Home My WebLink AboutResolution 1055 Defray cost of construction of sidewalks 1.29 COWAISSION RESOLUTION NO. 1055 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY I OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUC'l'ING AND INSTALLING AND/OR REPAIRING MISCEL- LANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1962. WHEREAS, the Commission of The City of Bozeman, pursuant to the provisions of Chapter 9.36 of the Bozeman Municipal Code and of Section 11-2226, Political Code, R.D.M., !947, provide tor the construction of sidewalks and curbs in the City of Bozeman during the year !962, without the formation of a Special Improve- ment District, WHEREAS, proceedings were had for the construction and installation and/or repair of Miscellaneous Sidewalks and Curbs in the City of Bozeman for the year 1962, and WHEREAS, miscellaneous Sidewalks and Curbs were construoted and installed . and/or repaired bordering on various properties in the City ot Bozeman, pur- suant to Chapter 9.36 of the Bozeman MUnicipal Code and the provisions of Section 11-2226, Political Code, R.C.M., 1947, which are hereby referred to and made a part of this Resolution, and WHEREAS, the said Miscellaneous Sidewalks and Curbs have been constructed I and oompleted and/or repaired in accordanoe with the terms and conditions of said prooeedings, and the City Engineer haa duly certified to the Commission a Schedule showing the sidewalks and curbs which have been oonstructed and instal- led and/or repaired, and the properties which are subjeot to assessment thereunder and the total cost of said construotion and installation and/or repairing is the sum of Four hundred ninety-two & 13/l00ths ($492.13) dollars. which sched- ule, marked "A", is hereto attached and made a part hereof. NOW, THEREFORE, Pursuant to the provisions of Chapter 9.36 of the Bozeman Munioipal Code and Section 11-2226, Political Code, R.C.M., 1947, as aforesaid, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section J.. That to defray the oost of constructing and instaJ.ling and/or repairing Miscellaneous Sidewalks and Curbs as set forth in Schedule "A", hereto attached and made a part hereof, there is hereby levied and assessed a tax amounting to the sum of Four hundred ninety-two & l3/luOths dollars (f492 .13) . I Sec tion 2. That a particular description of eaoh lot and parcel of land with the name of the owner and the sum assessed against him or it for suoh con- struotion and instalJ.ation and/or repair and the amount of each payment to be made and the day when the same shall become delinquent is set forth in the assess. ment list hereto attached marked Sohedule "A" and made a part hereof; that the --... - -.- 130 several sums set opposite the name of the owner and the descri.ptlon of the lots and parcels of land be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to defray the cost and expense of construct- ing and installing and/or repairing said Sidewalks and Curbs; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list as required by law; tha t the pa ymen ; I of said sums shaLL be made in six instaLlments; that the payment of said install- ments shall be made on or before the 3Uth day of November of each year until payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of Special Improvement taxes; tha t failure to pay suCh assessments when the same shall became due and payable shall make such persons and said lots and parcels of Land liable to the penalties provided by law relative to delinquent taxes. Sec tion 3. That the regular session of the Commission of the City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 3rd da y of October, 1962, at l:UO o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this resolution will be heard by said Commission. Section 4. That the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a I daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and Assessing a special assessment of taxes to defray the oost and expense of con- structing and installing and/or repairing Sidewalks and Curbs in the City of Bozeman for the year 1962 1s on file in the offioe of the CLerk of the Commis- sion subject to inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this ReSolution; that it shall be published at least five (5) days before the date set by the Commission for the hearing of objections and the final adoption of this Resolution. NOTICE IS HEREBY GIVEN, that during a regular session of the Commission of the City of Bozeman held on Wednesday, the 17t11 day of September, 1962, CODm1is- I sion Resolution No. 1055 was provisionally passed and adopted; that said Commis- - sian Resolution levies and assesses a special assessment of taxes upon certain lots and parcels of land in front, or on the side of whIch, sidewalks and curbs have been constructed and/or repaired pursuant to the provisions of Chapter 9.36 of the Bozeman Municipal Code and ot Section 11-2226, Political Code, R.C.M., 1947, to defray the cost and expense of constructing and installing and/or repair- ing said Sidewalks and Curbs. That said Commission Resolution is now on file in the office of the Clerk of the Commission, subject to inspection for a period ot five (5) days by any persons interested. That Wednesday the 3rd day of Ootober, 1962, at 1:00 o'olook P.M. ot said day, at the regular session of the said Commission of the City of Bozeman at the Commission Chamber, City Hall Building ot said City, has been designated as the time and planoe when and where the said Commission will hear and pass upon any and all objeotions that may be made to the final passage and adoption of said Resolu tibn No. .!222 and the levying of said assessment, and tba t said Resolution will be finally passed and adopted at said regular session. All persons 1nterested are referred to said Chapter 9.36 of the Bozeman Municipal Code, and the Commissioners' proceedings for the construction and/or repair of Misoellaneous Sidewalks and Curbs, in front ot or on the side of lots and parcels of land wi thin the Ci ty ot Bozeman for the year 1962 wi thout the formation of a Speoial Improvement District.
