A RESOLUTION OF Trill CITY COMMISSION OF THE CITY OF
BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF
BOZEMAN TO CREA TE A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 434 OF THE CITY
OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING
A PAVEMENT PROJECT ON SPRING CREEK DRIVE FROM THE SOUTH
LINE OF THOMPSON ADDITION NUMBER THREE TO THE INTERSECTION
I WITH THE EXTENSION WITH THE WEST LINE OF LOT ONE, BLOCK
FOUR OF SAID ADDITION, ALSO THE ACCESS DRIVE BETWEEN SPRING
CREEK DRIVE AND SPRING CREEK ROAD, ALSO A PORTION OF HIGH-
LAND COURT FROM SPRING CREEK DRIVE TO A LINE 166.25 FEET
WESTERLY TrffiREFROM, SAID PAVEMENT PROJECT TO INCLUDE
CONSTRUCTION AND INSTALLATION OF A STORM SEWER LINE,
COMBINATION CONCRETE CURBS AND GUTTERS, GRAVEL BASE COURSE,
CRUSHED GRAVEL CUSHION COURSE AND AN ASPAHALTIC-CONCRETE
TYPE SURFACE COURSE.
WHEREAS there has been filed with the Clerk of the City Commission of
the City of Bozeman, Montana, a petition in due form of certain owners of pro-
perties situated on Spring Creek Drive from the South line of Thompson Addition
Number 'fhree to the intersection 11:!:th the West Line of Lot One, Block Four of
said Addition, also the access drive between Opring Creek Drive and Spring
Creek Road, also a portion of Highland Court from Spring Greek Drive to a line
166.25 feet wes terly therefrom, asking tha t a special improvemen t dis tric t be
created for the purpose of constructing and installing a pavement project to
include the construction and installation of a storm sewer line, combination
concrete curbs and gutters, gravel base course, crushed gravel cushion course
and an asphaltic-concrete type surface course, and other work incidental
thereto; and
WHEREAS, at a regular meeting of the City Commission of the City of Bozem~n
held on the 2Lst day of August, 1963, the aforesaid petition was respectively
considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CUMMISSION OF THE CITY OF
BOZEMAN:
I Sec tion 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to
create a special improvement district to be known and designated as Special
Improvement District No. 434 of the City of Bozeman for the purpose of constr-
ucting and installing a pavement project on Spring Creek Drive from the South
Line of Thompson Addition Number ~hree to the Intersection with the extension
with the West line of Lot One, Block Four of said Addition, also the access
drive between &pring Greek Drive and Spring Creek Road, also a portion of
Highland Court from Spring Creek Drive to a line 166.25 feet westerly there-
from. Said pavement project to include construction and installation of a
strom sewer line, combination concrete curbs and gutters, gravel base course,
crushed gravel cushion course, and an asphaltic-concrete type surface course,
and other work incidental thereto.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 434 as described
as follows:
Beginning at a stome monument marking the Southwest Corner of Section
18, Township 2 South, Range 6 East of the Montana frincipal Meridian;
thence S 89024' East along the southerly boundary of said ~hompson
Addition Number Three (3) a distance of 836.99 feet to the southwest
corner of Lot 7 of Block 2 of said Thompson Addition Number Three
(3 ) to the City of Bozeman, Montana, being the true point of begin-
I ning; thence in a northeasterly direction along the westerly line
of Lots 1 through 7 of said Block 2 of said Thompson Addition
Number 'Ihree (3) to the northwesterlY corner of Lot 1 of said Block
2; thence N 1601U' E a distance of 66 feet to the northerly line
of Highland Court; thence continuing N 16010' E a distance of 140
fee t, to a point of intersection with the southerly line of Lot 2 of
Block 3 of said.Lhompson Addition Number Three (3); thence N 73050' W
along the southerly lot line of Lots 2 and 1 of said Block 3, a dis-
tance of 61.26 feet to the southwesterly corner of Lot 1; thence
N 30020' lU" W along the sou thwes terly line of Lo t 1 and said line
projected across Spring Greek Drive a distance of 210.03 feet to the
northwesterly line of Spring Creek Drive; thence continuing N 3u020'lU"
W a distance of 110 feet to a point of intersection with the north-
westerly line of Lot 2 of Block 4; thence N 59039'50" E along said

line of Lot 2 a distance of 2u.22 feet to the northwesterly corner
of Lot 1 of said Block 4; thence N 0049' W a distance of 76.08 feet
to a point of intersection with the northerly boundary line of said
Thompson Addition Number Three (3) ; thence N 89011' E along said
northerly line of said addition a distance of 571.87 feet to a
point of curvature; thence alonf the northeasterLY line of said
Thompson Addition Number Three 3), being along a curve of 476.67
feet in radius,s distance of 253.28 feet to the northeasterly
ocrner of said 'l'hompson Addi tion Number 'l'hree (3); thence in sou th-
westerly direction along the easterly boundary of said Thompson

Addition Number Three a distance of L285.96' to the southeasterly
corner of said addition; thence N 89024' W along the southerly
line of said 'l'hompson Addi tion Number Three (3 ) a distance of
483.19 feet to the true point of beginning.
Including within the above described exterior boundaries the
following lots and portions of lots: Lots 1 thru 12 inclusive
of Block 1; Lots 1 thru 7 inclusive of Block 2; Lots 1 thru 4 and
a portion of Lot 5 of Block 3; Lot 1 and portion of Lots 2 and 3
of Block 4 all in Thompsons Addition Number Three (3 ) to the
City of Bozeman, Man tana .

Character of Improvements
Construction of a pavement project on Spring Creek Drive from the
South line of Thompson Addition Number Three to the intersetion with the
extension with the West line of Lot One, Block Four of said Addition,
also the access drive between Spring Creek Drive and Spring Creek Road,
also a portion of Highland Court from Spring Creek Drive to a line 166.25
feet westerly therefrom, said pavement project to include construction and

Section 4
Es tima te of Gos t
The preLiminary estimate of cost is $61,500.UU, including all street
excavation, all ma terials, installation costs and engineering and incidentals. I
Section 5
Method of Assessment
The cost of such improvements is to be assessed against the entire
dis tric t, each lot or parcel of land within such district bordering or
abutting on street or streets whereon or wherein the improvement or improve-
ments have been made, to be assessed for its part of the whole cost in pro-
portion to the lineal feet abutting or bordering same.

That the payments for said improvements shall be made in twenty (2U)
annual installments extending over a period of nineteen (19) years, bu
t this
shaLl not be construed to prevent payment in fULl at any regular payment date
by any property owner who desires to do so. It is proposed to pay the entire
cost and expense of the construction and installation of said improvements
wi th cash to be obtained from the sale of bonds of said Special Improvement
Dis tric t No. 434, as authorized by law. Such bonds wiLL be in denomina tions
of $lUO.UO each and fractions or multipLes of $luv.OU where necessary to be
issued and chargeabLe against a fund to be known and designated as Special
Improvement District No. 434 Fund of the City of Bozeman. The bonds will be
redeemable at the option of the City, singly or in multiples, and in the order
of their registration, whenever funds are available for that purpose in said
Special Improvement Dis tric t_ No. 434. Said bonds will draw a simple interest
from the date of their registration until called for payment, at a rate not
to exceed six percent (6%) per annum, which interest shaLl be chargeabLe as
a part of the cost of construction and installation of said improvement. The

bonds will be issued and sold in accordance with the provisions of Section
11-2232 and section 11-2271, Revised Codes of Montana, L94" , and
all other
applicable provisions of Title 11 of the Revised Codes of Montana, 1947
relating to special improvement districts in cities and towns and any amend-
ments thereof or thereto.
Section 7
Protests and Notice
That the regular session of the City Commission of the City of Bozeman,

to be held a t the .commission Ghamber, City Hall Building, Bozeman, Montana,
on Wedne sda y, the 18th day of September, 1963, at the hour of one o'clock p.m.
of said day, is the time and place, when and where the City Commission will
hear and pass upon all protests duly and regularlY made and filed against the
creation of said proposed special Improvement District No. 434, the improve-
ment porposed to be made pursuant thereto and the extent and character there-
of, or either thereof, and the Clerk of the City Commission be, and he is
hereby directed to give notice in the manner and for the time as required, of
the adoption of this resolution of intention.
I ADOPTED by the Commission of the City of Bozeman, Montana, at a regular
and stated session of said Commission held on the 21st day of August, 1963.

That Wednesday, the 18th day of September, i963, at one o'olook p.m., at
the Commission ~oom of th~ty tiall, Bozeman, Montana, is designated by Reso-
lution No. 1084 as the time and plaoe for hearing objeotions to the aotion pro-
posed to be taken by said resolution, when and where all persons whose property
is within said proposed Speoial Improvement Distriot No. 434 on Spring Creek
Drive from the South line of Thompson Addition Number Three to the interseotion
with the extension with the West line of Lot One, Block Four of said Addition,
also the aooess drive between Spring Creek Drive and Spring Creek Road, also a
portion of Highland Court from Spring Creek Drive to a line 166.25 feet west-
erly therefrom, may appear and show oasue, if any they have, against said pro-
posed improvement. Objeotions must be made in writing and filed with the Clerk
I of the City Commission not later than fifteen (15) days after date of the first
publication of this notioe.
An approximate preliminary estimate of the oost of doing suoh work and
making suoh improvements within said distriot, inoluding all street exoavation,
all materials, installation oosts, engineering and incidentals, whioh is to be
speoially assessed against the property within said distriot is $61,500.UO.
Costs of the projeot will be assessed against the entire district, eaoh lot or
paroel of land within suoh distriot bordering or abutting on street or streets
whereon or wherein the improvement or improvements have been made, to be assessed
for its part of the whole oost in proportion to the lineal feet abutting or
bordering same. Payment for the improvements is to be made in twenty equal
annual installments.

For a description of the boundaries of said Special Improvement District
No. 434, reference is hereby made to Resolution No. 1084 of the Commission of
the City of Bozeman declaring the intention to create said District, which is
on file in the office of the undersigned Clerk of said Commission in the City
Hall of said City of Bozeman, State of Montana, and open for inspection to all
interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204,
Revised Codes of Montana, 1947.
