A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN
CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNO~W AS
SPECIAL IMPROVEMENT mSTRICT NO. 453 OF THE CITY OF BOZEMAN
FOR THE PURPOSE OF OPERATING AND l\1AINTAINING A STREET
LIGHTING SYSTEM TO LIGHT NORTH NINETEENTH AVENUE, FROM MAIN
STREET TO DURSTON ROAD, NORTH TWENTIETH AVENUE FROM MAIN I

WHEREAS, at a regular session of the Commission of the City of Bozeman, State
of Montana, held on the 17th day of February, 1965, the said Commission duly passed
Commission Resolution No. 1178 declaring it to be the intention of the said Comm-
ission to create a sEecial improvement district tq be known and designated as
Special Improvement istrict No. 453 of the said ~ity forthe purpose of operating
and maintaining a street lighting system to light North Nineteenth Avenue from
Main Street to Durston Road, North Twentieth Avenue from Main Street to Durston
Road, North Twenty-First Avenue from West Beall Street to Durston Road, a portion
of West Beall Street and a portion of Durston Road from North Nineteenth Avenue
to a point 117 feet West of North Twenty-first Addition and West Park Manor Second
Addition to the City of Bozeman, Montana, said lighting system to be installed
and paid for by the Montana Power Company, all under the authority of and in
conformity with Sections 11-2245 and 11-2257 inclusive, of the Revised Codes of
Montana, 1947, which said Resolution of Intention is of record and on file in the
office of the Clerk of said City Commission and open to the inspection of the
public, and is hereby referred to for further particulars; and
WHEREAS, due proof has been made that service of notice of the adoption of
said Resolution No. 1178 was duly made and given as by law provided; and
WHEREAS, at the time and place fixed in said Resolution No. 1178 for the making
and filting of prote~ts against the creation of said proposed Special Improvement
Lighting District No. 453, to-witt, at the hour. of 1:00 o'clock P.M. on Wednesday,
the 17th day of Febre ary, 1965, being a regular meeting time of said City Commis si on,
at the Commission Chamber in the City Hall building of the City of Bozeman, there
were not sufficient protests made or filed against the creation of said Special I
Improverrent Light ing District No. 453.
NOW, THEREFORE, BE IT RE3JLVED BY THE COMMISSION OF THE CI/I'Y OF BOZEMAN:
Section 1
That there be, and there is hereby created a special improvement district of
the City of Bozeman to be known and designated as Special Improvement Lighting
District No. 453, for the purpose of installing and main taining a light ing system
to light North Nineteenth Avenue from Main Street to Durston Road, North Twentieth
Avenue from Main Street to Durston Road, North Twenty-First Avenue from West Beall
Street to Durston Road, a portion of West Beall Street and a portion of Durston Road
from North Nineteenth Avenue to a point 117 feet West of North Twenty-First Addition
and West Park Manor Second Addition to the City of Bozeman, Montana, said lighting
system to be installed and paid for by the Mont ana Power Company, all under the
authorit~ of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the
Revised odes of Montana, 1947, pursuant to an in conformity with Commission Resol-
ution No. 1178 of the Commission of the City of Bozeman, passed and adopted on the
17th day of February, 1965, which said Commission Resolution No. 1178 declares it
to be the intention of said City Commission to create said Special Improvement
Lighting District No. 453 for the purposes aforesaid, and which said Commission
Resolution No. 1178 is of record and on file in the office of the Clerk of said
City Commission in t he City Hall Building, Bozeman, and is open to the inspection
of the public, and is hereby referred to for further particulars.
Section 2
That said Commission Resolution No. 1178 is hereby referred to am made a part
hereof for further particulars in respect to the boundaries of said Special Improve-
ment District No. 453, the estimated cost of said improvements and the method of
assessing the same again st the property of said District.
Sectio n 3 I
The character of the improvement to be installed and paid for by the Montana
Power Company is the erection and installation of eight-one (8l) 175 Watt Mercury-
Vapor, color corrected luminaries, mounted on 30 feet high steel poles. Power is
to be fed by a single overhead wire and the installation shall be equipped with
all necessary appliances for the safe and proper operation of the system.
Section 4
The proposed Special Improvement Lighting District will be established for the
the purpose of paying the operating and maintenance cost of such lights only, which
said operation and maintenance will include the furnishing of electric current, all
lamps as needed and the maintenance of poles, cables, and other incidental items.
The entire installation cost of such lights will be borne by the Montana Power Company.

The portion of the cost of maintenance and electrical current payable by the City
of Bozeman will be paid directly by the City of Bozeman and the portion to be
assessed against the property within the district will be assessed and paid annually
as provided by law.
PASSED AND ADOPTED by the Commission of the City of Bozeman at a regular session
