A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO
CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPEC-
IAL IMPROVEMENT DISTRICT NO. 425 FOR THE PURPOSE OF CON-
STRUCTING AND INSTALLING AN OUTFALL SANI~ARY SEWER 'IDO I

WHEREAS, there has been filed with the Clerk of the City Commission of
the City of Bozeman, Montana, a petition in due form by the owners of the
Hillcrest Retirement Homes and adjacent residential area in said City, asking
that a special improvement district be created for the purpose of constructing
and installing an outfall sanitary sewer, for the construction of a sewerage
system to provide sanitary sewers for all lots within the district.
WHEREAS, tha tat a regular meeting of the Oi ty Commission of the C1 ty of
Bozeman held on the 11th day of April A. D., 1962, the aforesaid petition was
respectively considerea-and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to
create a special improvement district to be known and designated as Special
Improvement District No. 425 of the City of Bozeman for the purpose of construct-
ing and installing an outfall sanitary sewer, said project to include all appurt-
enant work, for the construction of a sewerage system to provide sanitary sewers
for all lots within the district.

Section 2
The boundaries of said Special Improvement District No. 425 are described
as follows:
Beginning at the Northeast Corner of Section 18, Township 2 3o~th,
Range 6 Eas t, M. P.M. ; thence in a westerly direction along the North
line of said Section 18, a distance of 1327.36 feet, more or less,
to the Northwest corner of the East half of the Northeast Quarter
(E!NEt> of said Section 18; thence in a southerly direction along
the West line of said East Half of the Northeast Quarter (EtNEt>,
a distance of 2,666.55 feet, more or less to the"Southweat corner
of said East Half of the Northeast Quarter (EtNEt>, said point be-
ing the Southwest corner of Vailey View Addition to the City of
Bozeman; thence in an easterly direction along the South line of
said Valley View Addition a distance of 331.5 feet to the East line
of Block 24 of said addition projected; thence in a northerly direc-
tion along the East line of Block 24, Block 17 and Block 14 of said
Valley View Addition to the Southwest corner of Block 6 of Highland
Addition to the City of Bozeman; thence in an easterly direction
along the South line of Highland Addition to the West line of Block
13, Valley View Addition; tnence in a southerly direction along the
" West line of Block 13, Block 18 and Block 23 and said line projected,
to the South line of said Vailey View Addition; thence in an east-
erly direction along the South line of Valley View Addition to the
East Quarter Corner of said Section 18, Township 2 South, Range 6
East; thence continuing in an easterly direction along the South
line of Central Addition to the City of Bozeman, a distance of
1332.4 feet, more or less to the Southeast corner of the West half
of the Northwest Quarter (s!NWi> of Section 17, Township 2 South, I
Range 6 East; thence in a northerly direction along the East line
of central Addition, a distance of 2655.25 feet, more or less to
the Northeast corner of said addition, the same being the Northeast
corner of the West Half of the Northwest Quarter (WtNWt) of Section
17; thence continuing North along the East line of Drum Lummon addi-
tion a distance of 264 feet to the ~orth line of Fort Ellis Street;
thence in an easterly direction at a bearing of North 79007' East,
a distance of 748.0 feet; thence at a bearing of North 87018' East,
a distance of 617.7 feet, more or less, to the East line of the
Southwest Quarter (swi> of Section 8, Township 2 South, Range 6 East;

thence North along said East line of said Southwest Quarter (SWl)
a distance of 427.0 feet; thence North 52031' West, a distance of
279.7 feet; thence North 51023' West, a distance of 466.0 feet, to
a point on the South line of Granite Addition, said point being
586 feet West of the Southeast Corner of said Addition; thence in
an easterly direction along the South line of said Granite Addition,
a distance of 261.0 feet to the centerline of the North-South alley
in Block 19 of said Granite Addition; thence in a northerly direc-
I tion along the centerline of said Block 19, Block 12, and Block 9
of said addition to a point of intersection with the southerly
Right-of-Way of U. S. Highway No. 10; thence North 67019' West along
said southerly Right-of-Way a distance of 1578.23 feet, to a point
of intersection with the East line of Switzler Avenue as platted in
Marwyn, a rearrangement of portions of Northern Pacific Addition;
thence in a southwesterly direction along the easterly line of said
Switzler Avenue a distance of 116.97 feet; thence South along the
easterly line of said Switzler Avenue and continuing along the East
line of Lot 6, Block C, Marwyn a distance of 510 feet, more or less
to the South line of Marwyn; thence in a wester~y direction alont
the South line of Marwyn a distance of 542.65 feet to a point on
the southerly line of East Curtiss Street; thence along a curve to
the rIght, having a radius of 345 feet a distance of 206.54 feet;
thence in a westerly direction along the South line of East Curtiss
Street a distance of 131.62 feet to a point on the East line of Golf
Way; thence in a southerly direction at a bearing of South 19030'
East a distance of 620 feet; thence South a distance of 1332.0 feet,
more or less to a point on the South line of Section H, Township
2 South, Range 6 East; thence West a distance of 60 feet to the point
of beginning.
Section 3
Character of Improvements
Construction and installation of an outfall sanitary sewer, said project
to include all appurtenant work for the construction of a sewerage system to
provide sanitary sewers for all lots within the district, including pipe lines,
manholes and other necessary appurtenances.

Es tima te of Cos t
The preliminary estimate of cost is $81,454.38, including all trench
excavation and backfiLl, all materials, installation costs, engineering and
incidentaLs.
Section 5
Method of Assessment
The preliminary estimate of cost as set forth above will be assessed on
an actual area basis.
Section 6
Actual Area of District
The actual area of the district as described is 253.32 acres, and pro-
tests will be considered on an actual area baaia.
Section 7
Payments
That payments for said improvements shall be made in twenty (20) annual
installments extending over a period of nineteen (19) years, but this shall not
be construed to prevent payment in full at any regular payment date by any pro-
perty owner who desires to do so. It is proposed to pay the entire cost and
expense of the construction and insta~lation of said improvements with cash to
be obtained from the sale of bonds of said Special Improvement District No. 425,
I as authorized by law. Such bonds will be in denominations of $lOu.UO each, and
fractions or multiples of $100.UO where necessary, to be issued and chargeable
sgainst a fund to be known and designated as Special Improvement District No. 425
Fund of the City of Bozeman. Tne bonds wil~ be redeemable at the option of the
City, singly or in multiples, and in the order of their registration, whenever
funds are available for the purpose in said Special Improvement District No. 425.
Said bonds shall draw a simple interest from the date of their registration until
called for payment, at a rate not to exceed six percent (6%) per annum, which
interest shall be chargeable 8S a part of the cost of construction and install-
ation of said improvements. The bonds will be issued and sold in accordance with
the provisions of Section 11-2232 and Section 11-22'11, Revised Codes of Montana,
1947, and all other applicable provisions of Tit~e 11 of the Revised Codes of
Mon tana , 1947, relating to special improvement districts in cities and towns, and
any amendments thereof or thereto.

Section 8
Protests and Notice
That the regular session of the City Commission of the City of Bozeman,
to be held at the Commission Chamber, City Hall Building, Bozeman; Montana, on
Wednesday, the 8th day of Au~ust, A. D. 1962, at the hour of one o'clock p.m.
of said day, 1s the time and p ace, when and where the City Commission will hear
and pass upon all protests duly and regularly made and filed against the creation I
of said proposed Special Improvement District No. 425, the improvements proposed
to be made pursuant thereto and the extent and character thereof, or either
thereof; and the Clerk of the City CommissIon be, and he is hereby directed to
give notice in the manner and for the time as by law required, of the adoption
of this Resolution of Intention.
Adopted by the Commission of the City of Bozeman, Montana, at a regular
and stated session of said Commission held on the 18th day of July, 1962.

Notice 1s hereby given that on the 18th day of July A. D., 1962, at
a regular session of the Commission of the City of Bozeman, Commission Resolution
No. 1044 entitled:

was passed and adopted.
That Wednesday, the 8th day of August A.D. 1962, at One
o'clock p.m. at the Commission Room of the City HaLL, Bozeman, Montana, is
designated by Resolution No. 1044 as the time and place for hearing objections
to the action proposed to be taken by said resolution and when and where any and
all persons whose property 1s within said proposed Special Improvement District
No. 425, may appear and show cause, if any they have, against said proposed I
improvements. Objections must be made in writing and fiLed with the Clerk of
the City Commission not later than fifteen (15) days after date of the first
publication of this Notice.
An approximate preliminary estimate of the cost of doing such work and
making such improvements within said District, including all trench excavation
and backfi~l, all materials, installation coats, engineering and incidentals,
which is to be specially assessed against the property within said District is
$81,454.38. Costs of the project will be assessed on an actual area basis.
The total actual area of the property within said proposed district is 253.32
acres. Payment for the improvements is to be made in twenty (20) annual install-
ments over a period of nineteen (19) years with interest on the deferred payments

be construed to prevent payment in full at any regular payment date by any pro-
perty owner.
For a description of the boundaries of said Special Improvement Distriot
No. 425, reference is hereby made to Resolution No. 1044 of the Commission of
the City of Bozeman declaring the intention to create said District, which is on
I file in the office of the undersigned Clerk of said Commission in the City Hall
of said City of Bozeman, State of Montana, and open for inspection to all inter-
ested persons and the public generally.
This notice is given pursuant to the provisions of Section 11-2204,
Revised Codes of Montana, 1947.
