Home My WebLink AboutResolution 1096 Levy of taxes to Defray Construction Costs 224 COMMISSION RESOLUTION NO. 1096 A RESOLUTION OF THE COMMISSION OF THE CITY 01" BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND INSTALLING AND/OF REPAIRING MISCEL- LANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1963. I WrffiREAS, the Commission of The City of Bozeman, pursuant to the pro- visions of Chapter 9.36 of the Bozeman Municipal Code and of Section 11-2226, Political Code, R.C.M., 1947, provide for the construction of sidewalks and curbs in the City of Bozeman during the year 1963, without the formation of a Special Improvement District' WHEREAS, proceedings were had for the construction and installation and/or repair of Miscelianeous Sidewalks and Curbs in the City of Bozeman for the year 1963, and WHEREAS, miscellaneous Sidewalks and Curbs were constructed and installed and/or repaired bordering on various properties in the City of Bozeman, pur- suant to Chapter 9.36 of the Bozeman Municipal Code and the provisions of Section 11-2226, Political Code, R.C.M., 1947, which are hereby referred to and made a part of this Resolution, and WHEREAS, the Mi see llaneous Sidewalks and Curbs ha ve been cons true ted and completed and/or repaired in ac~ordance with the terms and conditions of said proceedings, and the City Engineer has duly certified to the Commis- slon a Schedl.J1e showing the sidewalks and curbs which have been constructed and installed and/or repaired, and the properties which are subject to assessment thereunder and the total cost of said construction and install- ation and/or repairing is the sume of Three thousand nineteen & 42 100ths Jj3,019.42) dollars , which Schedule, mar e c e u1e s hereto at ached and made a part nereof. NOW, THEREFORE, Pursuant to the provisions of Chapter 9.36 of the Boze- man Municipal Code and Section 11-2226, Political Code, R.C.M., 1947, as aforesaid, BE IT RESOLVED AND IT IT HEREBY ORDERED BY THE COMMTSE'iION OF 'l11fE I CITY OF BOZEMAN, MONTANA: Section 1. That to defray the cost of constructing and installing and/ or repairing Miscellaneous Sidewalks and Curbs as set forth in Schedule "A", here to a ttached and made a par thereof, there is hereby levied and assessed a tax amounting to the sum of Three thousand ~ineteen and 42/100ths ($3,019.42) Dollars. See tion 2. Tha t a particular description of each 10 t and parcel of land with the name of the owner and the sum assessed against him or it for such construction and installation and/or repair and the amount of each payment to be made and the day when the same shall become delinquent is set forth in the assessment list hereto attached marked Schedule "Aft and made a part hereof; that the several sims set opposite the name of the owner and the description of the lots and parcels of land be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to defray the cost and expense of constructing and installing and/or repairing said Sidewalks and Curbs; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assess- ment list as required by law; that the payment of said sums shall be made in six installments; that the payment of said installments shall be made on or before the 3uth day of November of each year until payment of all install- ments together with the interest thereon, sha IJ. be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of Special Improvement taxes; tha t failure ,~ -... to pay such assessments when the same shall become due and pay- able shall make such persons and said lots and parcels of land liabLe to the penalties provided by Law relative to delinquent taxes. Section 4. '111101 t the Clerk of the Commission of the City of Bozeman, be and he is hereby ordered and directed to pubLish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of ta:x:es to defray the cost and expense of constructing and installing and/or repairing Sidewalks and Curbs in the City of Bozeman for the year 1963 is on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) da ys ; tha t said Notice shall state the time and place at which objections will be heara by 225 the Commission to the final adoption of this Resolution; that it shall be published at least five (5) days before the date set by the Commission for the hearing of objections and the final adoption of this Resolution. - Provisionally passed and adopted by the Commission of 'l'he Ci ty of Bozeman at a regular session thereof, held on the ~ day of October , 1963. NOTICE IS HEREBY GIVEN, that during a regular session of the Commission of the City of Bozeman held on Wednesday, the 2nd day of October, 1963, Commis- sion Resolution No. 1096 was provisional.1.Y passed and adopted; that said Commission Resolutiori"""1'8vies and assesses a spc:cial assf'Jssment of taxes upon certain lots and parcels of land in front, or on the side of which, sidewalks and curbs have been constructed and/or repaired pursuant to the provisions of Chapter 9.36 of the Bozeman Municipal Code and of Section 11-2226, Poll tical Code, R.C.M., 1947, to defray the cost and expense of constructing and install- ing and/or repairing said Sidewalks and Curbs. That said Commission Reso.lution is now on file in the office of the C~erk of the Commission, subject to inspection for a period of five ( 5) da Y8 by any persons interested.
