I WHEREAS, the City Council of the City of Bozeman heretofore dUlY and regu- larly passed Ordinance No. 428, entitled: "AN ORDINANCE DEF'INU'G AND 1:':::'OVIDU.'G FOR T'HE 1:'lJNISm/fENT AND ABATE- MENT OIi' CER'I'AIN :l'nJISANCES", AND WHEREAS, Section 11-~e5 R.C.M., 1~4'1, provides the City or Town Council has power to declare and determine what vegetation within the City or frown s,hall be noxious weeds, and to provide the manner in which they shall be exterminated, tind to require the owner or owners of any property wi thin said C1 ty or 'I'own, to, exter- minate or remove noxious weedf: from their premises, and one-half of any road or street lyinp; next to the lands or boulev<-)rd abutting thereon, and to provide, in the event the owner~ or owner of eny of said premises neg~ect to exterminete or remove noxious weeds therefrom, for levying the cost of such extermination or removal 8S special assessmBnt against the property; and WHEREAS, owners of premisos in said City nave neglected to exterminate and remove noxious weeds therefrom during the year 1~64 and the Ci ty of Bozeman, pur- suant to Section 11-95 RCN~, 1~4'1, and Section 6.5u.U2U of the Bozeman Municipal Code, have extermina ted and removed nox:"Lou.s weeds from the premises of said owners and the total cost of the extermination and removal thereof is chargeable to the property as hereinafter set forth, fJursuant to the provislons of said Sec tion 11-9H5, l'oJ.i ticr,d Gnde, R. C .M., 194'1, and said S.ec tion 6 .5U .U20 of the Bozeman Mun1clpal Code. BE 1'1' RESOLV1W AND IT IS HEREBY ORDERED BY THE COMTrISSION OF' THE CITY OF BOZEMAN, STATE OF VONTANA: Section 1. The t during the year 1~64, the Ci ty of Bozeman has extermina ted and removed noxious weeds from the properties in the City of Bozeman and defrayed _ the cost thereof as set fortn in the Sechedule hereto attached and made a part I. hereof. Section 2. Tnat to defray the cust ib37.46 of exterminating ~nd removlng s~1d noxious weeds from said premises as set forth 1n said schedule, hereto attached and made a part hereof, for the year 1964, there be, and there is hereby levied and assessed a special tax against said property as set forth in said schedule, hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and tne sum eassessed against him (?jr it is set forth in the assessmen t list hereto a ttached marked "Schedule One", and made a part; hereof; that the several sums set opposite the names of the-oin- ers and the description of the Lots and parcels of land be, and the same are here- by levied and assessed upon ~nd against said lots and l~rcels of land; that the several sums be collected from the resfJective owners of said lots and parcels of land described in said assessment list, "ScheduLe One", as required by law; that said sums shall be paid and me cOJ_lection thereof shall be made in the manner in a ccordance with the law governing the cOllection of special improvement taxes; that failure to pay such assessments when same shall become due and payable Shall make such persons and such lots and parcelS of land liable to the penal ties provided by law rela tl ve to dellnquen t taxes. Section 3. Tha t the regular session of the Commission of the Ci ty of Bozeman to be held on the 23rd day of September, 1964 at the Commission Room, City Hall Building, be and the same is hereby designated as the ti'11e and place at which objections to the final adoption of this resolution will be heard by the Commission. Seotion 4. Tha t the Clerk of the Commission be, and he is hereby ordered and directed to publish in the Bozet'!1an Daily Chr'micle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission, stating that a resolution levying a special assessment of taxes to defray the cost of exterminating and removing noxious weeds from certain properties in the City of Bozeman for the year 1964, i8 on file in tne office of the Clerk I of the Oommission, subject to inspection for a period of five days; that said notice shall state the time and place at which objections Will be heard by the Commission to the final adoP. tion of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing objections, _ and the final adoption of this resolution. NOTICE ISHEREBY GIVEN, that.at a re~lar session of theCommlsslon of the City of Bozeman heid on the16thQ.ay of eptember, 1964, Commission Resolution No.1136 was duly pal.ed and adopted; that said Commission Resolution No. 1136 1ev18'Sand assesses a special. assessment of taxes upon certain properties l.n the ~, City of Bozeman for the year 1964 to defray the cost of exterminating and removing noxious weeds for the year i964. That, said Commission Resolution No. li36 1s now on fiie in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of ail persons interested for a period offive days; that Wednesday the 2'3rd day of September, 1964 at 1:uu o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman, City Hail Building, has been designated as the time and place when and where said Commission WLll hear and pass upon any and all ob jections tha t may be made to t he final passage and adoption of said I Commission Resolution No. 1136 and the levying of said assessment; that, said Resolution will be finailyPi'Ssed and adopted at said reguiar session of said Commission subject to such correctlonsand amendments as may be made upon objections made and filed within the five daJs limit as provided by law.
