana,
on the 22nd day of May, 1962, and that, further, there has been a Plat pre-
sented to said City Commission entitled "WESTRIDGE, a Subdivision of a portion
of the Northerly one-half of the Northwest Quarter of Section Nineteen, Town-
ship Two South, Range Six East of the Montana Principal Medidian in the County
of Gallatin, State of Montana", which said Plat was duly filed in the Office
of the County Clerk and Recorder of Gallatin County, Montana on the .16th day
of June , 19 50. and

WHEREAS, the proper legal description of said contiguous tract is set
out in Exhibits 'A' and 'B' attached hereto, both of said tracts being consid-
ered together as one unit for the purpose of this Resobltion, both being atta-
ched hereto and incorporated herein by reference as if fully set forth in
haec verga; and
I WHEREAS, it will be for the best interests of the City of Bozeman and
the inhabitants thereof and the inhabitants of said contiguous tract of land
described in Exhibits 'A' and 'B' attached hereto, and hereinbefore described,
to extend the boundaries of the City of Bozeman so as to include said tract
hereinbefore described in Exhibits 'A' and 'B' within the corporate limits
of
the said City of Bozeman.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF BOZEMAN:
SECTION 1: That pursuant to the provisions of Section 11-403, Sub-sectional,
of the Revised Codes of Montana, 1947, it is hereby decLared to be to the best
interest of the City of Bozeman and the inhabitants thereof and of the inhabit-
ants of the contiguous tract of land described in Exhibits 'A' and 'B' attached
hereto for which a Plat and Certificate of Survey have been duly filed, that
the boundaries of the said City of Bozeman be extended so as to include the
said contiguous tract of platted and unplatted land hereinbefore described and
for which a Certificate of Survey has been filed in the Office of the County
Clerk and Recorder of Gallatin County, Montana, on the 22nd day of May, 1962,
and a Plat has been duly filed in the said Office of the said Count~ Clerk
and Recorder on the 16th day of June, 196u, within the boundaries and corp-
orate limits of the City of Bozeman, Montana.
PASSED AND ADOPTED by the City Commission of the City of Bozeman at a regu-
lar session held on the 31s t day of May, 1962.

COMMISSION RESOLUTION NO. 1040 OF THE CITY OF BOZEMAN
STATING THE INTENTION OF THE CITY COMMISSION TO EXTEND
~IE BOU1~ARIES OF SAID CITY OF BOZEMAN TO EMBRACE AND I
INCLUDE A CERTAIN TRACT OF LAND ADJOINING SAID CITY.
NOTICE IS HEREBY GIVEN that on the 31st day of May, 1962, at a regular.
meeting of the City Commission of the City of Bozeman, the said Commission
duly and regularly passed and adopted Commission Resolution No. 1.040 entitled:
"A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN
DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF
BOZEMAN AND THE INHABITANTS THEREOF AND OF ~IE INHABI-
TANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF
BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND
THE BOUNDARIES OF SAID CITY OF BOZEMAN SO AS TO INCLUDE
THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS
THEREOF".
NOTICE IS HEREBY FURTHER GIVEN that Wednesday, the 27th day of June, 1962,
at one o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana,
is designated as the time and place for hearing objections to the action pro-
posed to be taken in said Resolution No. 1040, whereby it is proposed to embrace
the hereinafter described contingent territories within the corporate limits of
the City of Bozeman, Montana. Expressions of approval or disapproval by resi.
dent freeholders of the territories proposed to be embraced must be made in
writing and filed with the Clerk of the City Commission of the City of Bozeman
not later than Twenty (20) days after the date of the first publication of this
Notice.
A description of the boundaries of the territories proposed to be embraced
by said Commission Resolution No. lU40 is as follows:
(1) The following umpLatted land for which a certificate I
of survey has been filed in the office of the County CLerk
and Recorder, Gallatin County, Montana:
Beginning at the Southwest corner of Section
Eighteen, Township Two South, Range Six East
of the Montana Principal Meridian; thence along
the Westerly Line of said Section Eighteen N.

point on the Southeasterly line of the 50.foot
right-of-way of the Chicago, Milwaukee, St.Paul
and Pacific Railroad Company; thence along said

a distance of 1,353.60 feet to the point of inter.

to Bozeman, Montana; thence along said southerly
line EAST a distance of 245.95 feet to the South.

The tract of land thus described containing an area
I of 37.3 acres, excepting, however,
therefrom tha t
certain parcel of land described in that certain
deed to R. J. Rickabaugh and Alfreda M. Rickabaugh,
husband and wife, which said deed is recorded on
page 438 of Book 129, deed records of the County of
Ga lla tin, State of Montana, said parcel of land
containing an area of 1.136 acres.
This Notice is given pursuant to the provisions of Section 11-403,
Revised Codes of Montana, 1947.

length in the Bozeman Daily Chronicle, a newspaper of

in the issued of June 4th, and June 11th.. 1962 inclusive,
and due proof of such publications is on file in my
office.
