WHEREAS, at a regu~ar session of the Commission of the City of Bozeman, State of Montana, he.Ld on the .L2 th da y of A ugus t, .L 864, the said Commission du.LY passed Commission Reso.Lution No. 1.L29 dec.Laring it to be the intention of the said Commission to crea te a special irr:provement dis tric t to be known and designated as Specia~ Improvement District No. 442 of the said City for the purpose of constructing and instal.Ling a pavement project on the entire .Length of Blackmore j;-'~ace and Terrace Avenue in .Map~e Terrace Subdivision to the City of Bozeman, being a rearrangement of Tracts ~, 2, 3, 4, 9, 11 and 13 of Homesites Subdivision, and to speciaLLY assess the entire cost and expense of making said improvemen ts aga ins t the property wi thin said Dls tric t under and by virtue of the proviSions of the .L1::!.WS of the State of Montana in suCh cs se made and provided, and said Commission Resolution No. 1.L29 is hereby referred to and made a part hereof for further particuLars in respect to the boundaries of said Special Improvement District No. 442, the es tima ted cos t of said improvements and the method of assessing the samB Hgalnst the property of sHid District; and WHEREA S, notice of the p1::!.ssage of said Commission Reso.Lution No. 1~29 was dULY publ:tsrwd, as required by .Law, in the Bozeman DaiLY Chronic.Le, a daLLY newspaper of genera~ circulation printed and pub.Lished in the City of Bozeman, Montana, and by sending a copy of such notice by U. Section 3 I That tne entire cost and expense of making ttle specia~ improvement herein referred to in said SpeciaL Improvement District No. 442 sha..Ll. be paid by Spe- cial Improvement District Coupon bonds, as authorized by the .Laws of the state of Montana, which bonds sha~.L be in denomination of One Hundred Do.Llars ($lUu.OO) each, and fractions or multiples thereof where necessary, to be issued and chargeab.Le agninst a fund to be known as "Special Improvement District No. 442 Fund", said bonds to be redeemab.Le at the option of the City of Bozeman, rontana, whenever funds are avai.wbLe for tha t purpose from said Special Improvement District No. 442 Pund; said bonds sha.Ll draw interest at a rate not to excedd six percent (6%) per annum, which sha~-L be chargeabLe as a part of the cost of said improvements and shall rund from the date of the registration of said bonds until said bonds are paid. To pay said bonds, and ------ --..- --- --.- ~Bn the interest thereon, representing the cost of said improvement, a special assessment sha~l be levied against all of the ~ands within said Special Improve- ment District No. 442 as in said Resolution of Intention No. ~~29 defined. Section 4 Said assessment and taxes sha~l be payab~e in twenty (2U) annual. install- ments extending over a period of nineteen (l~) years, with interest on deferred I payments; but this provision shall not be construed to prevent fu~l payment at 8ny time. Sec tion 5 That the City Engineer be, and he is hereby directed to prepare plans and specifications for the dOing of said work and the making of said improvements. Section 6 That pursuant to the provisions and authority conferred by Section 11-2232, Revised Codes of Montana 1947, said bonds may be sold to the highest and best bidder therefor for cash, and the proceeds of such sa~e used in making payment to the contractor, or contractors, for such wOrl{, and sl1.ch payment may be made either from time to time on estimates made by the engineer in charge of such improvements for the C1 ty, or upon the entire comlHetion of the improvements and the acceptance thereof by the City Commission. Section 7 That upon completion of plans and specifications by the City Engineer for the doing of said work and the making of said improvements, the C~erk of the City Commission of the C1 ty of Bozeman, Montana, be, and is hereby, directed to publish a notice inviting proposa~s for the making of said improvements on said Special Improvement District No. 442, which notice shall refer to the plans and speci- fica tions on file, by PUblishing such notice in two (2) issues of the Bozeman Daily Chronic~e, a daily newspaper printed and pub~ished in the City of Bozeman, not less than ten (10) days before tho time such bids wi~l be opened.
