Ci ty of .oozeman, Montana, a pe ti tion in due form of certain owners of prop-
erties situated on Thirteenth Avenue South and Fourteenth Avenue South, as shown
in the above caption, asking that a specia.L improvement dis trict be created for
the purpose of constructing aro. install"ng an asphaltic-concrete lBvement
project to include intrega.L concrete curbs and gutters, storm drainage, and
other work incidental thereto; and
WHEREAS, at a regulHr meeting of ttle Gity Commission of
the Ci ty of Bozeman
heLd on the 2uth day of JanlJary, 1965,
the aforesaid peti tion was respe c ti vely
considered and granted;

Declaration of Intention
'l'hat it is hereby declared to be the intention of the \.Iityof' Bozeman to
I create a special improvement district to be known and designated as Special
Improvement District No. 443 for t he purpose of constructing and mstalling an
asphaltic-concrete pavement project on Thirteenth Avenue (L3th) South, from
the Northerly line of' West KOCh Street, nor the rly to the nort.herly line of'
Corcoran's Rearrangement of dLocks 3, 4, 5 and 6 of West Side Addition to
the City of Bozeman, Montana, and on Fourteenth Avenue (14th) South fram the
northerly line of West Koch Street, northerly to the nortner.J.Y line of \.Iorcorans
Rearrangement of ~Locks 3, 4, 5 and 6 of West Side Additinn to the City of
Bozeman, Montana.

Section 5
Method of Assessmen t
The COB t of such Improveme nt is to be assessed agains

each lot or parcel of land wi thin such di s tric t will be assessed for tiba. t part

clusive of streets, avenues, <:illeys and public places;
and further each square
foot of land within the district lying within 25 feet of the line of the street
on which the irprovements herein provlded:for are made,

amount of the costs of such improvements per square foot of sucn land that each
square foot of any other land wi thin the distric t
shall bear
Section 6
Payments.
~hat the payments for said improvements shall be made in 'twenty
(20) annual
installments extending over a period of nineteen ( 19)
years,
but this shall not
be construed to prevent payment in full at anyr eguLar payment
date by any pro-
perty owner who desires to do so.
It is proposed to pay the
en tire cas t and
expense of the construction and installation of said improvements witn cash to
be obtained from the sale of bonds of said ,5pecial Improvement 'uistrict No. 443,
as author1 zed by law. SUCLl bond s will be in denomina tions of $100 .Uu oeach, and
fractLms or multiples of $100.00 where necessary, to be issued and chargeable
against a fund to be known and designated as S:p9cial Improvement District No.
443 Fund of the Ci ty of Hozeman. The bonds will be redeemable a t the optl on of
the City, singly or in multiples, ani in the order of their registration, when-
ever funds are available for that purpose in ~aid Special Improvement District
No. 443. Said bonds wi.1l draw a simpie interest from the
date of their regis-
tration unt1l ca.1led for payment, at a rate not
to exceed six percent

annum, which interest shall be chargeable as a p;lrt of the cost of construction
and installation of said improvements. '.L'he bonds
will be is sued and 00 1d in
accordance with the provisions of Section 11-2232 and Section 11-22'11, Rev~sed
Codes of Montana, 1947, and all other applicable provisl.ons of '.I.ltle 11 of the

Wednesday, the 17th day of February, 1965, at the hour"of one o'clock p.m. of
said day, is the time and place, when and whe re the C1 ty Commission will hear
and pass upon all protests duly and reguiarly made ~nd fiied against the crea-
tion of said proposed SpeciaL Improvement District No. 4431 the improvements

proposed to be taken by said resolution when and where any and all persons whose
property 1s within said proposed Special Impro vemen t Distric t No. 443 may appear
and show cause, if any the y ha ve, aga1.ns t said proposed iroprov,ements. Object-
ions must be made in writing and filed with the Clerk of the City Commission
not later than fifteen (15) days after date of the first publication of this
notice.
An approximate preliminary esti a te of the cos t of t he improvements to be
made is $25,OuO.vO, including all street excavation, all. ml:iterlals, installation
costs and engineering and incldentals.
Payment for the Improvements is to be made in twenty (20) annual installments
over a period of nineteen (l'i:}) years with interest on the deferred paj11TIents not
to exceed six percent (6) per annum, payable annually, but this shall not be
construed to prevent payment in fUll at any regular payment date by any property
owner.
For a description of the boundaries of said SpeC1al Improvement District
No. 443, reference is hereby made to Resolution No. 1177 of the Commission of
the City of Bozeman declaring the intention to create said district, which is on
file in the offi(}e of the undersigned Clerk of said Commie sion in the C1 ty Hall
of said 6ity of Bozeman, State of Montana. and open for inspection to all
interested parties and tne public generally.

Codes of Montana, 1947.
