COMMISSION RESOLUTION NO. ~
A RESOLUTION OF THE COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, AUTHORIZING THE MAYOR AND
CLERK OF THE CITY COMMISSION TO EXECUTE A QUIT I
CLAIM DEED TO ALL OF THAT VACATED PORTION OF
SOUTH TRACY A VENUE LYING WEST OF AND ADJACENT
TO BLOCK TWO OF THE UNIVERSITY SUBDIVISION IN
THE CITY OF BOZEMAN, MONTANA, ACCORDING TO THE
OFFICIAL PLAT THEREOF ON FILE AND OF RECORD IN
THE OFFICE OF THE CLERK AND RECORDER OF GALLATIN
COUNTY, MONTANA.
WHEREAS, on the 31st day of October, 1962, at its regular meeting, the
City Commission of the City of Bozeman, Montana, passed and adopted Commis-
sion Resolution No. 1057 declaring it to be the intention of the said City
of Bozeman to vacate all of that portion of South Tracy Avenue from the
South line of East Garfield Street to the South iine of the University Sub-
division in the City of Bozeman, Montana, and d~recting the City Manager of
the City of Bozeman to give notice thereof in the manner and for the time
as provided by law; and
WHEREAS, pursuant to said Resolution, notice of the adoption of said
Resolution was published in the Bozeman Daily ~hronicle at least once befure
said Resolution was acted upon, as appears by the affidavit of the publisner
of said Bozeman Daily Chronicle on file with the Clerk of the City Commission
and which said notice describes the streets to be vacated and giving notice
that the hearing on said Resolution would be held at the regular meeting of
the City Commission to be held on the 7th day of November, 1962, at 1:00
o'clook p.m., at the Commission Room in the City Hail Building of the City
of Bozeman; and
WHEREAS, on November 7, 1962, The City Commission in reguLar session
assembled, did then and there determine that ail of tnat portion of South I
Tracy Avenue from the South line of East Garfield Street to the South line
of the University Subdivision in the City of Bozeman, .Montana, should be
vacated and such determination was entered upon the minutes of said meeting,
and did then and there determine and decide that such vacation could be made
wi thou t detriment to the public interes t and should be made in the public
interest, all aocording to Ordinance No. 838, passed and adopted at a regu-
lar meeting of the City Commission of the City of Bozeman held on the 7th
day of November, 1962.
NOW, THEREFORE, BE IT RESOLVED BY THE CuMMISSION OF THE
CITY OF BOZEMAN AS FOLLOWS:
That the Mayor of the City of Bozeman, Fred M. Staudaher, and the Clerk
of the City Commission, C. K. WiLson, be and they are hereby authorized for
and on behalf of the City of Bozeman, to make, execute and deliver a Quite
Claim Deed to McKinley ,T. Anderson, Jr., Douglas R. Drysdaie, Ralph K. Aaker,
Henry G. Edwards and Thompson Hereford Ranches, Inc., all of Bozeman, Montana,

releasing and quit claiming to them all right, titLe, estate ~nd interest
of said City in and to the following described real property situate in the
City of Bozeman, County of Gallatin, State of Mon~ana, to-wi t:
All of that portion of vacated South Tracy Avenue
lying West of and adjacent to Block Two (2) of the
University Subdivision in the City of Bozeman,
Montana, according to the official plat thereof
on file and of record in the offioe of the Clerk
and Recorder of Gallatin ~ounty, Montana.

Dated this 12th day of December, 1962.
I PASSED AND ADOPTED by the City Commission at its regular meeting held
on the 12th day of December, 1962.
