Home My WebLink AboutResolution 1050 Extending Boundaries 113 COMMISSION RESOLUTION NO. 12.2Q A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE I PARTICULARLY DESCRIBED, WITHIN THE CORPORATE LIMITS THEREOF WHEREAS., there haa been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman so as to include certain conti- guous tracts of land within the boundaries of the City of Bozeman; and WHEREAS, the proper legal descril-tlons of sa.id contiguous tracts are as follows: Tract No. 1 The following unplatted land for which a Certificate of Survey has been filed in the office of the County Clerk and Recorder of Gallatin County, Montana, on August 22nd, 1962: Beginnin~ at the Northeast Corner of the Northwest Quarter NWt), Section 12, Township 2 South, Range 5 Ea s t , M. P . M. , thence along the North line of said Northwest Quarter of said Section 12, at a bearing of S. 89057'08" W. a distance of 1449.92 feet to the Southeast Corner of Homesites, a suburb of Bozeman, Montana; thence contimllng along the North line of the NWt of said Section la, at a bearing of S. 89052'38" W. a distance of 1233.17 feet to the Section corner common to Sections 1, 2, 11 and 12, all in Township 2 Sovthl Range 5 East; thence along the North line of the NEt1'E"4 of Section 11, at a bearing of S. 88010'47" W. a I distance of 1351.22 feet to the Northwest corner of said NEiNE! WHEREAS, the City Commission of the said City of Bozeman has, by its Reso- lution No. 1049, regularly passed and adopted on the 22nd day of August, A. D. 1962, declared it to be for the best interests of the said City ot Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts herelnbefore described that the boundaries ot the said City of Bozeman be extended 80 as to include said oontiguous tracts; and WHEREAS, The Clerk of the City Commission has, pursuant to the provisions of Section 11-403, Revised Codes of Montana, 1947, given the required notice to property owners and caused to be published the required public notice of such proposed extension of the boundaries of said City of Bozeman; and WHEREAS, twenty (2U) days have expired since the date of the first publi- cation of said notice; and WHEREAS, less than a majority of the resident freeholders of the territory to be embraced have tiled with the City Clerk written expressions of disapproval, to-wit, two (2) written protests, each signed by two (2) resident freeholders of said territory. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. That pursuant to the authority vested in the City Commission of I Bozeman by section 11-403, Revised Codes of Montana, 1947, it is hereby declared that the boundaries of the said City of Bozeman shall be extended so as to em- brace and include within the boundaries and corporate limits of the said City of Bozeman the tracts contiguous thereto and hereinbefore described. Section 2.
