A RESOLUTION OF THE COMMISSION OF THE CI'lY OF BOZEMAN, MONTANA,
LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES U~ON ALL THE

WHEREAS, The City Commission of the City of Bozeman, did on the 21st day I
of August, 1~63, duly and reguiarly pass Commission Resolution No. lue4,
entitled:

hereby referred to and made a part of this resuiu~ion for further parti- I

WHEREAS, said improvements as con telilj,J.L1;i. ted in sa id Commls s .LOn Resuiutions
No. 's lU/j4 and iu8tj ffi ve been const.ructed and COmlJielied in accordance wi tn
the terms and c undi t~ons 0 f Oommiss~on Resolutions No.' s 1084 and lu8S, and
the total cost of said improvements so constructed is the Bum of Forty-Five
'l'housand ~ight Hundred Seventy Six and '4/1iJU dol.lars. ($45,B76 .74).
NOW, THEREFORE, pursuant to the provisions of Sections 5335 to 5277.5
and 5485, R. C. M., 194'7 and amendments thereto.
BE IT RESOLVED AI\TD IT IS I BEEBY ORDERED BY THE COMMISSION OF'
THE cr TY OF' BOZEMAN, STATE OF MONTANA:
Section 1. ~bat to defray ~he cost and expense of constructing and
making the improvements in said Special Improvement Dist. No. 434, there be,
and there is hereby levied and assessed a tax a moun ting to the sum of :b'orty
Five Thousand Eight Hundred Seventy Six and 74/1iJU Dollars ($45,/:j76.74)
upon all the property in said Special Improvement District No. 434, that
a particu.Lar description of each lot and parcel 0 f la rrl wi th the name of I
the owner and the sum assessed agains t him or it for such improvements
and the amount of each partial pa yment to be made and tile day when the same
shall be delinquent is set forth in detail in the assessment list hereto
a ttached, marked Schedule "A", and made a part hereof; tm t the several
sums set opposite the names of the owners and the described lots and parcels
of land be, and the same are hereby respectively levied and assessed upon

and against said described lots and parcels of land to defray the cost and expense of
constructing and making the improvements within said District; that the several sums
so assessed be collected from the respective owners of said lota and parcels of land
described in said assessment list, Schedule nAn as required by law; that the payment
of said sums shall be made in twenty installments and the payment of said installments
shall extend over a period of nineteen years; that the payment of the respective annual
installments shall be made on or before the 30th day of November of each year until
payment of all installments together with the interest thereon, shall be made: that said
I sums shall be paid and the collection thereof shall be made in the manner and in accord-
ance with the law governing the collection of special improvement taxes: that failure
to pay such assessments when the same become due and payable shall make such persons
and said lots and parcels of land liable to the penalties provided by law relative to
delinquent taxes.
Section 2. That the regular session of the Commission of The City of Bozeman
to held in the eommission Chamber in the City Hall of said City on the 28th day of
October 1964 at 1:00 o'clock P.M., be, and the same is hereby designated as the
time and place at which objections to the final adoption of this Resolution will
be heard by said Commission.
Section 3. That the Clerk of the Commission of The City of Bozeman be, and he
is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily news-
paper printed and published in the said City of Bozeman, a notice signed by the Clerk
of the Commission and stating that a Resolution levying and assessing a special assess-
ment of taxes to defray the cost and expense of constructing and making the improve-
ments in the said Special Improvement District No. 434 is on file in the office of the
Clerk of the Commission subject to inspection for a period of five (5) days; that
said Notice shall state the time and place at which objections will be heard by the
Commission to the final adoption of this Resolution; that it shall be published at
least five (5) days before the day set by the Commission for the hearing of objections
and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman at a
regular session thereof held on the 21st day of October 1964.

HEARING, FINAL ADOPTION OF COMMISSION RESOLUTION 1148 LEVYING ASSESSMENT
SPECIAL IMPROVEMENT DISTRICT NO. 434, CITY OF BOZEMAN, PAVING ON SPRING
CREEK DRIVE FROM THE SOUTH LINE OF THOMPSON ADDITION NUMBER THREE TO THE
INTERSECTION WITH THE EXTENSION WITH THE WEST LINE OF LOT ONE, BLOCK FOUR
OF SAID ADDITION, ALSO A PORTION OF HIGHLAND COURT.
NOTICE IS HEREBY GIVEN, THAT at a regular session of the Commission of The City
of Bozeman held on the 21st day of October 1964, Commission Resolution No. 1148,
was provisionally passed and adopted; that said Commission Resolution levies and
assesses a special assessment of taxes upon all the property in Special Improvement
District No. 434 in said City, to defray the cost of constructing and making the
improvements within said District, to-wit:
Beginning at a stone monument marking the Southwest Corner of Section 18, Township
2, South, Range 6 East of the Montana Principal Meridian; thence S 89- 24' East
I along the southerly boundary of said Thompson Addition Number Three a distance of
836.99 feet to the southwest corner of Lot 7 of Block 2 of said Thompson Addition
NUmber Three to the City of Bozeman, Montana, being the true point of beginning;
thence in a northeasterly direction along the westerly line of Lots 1 through 7 of said
Block 2 of said Thompson Addition Number Three to the northwesterly cornre of Lot 1 of
said Block 2; thence N 16- 10' E a distance of 66 feet to the northerly line of High-
land Court; thence continuing N 16- 10' E a distance of 140 feet, to a point of inter-
section with the southerly line of Lot :2 of Block 3 of said Thompson Addition Number
Three; thence N 73. 50' W along the southerly lot line of Lots 2 and 1 of said Block
3 a distance of 61.26 feet to the southwesterly corner of Lot 1: and said line pro-
jected; thence N 30- 20' W along the southwesterly line of Lot 1 and said line pro-
jected across Spring Creek Drive a distance of 210.03 feet to the northwesterly
line of Spr9ng Creek Drive; thence continuing N 30. 30' 10" W a distance of 110 feet
to a point of intersection with the north westerly line of Lot 2 of Block 4; thence

corner of Lot 1 of said Block 4; thence N 00 49'W a distance of 76.08 feet to a point
of intersection with the northerly boundary line of said Thompson Addition Number Three;
thence N 890 11' E along said northerly line of said addition a distance of 571.87 feet
to a point of curvature; thence along the northeasterly line of said Thompson Addition
Number three being along a curve of 476.67 feet in radius, a distance of 253.28 feet
to the northeasterly corner of said Thompson Addition Number Three; thence in a south-
westerly direction along the easterly boundary of said Thompson Addition Number Three I
a distance of 1286.96 feet to the southeasterly corner of said addition; thence N 890
24' W along the southerly line of said Thompson Addition Number Three a distance of
483.19 feet to the true point of beginning.
That, said Commission Resolution No. 1148 is now on file in the office of the
Clerk of the Commission, subject to inspection for a period of five (5) days by any
persons interested. That Wednesday, the 28th day of October, 1964,at 1:00 o'clock
P.M., of said day at the regular session of the said Commission of the City of Bozeman,
at the Commission Room, in the City Hall Building of said City, has been designated as
the time and place when and where the said Commission will hear and pass upon any and
all objections that may be made to the final passage and adoption of said Resolution
No. 1148, and the levying of said assessment, and that said Resolution will be finally
passed and adopted at said regular session.
All persons interested are referred to Commission Resolution No. 1084 declaring
it to be the intention of the Commission to create Special Improvement District No.
434, for constructing and making the improvements therein.
