Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman
to create a special improvement district to be known and designated as Spec-
ial Improvement District No. 431 of the City of Bozeman for the purpose of
constructing and insta.Lling a pavement project on Arthur street between South
Grand Avenue and South Third Avenue, said project to include combination con-
crete curbs and gutters, gravel base course, and other work incidental there-
to. The City Commission does hereby declare that the area and lots included
wi thin the boundaries of said proposed dis trict will be benefi ted by the work
and improvements.
Section

Boundaries
The boundaries of said Special Improvement District No. 431 are described
as follows:
Beginning at a point on the centerline of Arthur
I Street and the East property line of South Third
Avenue; thence northerly along the East line
of South Third Avenue to a point 15U feet North
of the North property line of Arthur street;
thence easter~y 150 feet North of and para.Llel
to the North property ~ine of Arthur Street to
the West property line of South Grand Avenue;
thence southerly along the West line of South
Grand Avenue to a point 15U feet South of the
South property line of Arthur streeJ; thence
westerlY 150 feet South of and parallel to the
South line of Arthur Street to a point on the
East property line of South Third Avenue; thence
northerly along the East property line of South
Thrld Avenue to tne point of beginning.

Character of Improvements
The paving of Arthur Street between South Grand Avenue and South Third
Avenue with combination concrete curbs and gutters, grave.L base course,
cru-
shed gravel cushion course and bituminous oil surface course.

Estima te of Cost
The preliminary estimate of cost is $8,gUO.UO, including all street
excavation, all ma teria ~s, insta.Llatlon costs and engineering and incidenta~s.

5.
Me thod of As se s smen t

The cost of such improvements is to be assessed against the entire
district, each lot or parce.L of land within such district will be assessed
for that part of the whole cost which its area bears to the area of the entire
district, exc lusi ve of s tree ts , avenues, alleys and public places; and further,
each square foot of .Land within the district lying within 25 feet of the line
of the street on which the improvements herein provided for are made, s ha 11
bear double the amount of the costs of such improvements per square foot of
such .Land that each square foot of any other ~and within the district shall bear.

Section 6
Extended District
The City Commission does hereby declare tha t all lots, pieces and
parcels
of property included within the boundaries of said proposed special improve-
men t dis tric t, incLuding the lots not fronting on said improvements, will, each
and a.1l, be speciaLlY benefited by said improvements and that all of said lots
included within said boundaries shall be assessed to pay the costs and expenses
of said improvements; that in the opinion of said City Commission the contem-
pla ted improvements to be constru.cted are more than local or ordinary public

benefit and that therefore the City Commission does hereby declare its intention
to make the costs and expenses of such work chargeable upon an extended district
and to include lots not fronting on the proposed improvements.
Section 7
Pa ymen ts
That the payments for said improvements shaLl be made in twenty (20)
Annual installments extending over a period of nineteen (L9) years,
but this
shall not be construed to prevent payment in full at any regular payment
date by any property owner who desires to do so. It is proposed to pay the
entire cost and expense of the construction and installation of said improve-
ments with cash to be obtained from the sale of bonds of said Special
Improvement District No. 431, as authorized by law. Such bonds will be in
denominations of $l1uu.uOeach and fractions or multip.1es of ~~lOO.OO where
necessary, to be issued and chargeabLe against a fund to be known and desi-
gnated as Specia.1 IRprovement District No. 431 Fund of the City of Bozeman.
The bonds wi.1l be redeemab.1e at the option of the City, singly or in multiples,
and in the order of their registration, whenever funds are avaiiabLe for that
purpose in said Special Improvement District No. 431. Said
bonds wi.1l draw a
simp.1e interest from the date of their registration until called for payment,
at a rate not to exceed six ((:) ) per cent per annum, which interest shail be
chargeab.1e as a part of the cost of construction and insta.1lation of said
improvement. The bonds wiLl be issued and so.1d in accordance with the pro-
visions of Section .11-2232 and Section 11-2271, Revised Codes of Montana,
1947, and all other apPLicab.1e provisions of TitLe 1.1 of the Revised Codes
of Montana, 1947, relating to speCia.1 improvement districts in cities and
towns and any amendments thereof or there to.

That; Wednesday, the 24th day of April, 1963, at one o'clock p.m., a t the
Commi.s~ion Room of the Ci"t"Yliall, Bozernsn, 1\tontana, is designated by Resolution
No. .LU'/U as the time and pLace for hearing objections to
the action proposed to
be taken by said resolution, when and where all persons whose pro;Je:c-,y is wi thin
said proposed Special Improvement District No. 431 on Arthur Street between
South Grand Avenue and South Third Avenue, may appear and show cause, if any
they have, a<:r,ainst said proposed improvement. Objections must be made in writing
and filed with the Clerk of the City Commission not later than fifteen (15) days
after date of the first publication of this notice.
An approximate preliminary estimate of the cost of doing such work and
making such improvements within said district, including all street excava tion,
all materiaLs, installation costs, engineering and incidentals, which is to be
specially assessed against the property within said district is $8,900.00. Costs
of the project will be assessed against the entire district, each lot or parcel
of land within such district will be assessed for that part of the whole cost
which its area bears to the area of the entire district, exclusive of streets,
avenues, alleys and public places; and further, each square foot of land within
the dis tric t 1 ying wi thin 25 fee t of the line of tbe s tree t on which
the improve-
men ts herein provided for a re made, shall bear double the amount of the costs of
such improvements per square foot of such land that each square foot of any
other land wi thin the district shall bear. Payment for the improvements is
to
be made in twen ty equal annual ins ta1.lmen ts.
For a description of the boundaries of said Special Improvement District
No. 431, reference is hereby made to Resolu tion fro. l0'10 of the Commission of
the City of Bozeman declaring the intenti~n to create said District, which is
on file in the office of the undersigned (;lerk of said Comm.i.ssion in the Ci ty
I Hall of said City of Bozeman, state of Montana, and open for inspection to all
interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-22u4, Revised
Codes of Montana, 1947.
