Home My WebLink AboutResolution 1162 Creates SID No. 445 :~H5 COMMISSION RESOLUTION NO. 1162 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNmVN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 445 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE PAVEMENT PROJECT WITH INTREGAL CONCHETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES TO SAID CONSTRUCTION AND INSTALLATION ON THE FOLLOW- I ING STREETS AND AVENUES, TO-WIT: A POHTION OF NOHTH EIGHTEENTH AVENUE BETWEEN DURSTON ROAD AND THE SOUTHERLY LOT LINES OF LOT 26, BLOCK "A" A!)!D LOT 9, BLOCK "B" OF GRAF'S FIRST REARRANGEMENT OF BLOCK 6 OF KIRK'S SECOND SUBDIVISION TO THE CITY OF BOZEMAN, HONTANA. ---------- ~VHEREAS, there has been filed with the Clerk of the City Conunission of the City of Bozeman, Montana a petition in due form of certain owners of properties situated on a portion of North Eighteenth Avenue between Durston Road and the southerly lot lines of Lot 26, Block "A" and Lot 9, Block "B" of Graf's First Hearrangement of Block 6 of Kirk's Second Subdivision to the City of Bozeman, Montane'_, asking that a fipecial improvement district be created for the purpose of constructing and installing an asphaltic-concrete pavement project to include intregal con- crete curbs and gutters, and other work incidental thereto; and WHEREAS, at a re,s>;ular meeting of the City Commission of the City of Bozeman held on the 9th day of December, 1964, the afore ~;aid petit ion v>Jas respectively considered and granted; NOW, THEHEFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improv ment District No. 445 for the purpose of constructing and installing an asphaltic-concrete pavement project on a portion of North Eighteenth Avenue between Durston Road and the southerly lot lines of Lot 26, Block "A" and Lot 9, Block "B", Graf's First Rearrangement of Block 6 of Kirk's Second Subdivision to the City of Bozeman, Montana. Said pavement project to include construction and installation of intregal concrete curbs and gutters and necessary appurtenances to said pavement, and other work incidental thereto. I Section 2 Boundaries The boundaries of said Special Improvement District No. 445 are described as follows: Beginnin,g at the northeasterly corner of Graft s First Rearrangement of Block 6 of Kirk's Second subdivision to the City of Bozeman, Montana; thence westerly along the northerly line of said Graf's First Rea,rrangement a distance of 20 feet to the north- easterly corner of Lot 1 of Block "B" of said Grafts First Rearrangement, being the true point of beginning; thence southerly along the easterly lot lines of Lots 1 through 9 of Block "B" of said Graf's First Hearrangement to the southeasterly corner of said Lot 9; thence westerly along the southerly line of said Lot 9, and across North Eighteenth Avenue and along the southerly lot line of Lot 26 of Block "A" of said Grafts First Rearrangement to the southwesterly comer of said Lot 26; thence northerly along the westerly lot lines of Lots 26 through 34 of Block "An of said Graf's First Rearrangement to the northwesterly corner of said Lot 34; thence easterly a,long the northerly line of said Grafts First Rearrangement to the true point of beginning; Included within the above described exterior boundaries the following Lots and Blocks, to-wi t : Lots 26 through 54 inclusive, of Block "An and Lots 1 through 9 inclusive, of Block "E" of Graf's First Rearrangement of Block 6 of Kirk's Second Subdivision to Bozeman, Montana. Section 3 Chara.cter of Improvements I Construction of a pavement project with intregal concrete curbs and gutters and necessary appurtenances t.o said construction on a portion of North Eighteenth Avenue between Durston Hoad and the f;outher ly lot lines of Lot 26, Block "A" and Lot 9, Block "B" of Graf's First Hearrange- ment of Block 6 of Kirk's Second Subdivision to the City of Bozem<'ln, Montana, said pavement pro,ject to include construction and installation of a st.orm sewer line, combinat.ion concrete curbs and gutters, gravel base course, crushed gravel cushion course, andan asphaltic-concrete type surface course. :~86 Section 4 Estimate of Cost The preliminary estimate of cost is $16,000.00, including all street excavation, all materials, installation costs and engineering and incidentals. Section 5 I Method of Assessment The cost of ~;uch improvement is to be assessed against the entire district, each lot or parcel of land within such district will be assessed for that part of the whole cost, which its area bears to the area of the entire district, exclusive of streets, avenues, alleys and public places; and further, each square foot of land within the district lying within 25 feet of the line of the street on which the improvements herein provided for are made, shall bear double the amount of the costs of such improvements per square foot of such land that each square foot of any other land within the district shall bear. Section 6 Payments That the payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner 1f,rho desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improve~ ment District No. 445, as authorized by law. Such bonds will be in denominations of ~plOO.OO each and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 445 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singl;y or in multiples, and in the order of their ret;istration, whenever funds are available for that purpose in said Special Improvement District No. 445. Said bonds will draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6%) per annum, which interest shall be chargeable as a part of the cost of construction and installation of said improvement. The bonds will be issued and sold in accordance vYith the provisions of Section 11-2232 and Section 11-2271, Revised CQdes of Hontl-ma, 1947, and all other applicable provisions of Title 11 of the Hevised Codes of Hontana, 1947, relating to special improvement districts in cities and towns and any amendments thereof or thereto. I Section 7 Protests and Notice That the regular ses:i>ion of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 30th day of December, 1964, at the hour of one o'clock p.m. of said day, is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 445, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof, and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as required, of the A,doption of this resolution of intention.
