ROYAL VISTA ADDITION TO THE CITY OF BOZEMAN TO POINTS OF
INTERS.ECTION WITH EXISTING SANITARY SEWERS AND SEPTIC
SYSTEMS WITHIN THE CONFINES OF MONTANA STATE COLLEGE, SAID
SANITARY SEWER PROJECT TO INCLlIDE ALL APPlffiTENANT WORK,
INCLlIDING NECESSARY PIPE LINES, MANHOLES AND OTHER NECESSARY
APPURTENANCES.
WHEREAS, there has been filed with the Clerk of the City Commission of the
City of Bozeman, Montana, a petition in due form of certain owners of properties
situated on the streets hereinafter specified, asking that a special improve-
ment district be created for the purpose of constructing and installing an out-
fall sewer to provide sanitary sewers for all lots within the district.
WHEREAS, that at a regular mee~ing of the City Commission of the City of
Bozeman held on the 5th day of June, 1963, the aforesaid petition was respect-
ively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY C OMNfISSION OF' THE CITY OF
BOZEl'iTAN:

Declaration of Intention
That it is hereby decLared to be the intention of the City of Bozeman to
create a special improvement district to be known and designated as Special
I Improvement District No. 432 of the City of Bozeman for the purpose of constr-
ucting and installing an outfall sewer, said project to include all appurten-
and work, for the construction of a sewera ge system to provide sanitary sewers
for all lots within the district.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 432 are described

Beginning at the Northeast corner of Section 11, T 2 S,
R 5 E, M.P.M., thence in a westerly direction along the
north line of said Section 11 at a bearing of S 88001'47"
W a distance of 1,351.22 feet more or less, to the
northwest corner of the NEiNEt of said Section 11; thence
in a southerly direction along the west line of the EtEi
of said Section 11, a distance of 4,942.76 feet to a point
on the north line of Mountain Vista Sub-division as
platted and of record in the County Clerk and Recorder's
Office, Gallatin County, Montana; thence in an easterly
direction along the north line of said Mountain Vista
Sub-diviflion to the weRt line of South 20th Avenue as
p1a:tted and of record in Kirk Sub-division, Gallatin
County, Montana; thence in a northerly direction along
the west line of said South 20th Avenue to a point 100.2
feet north of the north line of West Dickerson Street
as platted in Kirk Sub-division; thence in an easterly
direction 100.2 feet north of and parallel to the north
line of said West Dickerson Street to the east line of
I Section 11; thence in a soutnerly direction along the
east line of Section 11 to the centerline of West College
Street, also known as Huffine Lane and being the south
line of Section 11; thence in a westerly direction along
the north line of Section 14, a distance of 717.72 feet;
thence in a southerly direction 802.72 feet from and
parallel to the east line of Section 14 to a point on the
south line of the NEt, Section 14; thence in an easterly
direction along the south line of the NEt, Section 14,
and the south line of the NWt, Section 13 to a point
on the east line of the wi, Section 13; thence in.a
northerly direction along the east line of the mvt,
Section 13 to a point on the north line of Section 13;

the NWt of said Section 12 to the North Quarter Corner
of said Section 12; thence in a westerly direction along
the north line of the Nwi of said Section 12, said line
being the centerline of Durston Road, to the centerline
of North 17th Avenue; thence in a norther.LY direction
along the centerline of North 17th Avenue a distance of
761.6 feet, more or less, to a point opposite the south
line of Lot 12, Homesites, a suburb of Bozeman, ~ontana,
as platted and of record; thence in an easterly dir-
ection along the south line of' said Lot 12, a dis tance
of 570.2 fee t to the southeast corner of said Lot 12;
thence in a northerly direction along the east line of
said Lot 12 and continuing along the east line of Lots
14 and 16, a distance of 360 feet, to the northeast
corner of Lot 16 of said Homesltes; thence in a westerly
direction along the north line of Lot 16 and continuing
along the north line of Lot 15 of said Homesites to the
centerline of North 19th Avenue as platted and of record;
thence in a southerly direction along the centerline of
North 19th Avenue to the pOint of beginning.
Section 3
Character of Improvements
Construction of an outfall sanitary sewer ranging in size from 8" to
18" and extending from an existing manhole in Block 3, Royal Vista Addition to
the City of Bozeman to a point of intersection with an existing sanitary sewer
line on South 11th Avenue at West Garfield Street and also a line to replace
the existing sanitary septic system lying north of and serving the State of I
Montana Veterinary Research Station, said sanitary sewer project to include
necessary pipe lines, manholes and other necessary appurtenances.
Section 4
Es time te of Cos t
Preliminary estimate of cost for this project is $244,145.29, including
all trench excavation and backfii1, all materials, installation costs, engineer-
and incidentals.

Section 5
Method of Assessment
The actual area of the district as described is approximately 562.10 acres
and protests will be considered on an actual area basis.
Section 6
I Payments
The payments for said improvements shall be made in twenty (20) annual
installments extending over a period of nineteen (19) years" but this shall
not be construed to prevent pa~~ent in full at any regular payment date by any
property owner who desires to do so. It is proposed to pay the entire cost
and expense of the construotion and insta~lation of said improvements with
cash to be obtained from the sale of bonds of said Special Improvement Dist-
rict No. 432" as authorized by law. Such bonds will be in denominations of
$100.00 each" and fractions or multiples of $10U.00 where necessary" to be
issued and chargeable against a fund to be known and designated as Special
Improvement District No. 432 Fund of the City of Bozeman. The bonds will be
redeemable at the option of the City" singly or in multiples" and in the order
of their registration, whenever funds are available for the purpose in said
Special Improvement District No. 42. Said bonds shall draw a simple interest
from the date of their registration until called for payment, at a rate not
to exceed six percent (6%) per annum, which interest shall be chargeable as
part of the cost of construction and installation of said improvements. The
bonds will be issued and sold in accordance with the provisions of Section
11-2232 and Section 11-2271, Revised Codes of Montana" 1947" and all other
applicable provisions of Title 11 of the Revised Codes of Montana" 1947"
relating to special improvement districts in cities and towns, and any
a.mendments thereof or thereto.
Section 7
Protests and Notice
That the regular session of the City Commission of the City of Bozeman,
to be held at the Commission Chamber" City Hall Building" Bozema.n, Montana" on
Wednesday, the 26th day of June, A. K. 1963, at the hour of one o'clock p.m.
I of said day, is the time and place, when and where the City Commission will
hear and pass upon all protests duly and regularly made and filed against the
creation of said proposed Special Improvement District No. 432" the improve-
ments proposed to be made pursuant thereto and the extent and character thereof"
or either thereof; and the Clerk of the City Commission be" and he is hereby
directed to give notice in the manner and for the time as by law required, of
the adoption of this Resolution of Intention.
Adopted by the Commission of the City of Bozeman, Montana" at a regular
and stated session of said Commission held on the ~ day of June, 1963.

That Wednesday, the 26th day of June, A. D. 1963, at one o'clock p.m. at I
the Commission Room of th6CIty Ha.11, Bozeman, Montana, 1s designated by Reso-
lu tion No. 1078 as the time and place for hearing objections to the action pro-
posed to be taken by said resolution and When and where any and all persons
whose property is within said proposed Special Improvement District No. 432,
may appear and show cause, if any they have, against said proposed improve-
ments. Objections must be made in writing and filed with the Clerk of the
City Commission not later than fifteen (15) days after date of the first publi-
cation of this Notice.

Hall of said City of Bozeman, State of Montana, and open
for inspection to
all interested persons and the ~lblic generally.
This notice is given pursuant to the provisions of Section 11-2204,
Revised Codes of Montana, 1963.
