A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA ,LEVYING
AND ASSESSING A Sl'ECIAL ASSESSMENT OF TAXES U1.'ON ALL THE .PROPERTY IN
SPECIAL IMl'ROV~ENT DISTRICT NO. 431, IN '!HE CI TY OF BOZEMAN, COUNTY UF
GALLATIN, STATE OF MONTANA, TO DEFPAY THE COST OF CONSTRUCTING AND MAKING

INTENTION OF 'T'HE CITY OF BOZEMAN TO C"REATE A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 431, OF THE CITY OF BOZEMAN FOR THE PURpOSE
OF CDNSTRUCTING AND INSTALLING A PAVEMENT PRoJECT ON ARTHUR STREET BETWEEN SOUTH GRAND
AVENUE AND SOUTH THIRD AVENUE, SAID pRu.JECT TO INCLUDE COMBINATION CONCRETE CURBS AND
GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE AND BITUMINOUS OIL SURFACE
COURSE.
and thereafter, after due and legal proceedings had, the Commission of The City of
Bozeman did on the 24tn day of April 1963, duly pass Commission Resolution No. 1u76,

which Commission Resolutions No. 's 1u70 and lU'/6 passed as aforesaid, are hereby
referred to and made a part of this resolution for further particul!::Lrs in respect
to the boundaries of said district, the character cO:>f tne improvements to be con-
structed therein, the estimated cost of said improvements and the method of assessing
the cost against the property within said district; and
WHEREAS, said improvements as contemplated m said Con1l11iss10n Resulutlons No.'s
10'70 and 1076 have been cons tructed and completed in accordance wi th the terms and
condi t10ns of Cornmis sion Resolut1ons No.' s lu'10 and lU,(6, a nd the total cost of said
improvements So constructed is the sum of Eight Thous~rd Nine Hundred and no/luu
dOllars ($e,9uu.OO).
NOW, THEREFORE, pursuant to t he provisions of Sect10ns 5225 to 52'/?5 and 5485,
I R.C.M., 1847 and amendments thereto,
BE IT RESOLVED AND IT IS HEPEBY ORDERED BY THE COMMISSION OF THE
CITY OF BoZEMAN, STATE OF' MONTANA
Section 1. That to defray'the cost and expense of constructing and making
the improvements in sald SpeCial. Improvement District No. 431, there be, and
there is hereby levied and assessed a tax amounting to the sum of Eight Thousand
Nine Hundred and no/IOu doLlars ($8,9UO.UU) upon all. the property in sa1d Special
Improvement District No. 431, that a particuiar descript10n of eaCh Lot ~nd parcel
of land with the name of the owner and the Bum assessed against him or it for
such improvements and the amount of each partial. IS yment to be made and the day
when the same shall be delinquent is set forth in detail in tne assessment List
hereto attached, marked Sehedule "A", and m~de a part hereof; that the several
sums set opposite the names of the owners and the described lots and parcels of
land be, and the same are hereby respectively levied and assessed upon and against
said described lots and parcel.s of Land to defray the cost and expense of con-
structing and making the improvements wi thin said District; tha t the several stuns
so ~ssessed be coLLected from the respective owners of said loots and parcel.s of
land described in said 8ssessnent list, SChedule "A" as required by Law; that me
payement of said sums shall be made in twenty install.ments and the payment of said
instalLments snal.L extend over a period of nineteen years; the t "the payment of the
respective annual installments snal.l be made on or before the 3uth day of November
of eaCh year until payment of all instaliments together with the interest thereon,
shall be made; th!::Lt said sums fh aLl be paid and the COllection thereof shaLl be
made in the m~nner and in accordance with the law governing the COl.lection of
special improvement taxes; that failure to pay sucn assessment When the same become
due and payabLe shall. make such persona and said Lots and parceLs of land liable to

Section 2. That tne regular sesslon of tne Commission of The City of Bozeman
I to be held in the Commission 6hamber in the City Hal.l of said City on the 28th
day of October, 1~b4, at l:uu o'cloCk P.M., be, and the same is hereby designated
as the time and place at which objections to tne fin~i adoption of this Resuiution
will. be heard by said Commiss.1.on.
Section 3. 'J.'hat the IIlerk of tne Commission of '!Ohe '"'lty of Dozeman be, and he
is hereby ordered !::Lnd directed to pubiisn in the Bozeman Daily Chronlcie, a daily
newspaper printed and pubJ.1shed in the said '"'ity of Bozem!::Ln, a notice signed by
tne CLerK of the (,;onnnlssion and stating tba t a resolution Levying and assessing
a special assessment of taxes to defray me cost and expense of constructing and
making the Im~rovements in the said SpeclaL Improvement District No. 431 is on
fiLe in tne office of the Cl.erk of the lIommisslon subject to inspection for a period

NOTICE IS HEREBY GIVEN, that at a regull::\r session of the Commission of The
City of uozeman held on the 21st day of October, ~964,Commission Resolution No.
1146, was provisionally passed and adopted; that said vommission Resolution .levies
and assesses a special. assessment of taxes upon ail the property in Special
Improvement District No. 431 in said City, to defray the cost and expenses of
constructing and making the improvements wi thin said Dis trict, to-wit:
beginning
at a point on the centerline of Arthur Street and the East property line of South
Third Avenue; thence northerly along the East line of ~outh Third Avenue to a
point 150 feet North of the North property line of Arthur Street; thence easterly
150 feet North of Sind ~arallel to the North property line of Arthur Street to the
West property line of outh Grand Avenue; thence southerly along the West Line of
South Grand Avenue to a point 15U feet Soutn of the ~outh property line of Arthur
Street; ,thence westerly l5u feet South of and para~lel to the South line of
Arthur Street to a point on the East property line of ;;)()utnJ.hird Avenue; thence I
northerly along the East property line of Sou th Third Avenue to the point of
beginning
'l11a t, said Commission Resolution No. 1146 is now on file in the office
of the Clerk of the v ommission, subject 1p inspe ction for
a period of five (5)
days by any persons interested. That Wednesday, the 2Bth day of October,
1964
at l:UO .o'clock P.M., of said day at the regular sessinn of the said Commdssion
of The vity of Bozeman, at the Commission R0om, in the City Hall Building of
said City, has been designated as the time and place when and where the said
Commission will hear and pass upon any any a.1l objections that may be nBde to the
final passage, and adoption of said Resolution No. 1146, and the levying of said
assessment, and that said Resolution will be flnaily passed and adopted at said
regular mession.
All persons interested are referred to Commission Resolution No. lu70,
declaring it to be the intention of the Commission to Create ~pecial Improvement
Vistrict No. 431, and Commission Resolution No. lU76, crea ting Special Impro vement
Dis tric t No. 431, for c"nstructing a nd making the improvements therein.
