A. 06:00:44 PM Call to Order—6 p.m. —Commission Room, City Hall, 121 North
Rouse
Mayor Krauss called the meeting to order at 6:00 p.m.

Mayor Krauss asked City Manager Chris Kukulski if there were any changes to
the agenda. Mr. Kukulski stated no.
D. 06:06:36 PM Authorize Absence of Commissioner Pomeroy
06:06:40 PM Motion and Vote approve the absence of Commissioner Pomeroy.

Deputy Mayor Taylor began the discussion regarding the draft of the Non-Discrimination
Ordinance.
06:10:31 PM Mayor Krauss
Mayor Krauss would like legal authority,the need to obtain an AG opinion, authorization
based on the Constitution and the Montana Code Annotated looked into. He spoke
regarding defining community,current internal policies, ceremonies and criminal
charges.
06:17:21 PM Cr. Andrus
Cr. Andrus spoke regarding her concern about schools as written in the draft. She also
spoke regarding the right of all to not be discriminated against.
06:21:28 PM Cr. Mehl
Cr. Mehl stated that this form of discrimination is not protected under Montana Law, and
spoke regarding the importance of equal treatment, keeping religion and government
distinct.
06:30:40 PM Deputy Mayor Taylor
Deputy Mayor Taylor stated that the City welcomes all and that there is a need to become
a unified City. He spoke regarding the draft ordinance in that exemptions for religious
institutions were made more specific than other City ordinances.
06:38:36 PM Commission Discussion
The Commission discussed the Attorney fees, additional bathroom facilities the extent of
the religious exemptions,charities, statute of limitations and clarification of requirements
for those that are outside the City limits and do business within the City.

1. 09:46:05 PM Set Meeting date for Provisional Adoption of Non-
Discrimination Ordinance and details to be incorporated in Ordinance
(Commission)

Cr. Mehl listed the items that he would like addressed in the proposed Ordinance
including the Section of Purpose and Intent regarding the inclusion and redundancy of
current classes, the need for clarification and a definition for chartable employers, Public
Accommodations including a possible grandfather clause or no facilities at all, the need
for clarification on commerce, the need to define narrowly the religious freedom
intention act, and business owner and family owned business requirements.

Mayor Krauss listed the items that he would like addressed in the proposed Ordinance
including the rights of conscience, unintended consequences, statute of limitations and
geography.

Cr. Andrus listed the items that she would like addressed in the proposed Ordinance
including, accommodation numbers, public schools being included, freedom of
conscience and public business requirements.
10:19:27 PM Deputy Mayor Taylor
Deputy Mayor Taylor listed the items that he would like addressed in the proposed
Ordinance including the question of preemption and elimination of as much as we can
from this ordinance,take out rights in regards to anything that is covered by state and
federal law, charitable organizations, business coverage, statute of limitations, building
additional facilities or special facilities and family owned businesses requirements.

discrimination ordinance for May 12th, 2014 and request that the draft ordinance
provided be revised to reflect the discussion that we just had.
