WHEREAS, there has been fiLed with the CLerk of the City Commission of the City of Bozeman, Nlon tana , a petition in due form of certain owners of pro- perties si tua ted on Blackmore Place and Terrace Avenue in Maple Terrace Subdivision to the City of Bozeman, asking tha t a s pecia 1 improvemen t dis tric t be created for the purpose of construct:i.ng and installing a pavement project to include the construction of drainage facllites, combination curb and gutters, graveL base course, crlJshed gravel cushion course and an asphaltic-concrete surface course, and other work incidental thereto; and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman he.Ld on the 12th day of August, 1964, the aforesaid petition was respectively considered and granted; NOW, Tl:'ERElt'ORE, B:E IT RESOLVED BY THE CITY COMrnSSION OF THE CI'l'Y OF BOZm:IAN: Sec tion 1 DeClaration of Intention I That it is hereby deClared to be the intention of the City of Bozeman to create a special impro'lement district to be known and des:lgnated as Special Improvement District No. 442 of the City of Bozeman for the purpose of constr- ucting and installing a pavement project on the entire length of IHackl"lOre Place and Terrace Avenue in Maple Terrace Subdivision to the City of Bozeman. Said pavement project to include construction of drainage faci~ities, combinH- tioD curbs and gutters, gravel base course, crushed gravel custlion course and an asphaltic-concrete surface course, and other work incidental thereto. Section 3 Character of Imvrovements Construction of a pavement project on the entire length of Blackmore Place and Terrace Avenue in Map.Le rllerrace Subdivision to the C1 ty of Bozeman, said pavement project to include construction of drainage facilites, combina- tion curbs and gutters, graveL base course, crushed graveL cushion course and an asphaltic-concrete surface course. Sec tion 4 Es time te of Cos t The preliminary estimate of cost is $27,uUU.uO, including all street excavation, all materials, lnstallation costs and engineering and incidentals. Sec tion 5 Method of Assessment The cost of such improvement is to be assessed against the entire dist- rict, each LOt or parcel of land within such distric~ will be assessed for that part of the whoLe cost which i~s area bears to the area of the entire distric. t, exc.l.usive of street~., avenue, Hlleys ~.nd. publ~C p-,::aces; and. further, I each square foot of land withln the district lYlng withln 25 feet of the line of the stre!:;t on which the improvements herein provided for are made shall bear double the amOl1nt of the costs of such improvements per square foot of such land that each square foot of any other land within the district shall bear. Sec tion 6 Payments That the payments for said improvements shaJ.l be made in twenty (20) annual installments extending over a period of nino teen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 442, as authorized by law. Such bonds will be in denominations of ~plUO .OU each and frac tions or mul tlples of $luU .uu where necessary, to be issued and chargeable against a fund to be lmown and designated as Special Improvement District No. 442 Fund of the Ci ty of Bozeman. 'The bonds Will be in multiples, and in the order of their registration, whenever funds are available for that purpose in said Special Improvement District No. 4~2. Said bonds will draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6%) per annum, which interest shall be chargeabLe as a part of the cost of construction and installation of said improvement. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revi- sed Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 194'1, relating to special improvement districts in cities and towns and any amendments thereof or thereto. Section 7 I Protests and Notice Tha t the regular session of th.e C1 ty Commission of the Ci ty of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 2nd day of September, 1964, at the hour of one o'Clock p.m. of said day, is the time and pLace, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 4~2, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof, and the Clerk of the City Commission be, and he is hereby directed to give notice in the manner and for the time as required, of the adoption of this resolution of intention. 2~)5 ADOPTED by tne Gommission of the CitK of Bozeman, I1ontana, at a re~ular and stated session of said Commission hel on the 12th day of August, 1 64. When and where all persons wnose property is within said proposed Special Improvement District No. 442 may appear and show cause, if any they have, against said proposed improvement. Objections must be made in writing and filed with the C.Lerk of the City Commis- sion not later than fifteen (15) days after date of the first publication of this no tice. An approxim~te preliminary estimate of the cost of doing such work and mak- ing such improvements within said district, including aLl street excavation, all materiaLs, installation costs, engineering and incidentaLs, which is to be spe- cially assessed against the property within said district is $27..0UO.UU.
