HomeMy WebLinkAboutResolution 1053 Street Sprinkling District :123 COMMISSION RESOLUfION NO. 1053 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WI'I'HIN SAID STREET SPRINKLING DISTRICTS OF THE I CITY OF BOZEMAN FOR THE YEAR 1962. WHEREAS, The City Council and the Commission of the City of Bozeman have heretofore duly and regularly passed Council and Commission Resolutions creating Street Sprinkling Districts within the City of Bozeman and defining the boundaries thereof and providing for the assessment of the cost of sprinkling the same as set forth in Resolutions hereinafter referred to; and WHEREAS, the streets within the boundaries of said Street Sprinkling Dist- ricts have been sprinkled during the year 1962, as contemplated in said Resolutions, in accordance with the terms and conditions thereof; and WHEREAS, the Street Sprinkling Districts and the Resolutions creating the same, the total frontage of the property within said district to be assessed, the total cost of said sprinkling within said districts and the proportion thereof chargeable to the property therein is hereinafter set forth. NOW THEREFORE, pursuant to the provisions of Sections 11-2263 to 11-2267 inclusive, R.C .M., 1947', the Bozeman Municipal Code and said Council and Commis- - sion Resolutions creating said Street Sprinkling Districts: BE IT RESOLVED AND 1'1' IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That for the year 1962, the City of Bozeman has waived the sprinkling assessments of all Street Sprinkling Districts except Street Sprinkling Districts No's. 1 2 3 and 4; that for the year 1962, the City of Bozeman defrayed the cost $6,295.84 of sprinkling streets in the several street sprinkling districts pursuant to Resolutions creating the same, and seventy-five percent of the entire cost thereof $4,721.90 exclusive of the cost of sprink~ing parks and public places, the total number of linear feet of property to be assessed, and the rate per lin- I ear foot, is as follows: ~rinklin~ District No.1, created by Council Resolution No. 424t, Main reet be ween Wallace and Fourth Avenues and Bozeman, Grand, Willson, Tracy, Black and Rouse Avenues one-half (~) block each side of Main Street, a total frontage of 9,355.9 feet, the sum of ~354.22, being 75% of the entire amountj or at an approximate rate per ront foot or side street frontage of 0.251629453. Sprinkling District No.2, created by Councii Resolution No. 955, Babcock Street from east property line of south Rouse Ave. to the west property line of south Fourth Ave., including one-half (t) block on Rouse, Bozeman, B~ack, Tracy, Willson & Grand Avenues north from Babcock Street, Willson Ave. from Babcock Street to south property line of Olive Street and Third Ave., between Bab~ cock and Main Street, a total frontage of 7,221.2 feet, the sum of !Pl,O'/6.63, being '75% of the entire amount, or at an approximate reate per front foot of main or side street frontage of jO.149U92948. sprinkli~ District NO.3, created by ~ouncil Resolution No. 996, Mendenha Street from the east property line of North Rouse Avenue to the west property line of North Third Avenue including one-half (t) block on Rouse, Bozeman, Black, Tracy, Willson and Grand Avenues south from Mendenhall Street and North Third Avenue between Mendenhall Street and Main Street, a total frontage of 6,9359.58, the sum of $868.29, being 75% of the entire amount, or at an approximate rate per front foot of main or side street frontage of ~O.1365326Ul. Sprinkling District No.4, created by Council Resolution No. 997, West Main Street from the west property line of vacated Fourth I Avenue to the west property line of South Eighth Avenue, a total frontage of 2,66~.IO feet, the sum of $422.76, being 75% of the entire amount, or at an approximate rate per front foot of main or side street frontage of $0.158872604. Section 2. That to defray seventy-five percent of the cost of sprinkling streets within said street sprinkling districts for the year 1962, there be, and there is hereby levied and assessed a tax, up on all property in front of and bordering on said street sprinkling districts as set forth in Schedule One (1) hereto attached and made a part hereof; that a part1cular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it, is set forth in the assessment lists hereto attached, marked Schedule One (1) and made a part hereof; that the several sums set opposite the ---- --- 1.2tl names of the owners, and the described lots and parcels of land be, and the same are hereby levied and assessed upon and against said lots and parcels of land; that the several sums be collected from the respective owners of said lots and parcels of land described in the said assessment lists, Schedule One 1 , as requ jred by law; tha t said sums shall be paid and the collec tion thereo shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the same shall become due and payable shall make such persons and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. I Section 3. That the regular session of the Commission of the Cit~ of Boze- man to be held on the 3rd day of October, 1962, at the Commission hamber, City Hall Building, be,-and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper print- ed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission, and stating that a Resolution levying a special assessment of taxes to defray seventy-five per cent of the cost of sprinkling streets in the said Street Sprinkling Districts for the year 1962, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that is shall be published at least five days before the date set by the Commission for hear- ing objections, and the final adoption of this Resolution. NOTICE .....---.....-- HEARING FINAL ADOPTION COMMISSION RESOLUTION NO. 1053 LEVYING ASSESSMENT OF SEVENTY-FIVE PERCENT OF COS~ SPRINKLING STREETS, STREET SPRINKLING DISTRICTS FOR THE YEAR 1962. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 26th day of September, 1962, Commission Resolution No. 1053 was duly passed and adopted; that said Commission Resolution No. 1053 levies and assesses a special assessment of taxes upon all the pro- perty in Street Sprinkling Districts of said City to defray seventy-five per- I cent of the cost of sprink.ling streets within said Street sprinkling Districts for the year 1962. That said Street Sprinkling Districts, and the Resolution creating the same and the amount of the assessments are as follows: 1, created by Resolution 354.22 . Street S No.3, created by Resolution Now. 996, b68.29 . ~ ------- ".--. - :125 Street S District No.4, created by Resolution No. 997, amount of 4 2.76 That said Resolution No. 1053 is now on fiie in the office of the Cierk of the Commission of said City of~eman subject to inspection of all persons interested for a period of five days; that Wednesday, the 3rd day of October, 1962, at 1:00 o'clock P.M. of said day at a regular session of the Commission of The City of Bozeman, Commission Room, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any I and all objections that may be made to the final adoption of said Commission Resolution No. 1U53, and the levying of said assessments; and that said Resolution will be finally passed and adopted at said regular session of said Commission, subject to such corrections and amendments as may be made upon objections made and filed within five days limit as provided by law.
