HomeMy WebLinkAboutResolution 1093 Lighting District Maintenance 216 COMMISSION RESOLUTION NO. 1093 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAIN- TENANCE AND ELECTRICAL CURRENT COSTS FOR SPECIAL IMPROVE- MENT LIGHTING DISTRICTS OF THE CITY OF BOZEMAN, PURSUANT TO THE PROVISIONS OF SECTION 11-2252, R.C.M., 1947. I BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:' Sec tion 1. 'l'ha t pursuant to the direction and by authori ty of the pro- visions of Section 11-2252, R.C.M., 1947, and upon estimates of such cost made by sa id Ci ty Commis sion as authorized and dire c ted by sa id Sec tion 11-2252, R.C.M., 1947, to defray the cost of maintaining lighting systems and for elect- rical current in the several Special Improvement Lighting Districts of the City of Bozeman hereinafter specified, there is hereby levied and assessed against the property and the several lots, pieces and parcels thereof within the bound- aries of Special Improvement Lighting District No's. 284, 288, 289, 290, 300, 361, 362, 388 400, 420 and 423 of the City of Bozeman respectively, as here- tofore create~ and established, the total amounts as to each entire district and the several amounts as to each lot, piece, or parcel of land with the boundaries of such district, as set forth, in the several shcedules attached hereto and made a part hereof and marked separately for identification as as Schedule One thru Schedule Twelve. --- The amount so levied and assessed is 75% of such estimated cost for each and all of said Districts except for SILD's. No's. 361 and 362, and as to SILD. No's. 361 and 362 the levy and assessment is 50% of such estimated cos t. Sec tion 2. That a_particular description of each lot, piece or parcel of land with the name of the owner thereof, and the sum assessed and levied against such property and owners, or either, is set forth in the schedule of each district as specified and indentified in Section 1 of this Resolution, and made a part of this Resolution as aforesaid. See tion 3. That the regular meeting of the 'Commission of the City of Bozeman to be held on the 2nd day of Oct., 1963, at 1:00 o'clock p.m., at the Commission Chamber, City Hall Bui1OITIg, in the City of Bozeman, be, and I the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard and considered by said Commission. Section r. That the Clerk of the Commission be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in said City of Boze- man, a notice signed by said Clerk as such, which notice shall state that this resolution levying and assessing the several amounts set forth in the Schedules attached hereto and made a part hereof as aforesaid, and for the purposes herein s ta ted, has been provis iona11y pas sed and adopted by the Commission of the City of Bozeman and is on file in the office of said Clerk and subject to inspection during regular office hours, for a period of five days from and after the publication of such notice and at any time during such office hours and at or prior to the regular meeting of the City Commis- sion to be held on the 2nd day of October, 1963, as stated in Section 3 hereof; that said noticeshall be so published once, and such publication shall be made not less than five days before the time set for hearing and considering objections to the final adoption of this Resolution as aforesaid. NOTICE IS HEREBY GIVEN", that at a regular meeting of the Commission of . the City of Bozeman, Montana, held on the ~ day of September, 1963, Commission Resolution No. ~, was provislonally passed and aaopted. Said Resolution levies and assesses a special assessment upon all the property in Special Improvement Lighting Districts of said City and to defray the esti- mated cost of maintenance and electrical current for each of said Districts, pursuant to the provisions of Section 11-2252, R.C.M., 1947. The portion of such coast assessed assessed is 75% as to all of said Districts except Districts No. 361 and 362 (Main St.) and as to such districts the portion of the cost assessed is 50%.
