A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING
AND ASSESSING A SPECIAL ASSESSMENT 01<' TAXES UPON ALL 'l'HE PROPERTY IN
SPECIAL IMfiROVEMENT DISTRICT NO. 425 IN THE CITY OF BOZEMAN, COUNTY OF
GALLATIN, STATE OF MONTANA, TO DEFRAY TIill COST OF CONSTRUCTING AND MAK-
ING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 425
I WHEnEAS, THE City Commission of The City of Bozeman, did on the ~ day
of J'ul~ 1962, duly and regularly pass Commission Resolution No. ~ entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLAR-
ING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPEC-
IAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIST-
RICT NO. 425 FOR THE PURPOS.E OF CONSTRUCrrING AND INSTALLING AN

ING A SPECIAL IMj;)ROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE-
MENT DISTRICT NO. 425 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF
CONSTRUCTING AND INSTALLIN AN OUTFALL SANITARY SEWER TO SERVE
HILLCREST RETIREMENT HOMES AND ADJACENT RESIDENTIAL AREA.
which Commission Resolutions- Nos. 1044 and 1047, passed as aforesaid, are
hereby referred to and made a part-or-this ~lution for further particulars
in respect to the boundaries of said district, the character of the improve-
ments to be constructed therein, the estimated cost of said improvements and
the method of assessing the cost against the property within said district;
and
WHEREAS, said improvements as contemplated in said Commission Resolutions
Nos. 1044 and lu47 have been constructed and completed in accordance with the
I terms-anQ conditIOns of Commission Resolutions Nos. 1044 and 1047, and the
total cost of said improvements 80 constructed is the sum of ~y thousand
two hundred eleve~ & 56/100ths (6U,2l1.56) dollars.
NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and
5485, R. c. M., 1935 and amendments thereto,
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY
OF BOZEMAN, STATE OF MONTANA:
Section 1. ~hat to defray the cost and expense of constructing and making
the improvements in said Special Improvement District No. 425, there be, and
there is hereby levied and assessed a tax amounting to the-suID of Sixty thousand
two hundred eleven & 56 luuths (6U 211..56) dollars upon all property in said
peclal mprovemen s r c o. ,
t at a particular description of each Lot
and parcel of land with the name of the owner and the sum assessed against him
or it for such improvements and the amount of each partial payment to be made
and the day when the same shall be delinquent is set forth in detail in the
assessment list hereto attached, marked Schedule "A", and made a part hereof;
tha t the se veral sums se t opposi te the names of the owners and the described lots
and parcels of land be, and the same are hereby respectively levied and assessed
upon and aga ins t said described 10 ts and parce Is of land to defr8 y the co stand
expense of constructing and making the improvements within said District; tha t
the severa~ sums so assessed be collected from the respective owners of said lots
and parcels of land described in said assessment list, Schedule "A" as required
by law; that the payment of said St@S shall be made in 20 installments and the
payment of said installments shall extend over a period-of 19 years; that the
payment of the r'?spective annual installments shall be madeon or before the 30th
day of ~ovember of each year unti~ payment of all installments together with the
interest thereon, shall be made; that said sums shall be paid and the co~lection
thereof shall be made in the manner and in accordance with the law governing the
I collection of special improvement taxes; the t failure to pay such assessments
when the same ,become due and payable shall make such persons and said lots and
parcels of land liable to the penalties provided by law relative to delinquent
tax e s .
SAC tion 2. That the regular session of the Commission of The City of
Bozeman to held in the Commission Chamber in the City Hall of said City of the
30th day of october, 1963, at 1:00 o'clock 1'.11"., be, and the same is hereby
designa ted as the time and place at which objections to the final adoption of
this Resolution will be will be heard by said Commission.
Sec tion 3. J..ha t the Clerk of the Commis sion of The City of Bozeman be,
and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle,
a daily newspaper printed and published in the said City of Bozeman, a no tice
signed by the Clerk of the Commission and stating that a Resolution levying and

assessing a special assessment of taxes to defray the cost and expense of
constructing and making the improvements in the said Special Improvement
District No. 425 is on file in the office of the Clerk of the Commission sub-
ject to inspection for a period of five (5) ; that said Notice shall state
the
time and place at which objections will be heard by the Commission to the
final adoption of this Resolution; that it shall be published at least five
(5 ) days before the day set by the Commission for the hearing of objections and
the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman I
at a regular session thereof held on the 23rd da~ of Oct., 1963.

NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of
The City of Bozeman held on the ~ day of October, 1963, Commission Reso-
lution No. ~ was provisionally passed and adopted; that said Commission
Resolution levies and assesses a special assessment of taxes upon all the pro-
perty in Special Improvement District No. 425 in said City to defray the cost
and expense of constructing and making the improvements within said District,
to-wit:
Beginning at the Northeast Corner of Section 18,
Township 2 South, Range 6 East, M.P.M.,; thence in
a westerly direction along the North line of said
Section 18, a distance of 1327.36, feet, more or less,
to the Northwest corner of the East half of the
Northeast Quarter (EtNEt) of said Section 18;
thence
in a southerly direction along the West line of said
East Half of the Northeast Quarter (EtNEt), a dis-
tance of 2,666.55 feet, more or less to the Southwest
corner of said East Half of the Northeast Quarter
(EiNEt) , said point being the Southwest corner of
Valley View Addition to the City of Bozeman; thence
in an easterly direction along the South line of said
Valley View Addition a distance of 331.5 feet to the
East line of Block 24 of said addition projected;
thence in a northerly direction along the East line

Sec tion 3
Character of Improvements
Construction and installation of an outfall sanitary sewer, said pro jec t
to inciude all appurtenant work for the construction of a sewerage system to
provide sanitary sewers for all lots within the district, including pipe lines,
manholes and other necessary appurtenances.
Section 4
Estimate of' Cost
The preliminary estimate of cost is $81,454.38, incl.uding all trench
excavation and backfill, all ma teriais, inst81lation costs, engineering and
inciden tala.
Section 5
I Method of Assessment
The preliminary estimate of cost as set forth above will be assessed on
an actual area basis.
Section 6
Actual Area of District
The actual area of the district as described is 253.32 acres, and pro-
tests will be considered on an actual area basis.

Tha t, said Commission Resolution No. 1099 is now on file
in the office
of the C~erk of the Commission, subject to-rnBpection for a period of Five
(5) days by any persons interested. That Wednesday, the 30th day of October,
1963, at 1:00 o'clock p.m., of said day at the regular se"SSTOn of the said
Commission of The City of Bozeman, at the Commission Room, in the City Hall
Building of said City, has been designated as the time and place when
and
where the said Commission will hear and pass upon any and all objections that
may be made to the final passage and adoption of said Resolution No. ~, and
the levying of said Assessment, and that said Resolution will be finally
passed and adopted at said regular session.

All persons interested are referred to Commission Resolution No. 1044,
declaring it to be the intention of the Commission to create Special Improve-
ment District No. 425, and Commission Resolution No. lu47, cre
a ting Special
Improvement District No. 425, for constructing and making the improvements
therein.
