WHEREAS, The City of OOmmission of the City of Bozem~n did on the 8th day of
January, 1~40, duly and reguiarly Vass ord1nance No. 696, entitlea:
AN ORDINANCE DEFINING G\RBAGE FOR THE PUR.pOSE OF THIS
ORDINANCE, PROVIDING FuR THE COLLECTION AND DIS~OSITION
THEREOF BY AND UNDER THE 3Ut>ERVISION AND CONTROL OF THE
DEpARTMENT OF PUBLIC WELFARE AND FOR DEFRAYING THE COST
OF SUCH COLLECTION AND DISl'OSITION BY SPECIAL ASSESSMENT
AGAINST THE PROPERTY TO WHICH SUCH SERVICE IS RENDERED,
AND PRuVIDING r>ENALTIES FOR VIOLATION uF THIS uRDINANCE.
Which Ordinance No. 696, passed as aforesaid is hereby referred to and made
a part of tnis Resolution for further particulars in respect to the basis and
method of assesslng the cost against the property herein assess, and
WHEREAS, said expense incurred by said City in the COLlection and
disposition of garbage in accordance with said Ordinance 1s hereby estimated
by the Commie sion of the Oi ty of Bozeman to be the sum of Suty-one thousand

professional c~ncerns, or combined residence and business or residences and
professional bustness concerns in accordance with said Ordinance No. 696, and
the Bozeman Municipal Code, and
WHEREAS, in order to raise said sum to defray the said cost, it is necessary
to establtsh the basic unit rate, as defined in said Bozeman Municipal Code
I at Seventeen Do..11ars ($l7.vu)
NOW, THEREFORE, pursuant to the provisions of said Ordinance No. 6~6, and
the Bozeman Municipal. Code and the J.aws of the sta te of Mon tana,
BE IT REBOL VED AND IT IS HEREBY URDERED BY THE CoMMISSION OF THE CITY
OF BOZEMAN, STATE OF MONTANA:
Section 1. That to defray the estimated cost and expense of collecting
and disposing of garbage in the City of Bozeman for the year 1.964, there is
hereby levied and assessed against the property and the several lots, pieces
and parcels of land thereof within tne Ci ty of .bozeman as set forth in Schedule
"A", which is attached hereto and made a p3.rt hereof, a tax; that a particula.r
description of each lot and parcel of land with the name of the owner and/or
owners and the sum assessed against the same is set for th in the a ssessmen t
list in said Schedule "A"; that the severaL sums set opposite the names of
said owners and the described loots and parce.1s of land, be, and the same are
hereby levied and assessed upon and against said lots and parcels of land
for said purpose; that the several sums be collected from the respective
owners of said lots and parceJ.s of land described in said assessment list and
owned by them; that the said sums shaJ.l be paid and the collection thereof be
made in the manner and in accordance with Ordinance No. 696 of the City of
Bozerran, Mon tana, and the laws of the State of Montana governing the cO.Llection
of Special Improvement Taxes; that failure to pay such assessment when the
same shall become due and payab~e shall make such persons and such lots and
parcels of land J.lable to the penalties provided by law relative to delinquent taxes.
Section 2:: That the regular session of the Commission of the City of
Bozeman, M ntana, to be heJ.d in tne Commission Chamber in the City Hall of
said City on the 23rd day of September, 1964, at l:UU o'clock P.M., be, and
the same is hereby designated as the time and place at Which objections to the
I final adoption of this Resolution will be heard by said Commission.
Section 3. That the Clerk of the Commission of tne City of Bozeman, be,
and he is hereby ordered and directed to pub~isn in the Bozeman Daily Chronicle,
a daily 'newspaper printed and published in said City of Bozeman, a notice
signed by ,the Clerk of the Commission, stating that a resolution levying and
assessing a special assessment of taxes to defray the cost and expense of the
C0.11ection and disposition of garbage in the City of Bozeman for the year 1964,
a~alnst the property to whi c:h such s ervic e was rendered, is "n file in the
6 fice of the Clerk of the Commission, subject to inspection for a period of
five ~a1s; that said Notice shall state the time and p.1ace at w~ich objections
will be heard by the Connniss ion to the final adoption of this Resolution; and,
that said Notice shaJ.J. be pub.1ished at J.east five days before the date set by
the Commission for hearing of objections and the final adoption of this Resolution.

NOTICE IS HEREBY GIVEN, that at a regular sess! on of the Commission of
The City of Bozeman held on the 16th day of September, 1~o4, Commission
Resolution No. 1137 was provisionally passed and adopted; ttla t said Re-

of the Commission of the City of Bozeman, in the vommiss~on Room, in the I
City Hall Building, has been designated as the time and plt:ACe when and
