A RESOLUTION OF THE COMMISSION OF THE CITY OF' BOZEMAN,
MONTANA, LEVYING AND ASSESSING A Sl"'ECIAL ASSESSMENT OF
TAXES UPON ALL THE PROPERTY IN SillCIAL IMl"'ROVEMENT
DISTRICT NO. 427 IN THE CITY OF BOZEMAN, COUNTY OF
GALLATIN, STATE OF lVIOJITTANA, TO JjEFRAY THE COST OF CON-
STRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID
SPECIAL IMPROVENrENT DISTRICT NO.

WHEREAS, Tne City Commission of the City of riozeman, did on the
6th day of March, 1963, duly and regularly pass Commission Resolution No.
+065, en ti tled:
A RESOLUTION OF THE CITY COMMISSION OF THE CPPY OF
BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CI'l'Y
OF BOZEMAN TO CREATE A SFECIAL P"PROVEMENT DISTRICT
TO BE KNOWN AS SPECIAL IMPRQ'I,TEMENT DISTRICT NO. 427
OF THE CI'T'Y OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING
AND INSTALLI!lG A PAVEMENT PROJECT ON NORTH TENTH AVENUE
FROM BEALL STREET TO DURSTON ROAD. SAID fA VEMENT
PRO.JECT TO INCLUDE CONSTRUCTION AND D'STALLATION OF A
STORM SEWER LINE, COMBINATION CONCPETE CURBS AND GU'J'TERS,
GRAVEL BASE COURSE, CRUSlTED GRAVEL CUSHION mURSE, AND
BITUMINOUS, SURFACE COURSE.
and thereafter, after due and lega.i proceedh;gs had, the Commission of The
Ci ty of Bozeman did on me 27th da y of March, 1963, duly pASS Commission
Resolution No. 1066, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS
3i'ECIAL IMPROVEMENT DISTRICT NO. 427 OF THE CITY OF BOZEMAN FUR THE PURPOSE
OF CONSTRUCTING AND INSTAL,LING A PAVEMENT PROJECT ON NORTH TENTH AVENUE
FROM BEALL STREET TO DURSTON RuAD IN SAID CITY.
which Commission Resolutions Nos. 1065 and .i066, passed as aforesaid, are
hereby referred to and made a part of this resolution for further particulars
in respect to the boundaries of said district, the character of the improve-
ments to be cons truc ted the rein, the es tima ted cos t of said improvemen ts and
the method of assessing the cost against the property within said district;
and
WHE"P!EAS, said improvements as contemplated in said Commission Reso.iutlons I
Nos. Iv65 and Iv66 have been constructed and completed in accordance with tne
terms and conditions of Commission Reso.lutlons Nos. Iv65 and 1066, ""nd
the
total cost of said improvemen ts so constructed is the sum of Thirty Four
Thousand One Hundred Thirty Five dO.ilars and 55/1vv ($34,.i35.55)
NOW, THEREFORE, pursuant to the provJ.sl.ons of Sections 5225 to 52'1'1.5
and 5485, R.C.M., 1935 and amendments there to.
BE IT BESOL VED AND 1'1' IS HEREBY ORDERED BY 'l'HE CUMMISSION OF THE
CITY OF BOZE1ffiN, STATE OF MONTANA:
Section 1. That to defray ~he cost and expense of constructing and

Section 2. That the regular seas ion of the Commission of The City
of Bozeman to be held in the Commission Chamber in the City Hall of said

City on the 28th day of October, 1~64, at l:uu o'c.Lock P.M., be, and the same
is hereby designated as the time and place at which abjections to the final
adoption af this resolution will be heard by said Commission. .
Sec tion 3. That the Clerk of the Commission of The City af Bozeman, be,
and he is hereby ordered and directed to publish in the Dozeman Daily Chronicle,
a daily newspaper prin ted and published in the said Ci ty of Boz eman, a no tice
I signed by the Clerk of the Commission and stating that a Resolution levying
and assessing a s.!,Jecial assessment af taxes to defray the cost and expense
of cons true ting and m~king the imp "<'ovemen ts in the said Special Improvement
Di stric t No. 427 is on file in the office of the Clerk of the Commission
subject to inspection for a period of five ( 5) days; that said Notice
shall
state the time and place at which objections will be heard by the Commission
to the fina 1 adoption of this Resolution; that it shall be published at least
five (5 ) days before the day set by the uommission for the hearing of object-
ions and the finai adoption of this Resolution.
Provisionally passed and adopted by the Commission of the Ci ty of
Bozeman
at a regular session thereof held on the 21st day of October, 1964.

NOTICE ISHEREBY GIVEN, that at a regular session of the Commission of The
City of rlozeman held on the 21st day of October, 1964, Commission Resolution
No. 1143 was provisionally passed and adopted; that said Commission Resol-
ution levies and assesses a special assessment of taxes upon all the property
in Special Improvement District No. 427 in said City, to defray the cost
and expenses of constructing and making the improvements within said District,
to-Wit:
Beginning on the centerline of North Tenth Ave.
opposite the South Line of West Beail Street;
thence westerly to the East line of the alley
between North Tenth Avenue and North Eleventh
Avenue; thence northerly along the East line of
said alley to the South line of Durston Road;
thence eas terly along the South line of Durs ton
Road to the West line of the alley between North
Tenth Avenue and North Ninth Avenue; thence south-
erly along the Wes t line of said alley to the North
line of West Villard Street; thence southerly to
a point on the South line of West Villard Street
common to Lots 1 and 4 of Block 5 of Brunton Palffy
I Rearrangement of Durston 5ubdivion; thence sou

erly 150 feet East of and parallel to t he East
Line of North Tenth Avenue to a point on the South

That, said Commission Resolution No. 1143 is now on file in the office
of the Clerk of the Commission, subject to inspection for a period of five
(5) days by any persons interested. Tnat Wednesday, the 2t\ th da y of
October, 1964, at 1:00 o'clock P.M., of said day at the regular session
of the said Commission of the City of bozeman, ~t the Commission Room,
in the Vity Hall Building of said City, has been designated as the time
and place when and where the said Commission will hear and pass upon any
and all objections that may be made to the fina.L passage and adoption of

said Resolution No. 1143, and the levying of said assessment, and that said
resolution will be finally passed and adopted at said regular session.
All persons interested are referred to Commission Resolution No. 1065,
declaring it to be the intention of the Commission to create Special Improve-
ment District No. 42'1, and Commission Resolution No. lu66 , creating Special
Improvement District No. 427, for constructing and making the improvements
therein.
