HomeMy WebLinkAboutResolution 1049 Extend Boundaries 109 COMMISSION RESOLUTION NO. 1049 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE IN- I HABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF. WHEREAS, there has been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman so as to include certain conti- guous tracts of land within the boundaries of the City ot Bozeman and having presented to the City of Bozeman proposed plats and certificate of survey of said land; and WHEREAS, the proper legal description of said contiguous tracts 1s as follows: Tract No.1. The following unplatted land for which a Certificate of Survey has been filed in the office of the County Clerk and Recorder of Gallatin County, Montana, on August 22nd, 1962: Beglnni, at the Northeast Corner of the Northwest Quarter NWt), Section 12, Township 2 South, Range 5 East, M.P.M., thence along the North line of said Northwest Quarter of said Section 12. at a bearing of S. 89057'08" W. a distance of 1449.92 feet to the Southeast Corner of Homesites, a suburb of Bozeman. I Montana; thence continuing along the North line of the NW;' of said Section .12, at a bearing of S. 89052'38" W. a distance of 1233.17 feet to the section Corner Common to Sections 1. 2, 11 and 12, all in Township 2 South, Range 5 East; thence along the North line of the NEtNEt of Section 11, at a bearing of S. 88010'47" W. a distance of 1351.22 feet to the Northwest corner of said NEtNEt Section 11; thence in a southerly direction along the West line of the East Haif of the East Half of Section 11. WHEREAS, it will be for the best interest of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous traots hereinbefore described to extend the boundaries of the City of Bozeman eo as to include the said contiguous traots hereinbefore described within the corporate limits of the said City of Bozeman. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: See tion 1. That pursuant to the provisions of Section 11-403, Revised Codes of Montana, 1947, it is hereby declared to be to the best interest of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so aa to include the contiguous tracts hereinbefore described I within the boundaries and corporate limits of the City of Bozeman, Montana.
