COMMISSION RESOLUTION NO. 1152
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING AND
ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IM-
PROVEMENT DISTRICT NO. 432, IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE
OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING IMPROVEMENTS WITHIN
SAID SPECIAL IMPROVEMENT DISTRICT NO. 432.
WHEREAS, The City Commission of The City of Bozeman, did on the 5th day of June I
1963, duly and regularly pass Commission Resolution No. 1078, entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE
INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN
AS SPECIAL IMPROVEMENT DISTRICT NO. 432 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING
AN OUTFALL SEWER FROM BLOCK 3, ROYAL VISTA ADDITION TO THE CITY OF BOZEMAN TO POINTS
OF INTERSECTION WITH EXISTING SANITARY SEWERS AND SEPTIC SYSTEMS WITHIN THE CONFINES
OF MONTANA STATE COLLEGE, SAID SANITARY SEWER PROJECT TO INCLUDE ALL APPURTENANT WORK,
INCLUDING NECESSARY PIPE LINES, MANHOLES AND OTHER NECESSARY APPURTENANCES.
and thereafter, after due and legal proceedings had, the Commission of the City of
Bozeman did on the 26th day of June 1963, duly pass Commission Resolution No. 1080,
entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVE-
MENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 432, QF THE CITY OF BOZEMAN
FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN OUTFALL SEWER FROM BLOCK 3, ROYAL
VISTA ADDITION TO THE CITY OF BOZEMAN TO POINTS OF INTERSECTION WITH EXISTING SANITARY
SEWERS AND SEPTIC SYSTEMS WITHIN THE CONFINES OF MONTANA STATE COLLEGE.
which Commission Resolution No.'s 1078 and 1080 passes as aforesaid, are hereby referred
to and made a part of this resolution for further particulars in respect to the boundaries
of said district, the character of the improvements to be constructed therein, the estim-
ated cost of said improvements and the method of assessing same against the property
within said district; and
WHEREAS, said improvements a.s contemplated in said Commission Resolution No.' s
1078 and 1080 have been constructed and completed in accordance with the terms and con-
ditions of Commission Resolution No.'s 1078 and 1080 and the total cost of said improve-
ments so constructed is the sum of 6ne Hundred Eighty Seven Thousand Seven Hundred Twenty
Nine and 20/100 ($187,729.20) dollars.
NOW THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485 R. I
C.M., 1947 and amendments thereto.
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE
CITY OF BOZEMAN, STATE OF MONTANA
Section 1. That to defray the cost and expense of constructing and making the
improvements in said Special Improvement District No. 432, there be and, there is here-
by levied and assessed a tax amounting to the sum of One Hundred Eight Seven Thousand
Seven Hundred Twenty Nine and 20/100 ($lE~7, 729.20) dollars upon A,ll the property in
said Special Improvement District No. 432,that a particular description of each lot and
parcel of land with the name of the owner and the sum assessed a.gainst him or it for
such improvements and the amount of each partia.l payment to be made and the day when
the same shall be delinquent is set forth in detail in the assessment list hereto
attached, marked Schedule "A", and made a part hereof; that the several sums set oppos-
ite the names of the owners and the described lots and parcels of land be, and the
same are hereby respectively levied and assessed upon and against said described lots
and parcels of land to defray the cost and expense of constructing and making the
improvements within said District; that the several sums so assessed be collected from
the respective owners of said lots and parcels of land described in said assessment
list, Schedule "A" as required by law; that the payment of said sums shall be made
in twenty installments and the payment of said installments shall extend over a. period
of nineteen years; that the payment of the respective annual installments shall be
made on or before the 30th day of November of each year until payment of all install-
ments together with the interest thereon, shall be made; that said sums shall be paid
and the collection thereof. shall be made in the manner and in accordance with the law
governing the collection of special improvement taxes; th,t failure to pay such assess-
ments when the same become due and payable shall make such persons and said lots and
parcels of land liable to the penalties provided by law relative to delinquent taxes.
Section 2. That the regular session of the Commission of The City of Bozeman to I
hold in the Commission Chamber in the City Hall of said City on the 4th day of November,
1964, at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place
at which objections to the final adoption of this Resolution will be heard by said
Commission.
Section 3. That the Clerk of the Commission of The City of Bozeman, be, and he
is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily news-
paper printed and published in the said City of Bozeman, a notice signed by the Clerk
of the Commission and stating that a Resolution levying and assessing a special assess-
ment of taxes to defray the cost and expense of constructing and making the improve-
ments in the said Special Improvement District No. 432 is on file in the office of the
Clerk of the COIT@ission subject to inspection for a period of five (5) days; that said
Notice shall state the time and place at which objections will be heard by the Commission
to the fina.l adoption of this Resolution; that it shall be published at least five (5)

adoption of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman at a
regular session thereof held on the 28th day of October, 1964.

HEARING, FINAL ADOPTION OF COMMISSION RESOLUTION NO. 1152 LEVYING ASSESSMENT
SPECIAL IMPROVEMENT DISTRICT NO. 432, CITY OF BOZEMAN, SANITARY SEWER LINES
FROM ROYAL VISTA ADDITION TO MONTANA STATE COLLEGE.
NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the
City of Bozeman held on the 28th day of October 1964, Commission Resolution No. 1152,
was provisionally passed and adopted; that said Commission Resolution levies and assesses
a special assessment of taxes upon all the property in Special IIrtprovement District No.
432, in said City to defray the cost of constructing and making the i~mprovements within
said District, to-wit;
Beginning at a Northeast corner of Section 11, T 2 S, R 5 E, M.P.M., thence in a wester-
ly direction along the north line of said Section 11 at a bearing of S880 01' 74" W a
distance of 1,351.22 feet, more or less, to the northwest corner of the NE~~ of said
Section 11; thence in a southerly direction along the west line of the E~E~ of said Sec-
I tion 11, a distance of 4,942.76 feet to a point on the north line of Mountain Vista
Sub-division as platted and of record in the County Clerk and Recorder's Office, Gallatin
County, Montana; thence in an easterly direction along the north line of said Mountain
Vist~ ~u~division t? the west line of South 20th Avenue as pla~ted ~nd of record in Kirk
Subdlvlslon, Gallatln County, Montana; thence in a northerly dlrectlon along the west
line of said South 20th Avenue to a point 100.2 feet north of the north line of West Dick-
erson Street as platted in Kirk Subdivision; thence in an easterly direction 100.2 feet
north of and parallel to the north line of said West Dickerson Street to the east line
of Section 11; thence in a southerly direction along the east line of Section 11 to the
centerline of West College Street, also known as Huffine Lane and being the south line

Werre Rearrangement of portions of West Side Addition; thence in a northerly direction
83.41 feet distant from and parallel to the west line of Block 7 of said Werre Rearrange-
ment to the north line of said Werre Rearrangement; thence in a westerly direction along
the north line 0:( said Werre Rearran~ement to a point on the west line of South 15th
to the Northeast corner of the SW~W~, section 121 T2S, R5E, M.P.M.; thence in a west-
erly direction along the north line of said swi:sW... Section 12 to a point on the west
I line of said Section 12; thence in a northerly direction along the west line of said
Section 12 to the west quarter corner of said Section 12; thence in an easterly direc-
tion along the north line of the S\v~ of said Section 12 to a point 69.28 feet east of

27' 15" E a distance of 262.73 feet to a point on the southerly right-of-way of U.S.
Highway No. 191; thence in a northeasterly direction across the right-of-way of U.S.
Highway No. 191, to the Southeast corner of Lot 1, Cleveland Subdivision, as platted and
recorded; thence in a. northerly direction along the east line of said Cleveland Sub-
division a distance of 951.25 feet, more or less, to a point on the south line of the
NE~W~, Section 12, T2S, R5E, M.P.M.; thence in an easterly direction along the south
line of said NE~\v~ to a point on the east line of the NW~ of said Section 12; thence
in a northerly direction along the east line of the NW~ of said Section 12; thence in
a northerly direction along the east line of the NW~ of said Section 12 to the North
Quarter Corner of said Section 12; thence in a westerly direction along the north line
of the NW~ of said Section 12, said line being the centerline of Durston Road, to the
centerline of North 17th Avenue; thence in a northerly direction along the centerline
of North 17th Avenue a distance of 761.6 feet, more or less <to a point opposite the

the south line of Lot 12, Homesites, a suburb of Bozeman, Montana, as platted and of
record; thence in an easterly direction a distance of 30 feet to the southwesterly
corner of said Lot 12; thence in an easterly direction along the south line of said
Lot 12, a distance of 570.2 feet to the southeast corner of said Lot 12; thence in a
northerly direction along the east line of said Lot 12 and continuing along the east
line of Lots 14 and 16, a distnace of 360 feet, to the northeast corner of lot 16 of
said Homesites, thence in a westerly direction along the north line of Lot 16 and con-
tinuing along the north line of Lot 15 of said Homesites to the centerline of North I
19th Avenue as platted and of record; thence in a southerly direction a.long the center-
line of North 19th Avenue to the point of beginning.
That, said Commission Resolution No. 1152 is now on file in the office of the
Clerk of the Commission, subject to inspection for a period of five (5) days by any
persons interested. That Wednesday, the 4th day of November, 1964, at 1:00 o'clock P.M.,
of said day at the regualr session of said Commission of the City of Bozeman, at the
Commission Room, in the City Hall B~ilding of said City, has been disignated as the time
and place when and where the said Commission will hear and pass upon any and all object-
ions that may be made to the final passage a.nd adoption of said Resolution 1152, and
the levying of said assessment, and that said Resolution will be finally passed and
adopted at said regular session.
All persons interested are referred to Commission Resolution No. 1078, declar-
ing it to be the intention of the Commission to create Special Improvement District No.
432, and Commission Resolution No. 1080, creating Special Improvement District No. 432,
for constructing and making the improvements therein.
