WHEREAS, the City Council of the City of Bozeman heretofore duly and regularly passed Ordinance No. 502, entitled: "AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW FROM THE SIDEWALKS IN THE CITY OF BOZEMAN AND REJ:-'EALING ORDINANCE NO. 385, ENTITLED: "AN ORDINANCE J:-'ROVIDING FOR THE RE- MOVAL OF SNOW A~ID ICE, DIRT, FILTH AND OTHER OBSTRUCTION FROM SIDEWALKS ON MAIN STREET BETWEEN WALLACE AVENUE AND FOlTRTH A VENUE IN THE CITY OF BOZEMAN 1 It, and WHEREAS, Section 11-9U9, R.C.M., 1~47, provides; nThe C1 ty or Town Council has power to regula te the use of sidewalks and to require the owners of the premises adjoin- ing to keep same free from snow xx xx xx; and to provide for ~evying the cost of removal as a special tax against the property x x xlt, and WHEREAS, owners of premises in said City have neglected to remove the snow from the sidewalks adjoining thereto during the year 1962-1963 and the City of Bozeman, pursuant to Section 11-909 R.C.M., 1947, and Ordinance No. 502 has removed the snow from the sidewalks adjoining the premises of I said owners and the total cost of the removal thereof is chargeable to the property as hereinafter set forth, pursuant to provisions of said Section 11-909, Political Code, R.C.M., 1947, and said Ordinance No. 502. NOW THEREFORE, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That during the year 1962-1963 The City of Bozeman has removed the snow from sidewalks adjoining premises in The City of Bozeman and defrayed the cost thereof as set forth in schedule "One" hereto attached and made a part hereof. See tion 2. That to defray the cost ($615.71) of removing said snow from sidewalks adjoining said premises as set forth in said Schedule "One", hereto attached and made a part hereof, for the year 1962-1963, there be, and there is hereby levied and assessed a special tax against said property as set forth in said Schedule "One", hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it is set forth in assessment list hereto attached marked Schedule ItOne", and made a part hereof; that the several sums set opposite the names of the owners and the description of the lots and parcels of land be, and the same are hereby levied and assessed upon and against said lots and parcels of land; that the severa~ sums be collected from the respective owners of said lots and parcels of lands des- cribed in said assessment list, Schedule "One", as required by law; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when same shall be- come due and payabLe shall make usch person and such lots and parceLs of land liable to the penalties provided by the law relative to delinquent I tax e s . Section 3. 'l'hat the regular session of the Com"nission of The City of Bozeman to be held on the 2nd day of October, 1963, at the Commission Room, City Hall Bu'lding, be, ana:-the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be, and he is hereby dir- ected and ordered to publish in the Bozeman Dai~y ~hronicle, a daily news- paper printed and published in said City of Bozeman, a notice signed by the Clerk of the Commission, and s ta ting tha t a resolution levying a special 22() assessment of taxes to defray the cost of removal of snow and ice from side- walks adjoining certain premises in 'rhe City of Bozeman for the year 1962-1963 is on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days; that said notice shall state the time and place at which objections will be heard by the Cornmisrion to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing objections and the final adoption of this Resolution. NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of the City of Bozeman held on the 25th day of Se~tember, 1963, Commission Reso- lution No. 1094 was duly passed a:na-adopted; t at said Commission Resolution No. ~ leVIeS and assesses a special assessment of taxes upon certain pro- perties in The City of Bozeman for the year 1962-1963 to defray the cost of removal of snow for the year 1962-1963. The said Commission Resolution No. lu94 is now on file in the office of the CLerk of the Commission of said City-or-Bozeman subject to inspection of all persons interested for a period of five (5) days, by any person inter- ested; that Wednesday the 2nd day of October, 1963, at l:UO o'clock p.m. of said day at a regular session of the Commission of The City of Bozeman, Commission Room, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final adoption Hnd passage of said Commis- sion ReSOlution No. 1094, and the levying of said assessment; that said Reso- lution will finally ~assed and adopted at said regular session of said Commission, sub,ject to corrections and amendments as may be made upon ob ;jec tions made and filed wi thin five da ys limi t as provided by law.
