Kukulski, City Manager SUBJECT: Appointment to the Library Board of Trustees MEETING DATE: July 27, 2009 AGENDA TYPE: Action RECOMMENDATION: Mayor Jacobson appoints one new member to the Library Board of Trustees, with the advice and consent of the Commission, for a term expiring June 30, 2014. BACKGROUND: One term on the Library Board of Trustees expired June 30, 2009. There are two new applicants for this position. The following statement was provided by Alice Meister on behalf of the board: The appointment for the Library Board was discussed (July 16th) at the Board meeting and the Trustees wish to recommend Donna Swarthout for the position. She was the first to apply and comes with glowing recommendations. Michael McCormick also had very good recommendations, but we're hoping he might consider the Foundation Board due to his financial expertise. Since First Security Bank President Ron Farmer is currently on the Library Board of Trustees, he has been our financial expert for many years along with support and help from Jacki McGuire, a CPA, who is a more recent addition to the Board. Thus Michael's financial expertise might be better utilized on the Foundation Board. The Library Board of Trustees is created under Section 22-1-308 of the Montana Code Annotated and Section 2.56.010 of the Bozeman Municipal Code. Under Section 2.56.010 of the B.M.C., the Board of Trustees of the Public Library shall be composed of five persons and shall be appointed by the Mayor, with the advice and consent of the Commission, and shall serve without pay. The trustees shall hold their office for the term of five years, and one trustee shall be appointed annually at the beginning of each fiscal year (July 1) for the term of five years, and until his/her successor is appointed and qualifies. Trustees shall serve no more than two full terms in succession. They shall have power to select librarians and other employees as they may determine and fix the amount of any bond which they may require to be given by the librarian and other employees. They shall have power to receive books from all sources for the use and benefit of the library and to purchase books therefore with any money available for that purpose and power to prescribe all rules and regulations for the use of books and the preservation of the same. The board shall keep a record of its transactions and shall make a report to the City Commission at the close of each calendar year, covering the business transacted by it during the year (Ordinance No. 1163, 1984; Ordinance No. 1094 S 1, 1982; prior code S 2.08.200). No residency requirements are contained in either the M.C.A. or the B.M.C. Under state statutes, this Board is administrative. The Library Board of Trustees has one vacancy and two applicants. As a private wealth manager I advise an influential collection of local residents. My term appointments on the Big Sky Youth Empowerment Board and Manley Meadows HOA Board are expiring this fall, and a position on this Board would allow me to continue to serve the community I love.
