A RESOLUTION OF THE CITY COl~ISSION OF THE CITY OF BOZEMAN
DECLARING IT TO BE ~iE INTENTION OF THE CITY OF BOZEMAN TO I
CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS
SPECIAL IM~ROVEMENT DISTRICT NO. 427 OF THE CITY OF BOZEMAN
FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT
PROJECT ON NORTH TENTH AVENUE FROM BEALL STREET TO DURSTON
ROAD. SAID PAVEMENT PROJECT TO INCLUDE CONSTRUCTION AND
INSTALLATION OF A STORM SEWER LINE, COMBINATION CONCRETE
CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL
CUSHION COURSE, AND BITUMINOUS SURFACE COURSE.
WHEREAS, there has been filed with the Clerk of the City Commission
of the City of Bozeman, Montana, a petition in due form of certain owners
of properties situated on North Tenth Avenue from Beail Street to Durston
Road, asking that a speciai improvement district be created for the purpose
of constructing and ins tailing a pavement project to include the construc-
tion and installation of a storm sewer line, combination concrete curbs and
gutters, gravel base course, crushed gravel cushion course, bituminous sur-
face course, and other work incidental thereto; and
WHEREAS, at a regular meeting of the City Commission of the City of
Bozeman held on the 6th day of March, 1963, the aforesaid petition was
respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN:
Section I
Declaration of Intention
I
That it is hereby declared to be the intention of the City of Bozeman
to create a special improvement district to be known and designated as Spec-
jal Improvement District No. 427 of the City of Bozeman for the purpose of
constructing and installing a pavement project on North Tenth Avenue from
Beail Street to Durston Road, Bozeman, Montana. Said pavement project to
include construction and installation of a storm sewer line, combination
concrete curbs and gutters, gravel base course, crushed gravel cushion course,
and bituminous surface course, and other work incidental thereto.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 427 are
described as follows:
Beginning on the centerline of North Tenth Avenue opposite
the South line of West Beall Street; thence westerly
to the East line of the alley between North Tenth Avenue
and North Eleventh Avenue; thence northerly along the
East line of said alley to the south line of Durston
Road; thence easterly along the south line of Durston
Road to the West line of the ailey between North Tenth
Avenue and North Ninth Avenue; thence southerly along
the West line of said alley to the North line of West
Villard Street; thence southerly to a point on the south
line of West Villa!dStreet common to Lots I and 4 of
Block 5 of Brunton Palffy Rearrangement of Durston Sub-
division; thence southeriy to a point being the south-
east corner of Lot 3 and the Southwest corner Lot 7 of
said subdivision; thence southerly 150 feet East of and I
parallel to the East line of North Tenth Avenue to a
point on the South line of West Beall Street; thence
westerly along the South line of West Beall Street to
the point of beginning.
Section 3
Character of Improvements
Construction of a pavement project on Nortn Tentn Avenue from Beall
Street to Durston Road, Bozeman, Montana, said pavement project to include
construction and installation of a storm sewer line, combination concrete

curbs and gutters, gravel base course, crushed gravel cushion course, and
bituminous surface course.
Section 4
Es tima te of Cos t
The preliminary estimate of cost is $35,3UO.uO, including ail street
I exoa va tion, all ma terials, ins talla tion oos ts and engineering and incidentals.
Sec tion 5
Method of Assessment
The cost of such improvements is to be assessed against the entire district,
each lot or parcel of land within such district bordering or abutting on street
or streets whereon or wherein the improvement or improvements have been made, to
be assessed for its part of the whole cost in proportion to the lineal feet
abutting or bordering same.
Section 6
That payments for said improvements shall be made in twenty (20) annual
installments extending over a period of nineteen (19) years, but this shall
not be construed to prevent payment in full at any regular payment date by
any propert..,. ('wner who desires to do so. It is proposed to pay the entire
cost and expense of the construction and installation of said improvements
with cash to be obtained from the sale of bonds of Baid Speoial Improve-
ment District No. 427, as authorized by law. Such bonds will be in denomin-
ations of $100.00 each and fractions or multiples of $100.00 where necessary,
to be issued and chargeable against a fund to be known and designated as
Special Improvement District No. 42'/ Fund of the City of Bozeman. The bonds
will be redeemabie at the option of the City, singly or in multipies, and in
the order of their registration, Whenever funds are availabie for that pur-
pose in said Special Improvement District No. 427. Said bonds will draw simple
interest from the date of their registration until called for payment, at a
rate not to exceed six per cent (6%) per annum, which interest shall be
chargeable as a part of the cost of construction and installation of said
improvement. The bonds will be issued and sold in accordance with the pro-
visions of Section 11-2232 and Section 11-2271, Revised Codes of Montana,
I 1947, and all other applicable provisions of Title 11 of the Revised Codes
of Montana, 1947, relating to speciai improvement districts in cities and
towns and any amendments thereof or thereto.
Section 7
Protests and Notioe
That the regular session of the City Commission of the City of Bozeman,
to be held at the Commission Chamber, City Hall Building, Bozeman, Montana,
on Wednesday, the 27 day of March, A.D. 1963, at the hour of one o'clock p.m.
of said day, is the-time and place, when and where the City Commission will
hear and pass upon all protests duly and regularly made and fiied against
the creation of said proposed Special Improvement District No. 427, the
improvement proposed to be made pursuant thereto and the extent and character
thereof, and the Clerk of the City Commission be, and he is hereby directed
to give notice in the manner and for the time as by law required, of the
adoption of this resolution ("f intention.

Notice 1s hereby given that on the 6th day of March, A. D. 1963, at I

was passed and adopted.
That Wednesday, the 27th day of March A. D., 1963,
at one o'clock p.m., at the Commission Room of the City Hall, Bozeman,
Montana, is designated by Resolution No. lu65 as the time and place for hear-
ing objections to the action proposed to be taken by said resolution, when
and where all persons whose property is within said proposed Special Improve-
ment District No. 427 on North Tenth Avenue from Beall Street to Durston Road,
may appear and show cause, if any they have, against said proposed improve-
ment. Objections must be made in writing and filed with the Clerk of the City
Commission not later than fifteen (~5) days after date of the first publication
of this no tice .
An approximate preliminary estimate of the cost of doing such work and
making such improvements within said district, including all street excavation,
all materials, installation costs, engineering and incidentals, wnich is to be
specially assessed against the property within said district is $35,300.UO.
Costs of the project will be assessed against the entire district, each lot I
or parcel of land within such district bordering or abutting on street or
streets whereon or wherein the improvement. or improvements have been made, to
be assessed for its part of the whole cost in proportion to the lineal feet
abutting or bordering same. Payment for the ~provements is to be made in twenty
(20) equal annuai installments.
For a description of the boundaries of said Special Improvement District
No. 427, reference is hereby made to Resolution No. 1065 of the Commission of
the City of Bozeman declaring the intention to create said District, which 1s
on file in the office of the undersigned Clerk of said Commission in the City
'- Hall ofs:ald Ci ty of Bozeman, Sta te of Montana, and open for inspec tion to
all interested parties and the public generally.
